ZONING BOARD OF APPEALS
REZONING AND PRELIMINARY PLAT HEARINGS
JUNE 23, 1987
Pursuant to due call and notice thereof, the Zoning Board of
Adjustment and Appeals met on Tuesday, June 23, 1987 at 7:30
p.m. in City Hall to conduct a public hearing.

Purpose of the meeting: Purpose of the meeting was to hold a
hearing to consider the request to rezone and hold a
preliminary plat hearing.
Chairman Ben Kremer called the meeting to order and opened
the rezoning hearing. Dale Salo stated his request to rezone
the newly annexed property legally described as Outlot "A"
Cloverdale Estates Second Addition, 25.95 acres, from the
Agriculture zoning it acquired on entering the City to R-1 to
allow for single familv home development of the property.
Rezone Outlot A: The Commission discussed the request and
there was no public input. Sister Kathleen Kalinowski made a
motion to recommend to the Council to grant the request to
rezone Outlot A, Cloverdale Estates Second Addition to R-1;
seconded by Tom Nahan.
Ayes: Kremer, Kalinowski, Budde, Nahan, Klein.
Naves: None. Motion carried.
The rezoning hearing was closed.
~r~!i!!!iDªIY ~!ª.t H§ªIiDg..:.. At 8:00 p.m. Chairman Kremer opened
the preliminary plat hearing. Dale Salo and his engineer
presented and discussed his proposed plans and changes he had
made as requested by the Planning Commission. He discussed
how he had allowed for solar energy use on some of the lots;
that 35 of the lots are over 10,800 square feet; the drainage
has been studied; provisions for sewer on the 5 lots on the
lowest elevation will have to be made as they are to low to
be serviced by the City system with out extra provisions; the
storm sewer drainage.
Question from floor - would there by a public hearing for the
final plat? Chairman stated that the Commission would
probably want to hold one.
Drainªg~-=- Questions on increased drainage and the handling
of it; was the drainage permission received from the
Watershed District? RCM engineer stated that they will not
block drainage from the natural flow and will not run off
more than the terrain handles now but there will be increase
from the developed driveways and streets. The Watershed
District probably does not require permits for this type of
drainage. Tom Nahan asked what will be done to the pond to
hold the extra drainage. Mr. Salo stated that he would leave
it up to the engineers, if there is a problem, and they
haven't determined that yet. Duane Gaida asked about the
increased water in the pond and how it would be controlled to
not have an adverse effect on the other property owners at
lower elevations. He stated he his drain field was under
water and the pond was at the same height as his septic tank
last year. Joe Bettendorf stated that the developer will be
required to take care of additional problems of additional
runoff from development but not to take care of existing
problems.
Traffic: Concerns were expressed concerning the increased

traffic from the development. Property owners on Dale and
Calloway Streets have petitioned the Township to vacate these
two stub streets. Discussed was increased traffic on 7th and
9th Avenues. The narrow and light traffic construction, may
require reconstruction of 7th Avenue in the future, and who
would be responsible for the cost of reconstruction, should
Dale and Calloway Streets not be vacated as has been
petitioned to the Township. There were safety concerns on
9th Avenue because of many small children in the families
living on 9th Avenue. and the need to build Baker Street to
city standards. Also discussed were the comprehensive plans
through APO for collector streets at 12th Avenue and south of
the proposed development which would alleviate the traffic
problems, but this is a long range plan and probably will not
be constructed for some time. The City Engineer informed the
group that the cost of construction and reconstruction of
streets is the responsibility of the adjacent property owners
as the Council determines through the assessment process.
Safety of streets is always a concern, but streets are
dedicated for public traffic use only.
Concerns were expressed on the affect this development will
have on surrounding properties by acting as a buffer to
future development in the area.
Questions were asked if the developer would be allowed to
develop the property in sections; which Mr. Salo indicated he
intended to do. The Planning Commission stated they had not
allowed this in the past and requested Mr. Salo look into
bonding the entire development at the required 125% of the
anticipated budget costs.
The Chairman closed the public hearing at 10:25 p.m. and
stated the Planning Commission would defer making a
recommendation until the next regular meeting on July 6,
1987, contingent on the Township's action on the vacation of
the stub streets of Dale and Calloway, adjacent to the
proposed development.
The meeting was adjourned at 10:30 p.m.
