HomeMy WebLinkAbout1990 [07] Jul 02 Minutes of the St. Joseph Planning Commission July 2, 1990 MEMBERS PRESENT: Hub Klein, Tom Nahan, Sister Kathleen, Bob Loso, Art Budde and Dan Nierengarten. OTHERS PRESENT: Dave Mehr, Judy Weyrens, Ross Rieke, Council Liaison, and John Scherer, City Attorney. Dave and Michelle Mehr appeared and inquired about the possibility of obtaining a Rermit to erect a privacy fence on the back boundary line of their property at 140 6th Avenue Northwest. They were informed that the present ordi:.ance allows a fence but the height cannot exceed 6 feet. The Commission recommended that Dave and Michelle appear before the City Council and request that the City take action to force the owner of the property to clean up the property behind them so that a fence higher than 6 feet would not be necessary. i Bob Krebsbach of Triple K appeared and presented a preliminary plan to build a Super America Convenience Store at the corner of Hiway 75 and College Avenue. The proposed business appears to fall within that permitted by the zoning ; ordinance and the Commission recommended that a building permit be issued. John Scherer, City Attorney, was present and spoke to the Board regarding what options are available to the City in trying to control loud parties, particularly on certain days. The Board questioned whether the defination of "family" could be reduced from the present 5 member to 3 member in rental units. Discussion ¡ followed as to how to handle and enforce such a restriction. Grandfathering I of those units with 5 members was also discussed. I Motion was made by Bob Loso and seconded by Tom Nahan to have Mr. Scherer pre- pare an amendment to the zoning ordinance, changing the definition of a family I I from 5 unrelated persons to 3 and further add a grandfather clause to continue I to allow those units already in existance. Motion carried. Motion was made by Bob Loso and seconded by Sister Kathleen to recommend to the City Council to change all the remaining area north of County Road 75 from In- i dustrial to Commercial, except Block 23 and 25.
