MINUTES OF THE ST. JOSEPH PLANNING COMMISSION
June 6, 1988

At 7:30 Ben Kremer called a meeting to order of the Zoning Board of
Adjustments and Appeals to consider a request by Mike Scherer to rezone
two parcels of property. The legal descriptions of the parcels were
stated in the notice for a public hearing. One parcel that now contains
the Scherer trucking business would be rezoned from agricultural to
industrial; the other parcel, containing an office for the business,
would be rezoned from residential to industrial. The Scherer business
recently petitioned to come into the City from the Township.
Dan Eller, representing Scherer Trucking, discussed with the Board the
need to rezone the property because the business has been operating
prior to either Township or City zoning ordinances were in effect. The
Board discussed the placement of the buildings on the properties and the
size of them. Provision for the fifty foot buffer zone between
industrial and residential zoned property was raised. On the east side
~ there is not room to provide for a buffer zone; the building is five
feet from the property line. Other concerns were raised on the future
expansion of the industrial zone and traffic on Minnesota Street. Art
Budde made a motion to postpone a decision until the City Attorney can
give an opinion on if a variance is needed on the setback requirements
and buffer zone requirements; seconded by S. Kathleen. The motion
passed unanimously. The public hearing before the Zoning Board was
adjourned.
Dale Jacobson and Jim Colt, representing the st. Joe Family Dental
Providers, inquired about requirements for building on a lot which they
plan to purchase located on 2nd Ave. N.W. between Ash st. and Minnesota
St. The lot is about 50' X 108' and the desired building would be about
50' X 30'. For this size building, the ordinance stipulates that 14
parking places would be required (see p. 106, #g). Since the dental
business would not need this much parking, a variance would be needed to
reduce the amount of parking area.
Bob Prom and Cyndi Sauer inquired about splitting a lot located at the
S.W. corner of 5th Ave. S.E. and Minnesota st. Examination of the lot
by the Commission members indicated that the lot is not large enough to
split and obey the Zoning Ordinance.
Peter Omann inquired about splitting the lot between Gary's Pizza and Bo
Diddley's located on College Ave. The Commission saw no problem to
splitting the lot. Parking, however, is a problem. A request for no
parking space or reduced parking space would require a variance.
The Minutes from May 2 were read and approved.
The meeting was adjourned.
