PUBLIC HEARING: Ben Kremer called the meeting to order at 7:30 p.m. and opened a public hearing to consider a special use permit to allow construction of a v- shaped, double faced billboard, and a one hundred eighty (180) foot variance on the size of each face of the billboard. zoning Ordinance No. 52 of the St. Joseph Code of Ordinances requires a special use permit for all uses in an Industrial District and a maximum 300 square feet on each face of a billboard. The property is legally described as follows: That part of lot 9, Aud. Subd. 4, which lies east of the west 186.5 feet thereof, northerly of the northerly right of way line of CSAH 75 and west of a line drawn due south from a point which is 800 feet due west of a point on the west line of Schneider's Addn., distant 800 ft. northerly of the intersection of said west line and the northerly right of way line of CSAH 75. The requests were submitted by Krebsbach Oil Company of St. Joseph. Bob and Jim Krebsbach, owners of Krebsbach Oil Co, presented plans to construct I a v-shaped double faced billboard to be located near their bulk tank plant on CSAH 75. Each face of the billboard would be lOt X 48'. The board discussed the need for such a large sign, stating their concerns for the esthetics in the City by allowing such a sign and questioning whether a smaller sign could accomplish the same goals. Bob stated the following reasons for requesting a variance on the size of the sign: l. Would like to put up a sign comparable to the other signs in the area. 2. The sign will be sitting in an area that is vast and open and the size is important to draw attention to it. 3. The sign will be more marketable. As far as the esthetics, Bob stated the purpose of proposing a v-shaped sign was they are more attractive to the eye. Krebsbach's felt they could also add to the esthetics by constructing the framework of steel. Sr. Kathleen made a motion to approve the special use permit to allow construction of a billboard in an industrial zone and to grant the variance of l80' on the size of the sign provided the billboard is of all steel construction; seconded by Hub Klein. Discussion: If the billboard is not steel constructed, the maximum size of the I billboard will not exceed 300 square feet, as per Ordinance No. 52. Ayes: Klein, Roach, Loso, Kalinowski. Nayes: Budde, Kremer. Motion Carried 4-2. MARK LAMBERT - Mark Lambert appeared before the commission to request action on a special use permit to allow construction of a twelve unit apartment building in an industrial zone, and to request a variance of fifteen feet on the rear yard setback, to construct garages in the rear yard, in conjunction with the proposed apartments. Ben Kremer presented a petition he received by the adjoining property owners of the proposed apartment project. The petition read as follows: We the concerned citizens of St. Joseph, express our opposition to the proposed 12-unit apartment building to be located at 129 1/2 Cedar St. East, along with the proposed road that will connect this complex to the intersection at First Ave NE and Date Street for the following reasons: I. It will create a large traffic problem due to the width of the street and the large volume of traffic already using this road. 2. The additional cars will also create a parking problem as he has not given enough off street parking. 3. The builder stated he would have students and these students would create noise in a quiet neighborhood 4. With students would come alcohol and probably drug problems which would be very hard to supervise. The petition was signed by 22 homeowrners, some of which expressed their concern at the public hearing on September II, 1989. After listening to the concerns of Mr. Lambert and those in attendance opposing the apartments, the board felt that the major concerns were density in an already small area, possible traffic problems, and opposition to expanding Date Street. with construction of the CSAH 75 Signal project to begin sometime during 1990, the board thought that it is important to see how the traffic flow on Cedar Street will be affected by the Signal Project, and if by allowing the special use permit, would it cause adverse affects to the Signal Project. Mike Roach made a motion to recommend the Council deny the special use permit to allow construction of a twelve unit apartment building due to insufficient access; seconded by Art Budde. Ayes: Roach, Kremer, Budde, Kalinowski. Nayes: Klein, Loso. Motion Carried 4-2. The board was in general agreement that the area for the proposed apartment complex is zoned inappropriately. Therefore, the Planning Commission will do an in depth study of the zoning on the North side of CSAH 75 and make a recommendation to the City Council at a later time. Art Budde made a motion to approve the minutes of the August 7 and September II Planning Commission minutes as presented; seconded by Kalinowski. Ayes: Klein, Roach, Loso, Kremer, Budde, Kalinowski.
