Minutes of the St. Joseph Planning Commission
September 11, 1989

PUBLIC HEARING: Acting Chairman Torn Nahan called the meeting
to order at 7:30 and opened a public hearing to consider a
special use request to allow construction of a twelve unit
apartment building in an Industrial District, and to consider
a variance request of fifteen feet on the rear yard setback,
to construct garages in the rear yard, in conjunction with
the proposed apartments. Zoning Ordinance No. 52 of the St.
Joseph Code of Ordinances requires a special use permit for
all uses in an Industrial District and a minimum twenty foot
rear yard setback. The property is located at 129 1/2 Cedar
Street East and is described as the combined following
parcels:
PARCEL "A"
The Westerly Sixty-six (Wly 66') Feet of the Easterly One
Hundred Thirty-two (Ely 132') Feet of Lot Four (4) of
Auditors's Subdivision No. Nine (9) , in the Village of St.
Joseph, less and except the South Two Hundred (So. 200' ) Feet
thereof, all according to the Plat and Survey thereof now on
file and of record in the Office of the Stearns County
Recorder, Minn.
PARCEL "B"
The Easterly Sixty-six (Ely 66') Feet of Lot Four (4 ) of
Auditor's Subdivision, less the Southerly Two Hundred (Sly
200' ) Feet of the Easterly Sixty-six (Ely 66') Feet of Lot
Four (4 ) of Auditor's Subdivision No. Nine (9) of Lots 14,
15, 16 and 17 of Auditor's Subdivision No. Four (4) of the
Southwest Quarter of Northwest Quarter (SW 1/4 of NW 1/4) and
of the Southeast Quarter of the Northwest Quarter (SW 1/4 of
NW 1/4) of Section Ten (10), Township One Hundred Twenty-Four
(124) North, Range Twenty-Nine (29) West, according to the
plat and surveys thereof on file and of record in the office
of the Stearns county Recorder's Office, Stearns County,
Minnesota.
PARCEL "C"
The Easterly 66 feet of the Southerly 200 feet of Lot 4 of
Auditor's Subdivision No. 9 of Lots 14, 15, 16 and 17 of
Auditor's Subdivision No. 4 of the SW 1/4 of the NW 1/4 and
SE 1/4 of NW 1/4 of Section 10, all in Township 124, Range
29, Stearns County, Minnesota.
The requests were submitted by Mark Lambert, 521 Second St.
SE, St. Cloud MN 56304.
Mark Lambert discussed that he is proposing a 12 unit
apartment building for this property. It now has three
bUildings on it, a house, a small house, and an antiquated
mobile home. If allowed the 12 unit apartment construction,
he would remove the mobile home, and the small house. He
also discussed that he would like to build a 12 unit garage,
and would provide twelve addition parking spaces. Mr.
Lambert stated that he would like to have Date Street
extended to provide entrance to the apartment unit. But
realistically intends to provide entrance from the existing
driveway from Cedar Street. and will upgrade it to asphalt.
The Board discussed the width of the driveway.
There was public opposition to extending Date Street, by
property owners adjacent to the area, because of losing
property to the street area, and increased traffic.
The Board discussed number of parking places needed per unit,
Mr. Lambert agreed to provide the required amount. He is
proposing three bedroom apartments. The Board inquired what
makes this property unique to allow for a variance and
special use permit. Mr. Lambert stated that this area is not
drawing, nor is it conducive to industry, and that access is
only from Cedar Street, through private property. Because of
the location of, and the wide right of way of the railroad
tracks, it is appropriate to locate the garages at the rear,
with a residential type setback.
The public at the hearing were concerned about the increase
in population which the apartments would bring, and the
increased traffic, vandalism, and other type of destructive
activity. This is not a problem in the area now. Also
questioned was the amount of outside area needed on the
property. The ordinance states clearly the setbacks,
percentage of rear yard and space around the structures.
It was declared that a quorum of the Board was not present,
and that the matter will be considered at the next regular
meeting.
Mike Scherer and Dan Eller, representing Scherer Trucking,
presented a certificate of survey of the property as
requested at the March 6, 1989 Planning Commission meeting.
The Board discussed that a special use permit was approved

I with restrictions and recommendations to be worked out. The
City Attorney and the City Clerk received no requests for
restrictions or recommendations as was requested of the
interested persons at the March 6, 1989 meeting.
Peter Omann appeared before the Board to discuss a proposed
construction of a business building between Bo Diddley's and
Gary's Pizza. Discussed inability to provide adequate
parking, and if the Board would have a problem with minimal
parking, because of the location of the proposed structure.
Ross Rieke, Council Liason, informed the Board that the
Council would the Board to discuss if there is a need to
require survey prior to any construction in the City, and
would like a recommendation.
The meeting closed at 9:10 p.m.
