Minutes of the st. Joseph Planning Commission
October 5, 1987
Members present: Hub Klein, Tom Nahan, Ben Kremer, Phil Durkee,
Art Budde, Rachel Stapleton (City Clerk)
Others present: Betty Pfannenstein, Dennis Stueve, Pat Ehlert,
Allen Ehlert, Pat Zahler, Dan Nierengarten, Ross
Riele (Council laison).
A Public Hearing was called to order at 7:30 p.m. by Ben Kremer to
consider a request from Allen Ehlert for a special use permit to
build an addition~tö an existing garage at fuis residence at 114
1st Ave. S.E. The request was for an additional 480 sq. ft. for the
purpose of storing day-care play equipment. After discussiong the
request, the Commission decided that a variance request was more
appropriate because the house and property are primarily used as a
private residence with the Day Care being a home occupation with
10 children or less, and the~ore, not carrying a Special Use permit.
The requested additional garage space seemed too large to the Commission
just for storage of Day Care play equipment, and there was no just-
ifiable reason for granting additional sp ~:e beyond that allowed by
the Ordinance for private residential use. Phil moved to recommend
the granting of a variance for the construction of an additional 240
sq. ft. garage or other accessory building for the purpose of
storing day-care equipment. 'fhe reasons for granting the variance
,.,ere as follows:
1) the residence is used for a group day-care business
with 5-10 children;
2) the lot is above average size;
3) the safety of the children is enhanced by having a
storage place for play equipment;
4) the request has the support of neighbors.
Tom seconded the motion and it was passed unanimously. The hearing
was adjourned.
