MINUTES OF THE ST. JOSEPH PLANNING COMMISSION
July 11,1988

Ben called the meeting to order at 7:35 p.m.
Becky Rivers, representing Dale Salo, presented the plat for the
development of Phase II of Cloverdale Estates, 4th Addition. The plat
showed the lay-out for 31 lots. Rachel and Ross informed the Commission
that approval of the plat should contain stipultions that the drainage
issue should be resolved, that all aspects of Phase I should be
completed, and that a new developer's agreement should be concluded with
the City. A number of complaints and allegations of code violations of
the construction in Phase I were itemized by nearby residents and given
to Mr. Salo, FmHA which finances the houses for prospective buyers, and
the City Council. Mr. Salo has responded to the complaints and made
several corrections during the building process. City engineers have
been on-site most of the time to inspect the work being done. FmHA and
the City Council are responding to the concerns of the nearby residents.
Phil moved that the Commission recommend the approval of the plat for
Phase II when the following conditions are met:
1) that all aspects of Phase I are completed, including curb and
I gutter installation and restoration of easements that were disturbed
during the construction of Phase I;
2) that the drainage issue for Cloverdale Estates, 4th Addition, is
fully resolved according to the recommendations of the City engineering
office;
3) that a new developer's agreement and other required legal
agreements with the City (e.g. bonding) are drawn up and approved by the
City Administration.
The motion was seconded and passed unanimously.
Peter Omann inquired about conditions that would have to be met in
constructing a building on the lot between Gary's Pizza and Bo
Diddley's. He would like to build a bi-level structure and rent out the
upper half for commercial use. Commission members mentioned the
respecting of the location of easements and the disallowance of renting
for residential use. For the size of the building being proposed, about
six parking spaces would be required. Thus, Peter would need to request
a variance for less parking spaces or no parking spaces.
The Minutes for April 4 and June 6 were read and approved.
The meeting was adjourned at 9:00 p.m.
