JOSEPH PLANNING COMMISSION CITY OF ST JOSEPH January 16, 1989 MEMBERS PRESENT: Chairman Ben Kremer; Board Members Torn Nahan, Hub Klein, Art Budde, Sr. Kathleen Kalinowski. OTHERS PRESENT: Rachel Stapleton, Clerk/Administrator; Ross Rieke, Council Liason¡ Mike Deutz and John Dube. Mike Deutz appeared before the Commission to present his plans for expansion of the service station business to include a bait shop, off sale liquor and parking with 12 stalls besides the filling station bays. Board felt parking plans were adequate and building sites were acceptable. Torn Nahan made a motion to approve the plans as presented; Sr. Kathleen seconded. Ayes: Kremer, Klein, Budde, Nahan, Kalinowski. Nayes: None. Motion carried. John Dube discussed with the Commission a proposal for a residence, located in an Industrial zone, which the use has been grandfathered in as a residential non-conforming use. This property is located at 403 College Avenue North. The property owner would like to sell the property but financing for it is difficult to get because of the non-conforming use status. He would like to put an office in the front and rent out the rest of the structure as a residence. The city attorney has stated that the ordinance would not allow a residence to have an office in it unless it is a home occupation, under the Residential non-conforming use status. If the use is changed. it must be changed to Industrial, which this proposal does not fit. The Planning Commission discussed the Zoning of this area, and that it was zoned industrial when the railroad was active for transportation. Most of the properties in this area are residences or businesses. The city attorney has recommended that the Planning Commission review this area for appropriateness of zoni~After much discussion of appropriate use of the ---a~e~. Art Budde made a motion to recommend to the Council to consider rezoning the area bounded on the west by the east boundary of the Mobile Horne zone, to the current city limits on the east, to the railroad tracks on the north, and CSAH 75 right of way on the south. The motion was seconded by Hub Klein. Ayes: Kremer, Klein, Budde, Nahan, Kalinowski. Nayes: None. Motion carried. The Planning Commission questioned by the El Paso building plans were not required to be brought before the Commission before the building permit was approved. The Clerk explained that it was an over site, there were several problems which needed to be solved with the construction the addition to the El Paso. She also stated that she would inform the Building Inspector that it is necessary for all building plans to be approved by the Planning Commission which are in the business zone, prior to approval of the building permit. The Planning Commission requested that Ron Euteneuer come to the next Planning Commission meeting to meet them. Hub Klein made a motion to recommend to the Council that Mike Roach be appointed to fill the vacancy left by Phil Durkee's resignation. and to increase the Board to seven members. The motion was seconded. Ayes: Kremer, Klein, Budde, Nahan, Kalinowski. Nayes: None. Motion carried. The meeting was adjourned at 8:50 p.m. Respectfully Submitted, ~a~ Acting Secretary
