Minutes of the st. Joseph Planning Commission
Oct. 1 , 1990
Members present: Hub Klein; chairman, Art Budde, Dan
Nierengarten, S. Kathleen Kalinowski, Ken Hiemenz, Bob Loso.
Others present, Judy Weyrens; Deputy Clerk, Linda Viehauser,
Art Reber, Mark Lambert, Mike Hazen, Greg Kacures, Roger
Steichen, Dick Sakry, Lynn Sakry.
Hub Klien called the meeting to order at 7:30 p.m.
Ken Hiemenz made a motion to accept the August 6 planning
commission minutes; seconded by S. Kathleen.
Ayes: Nierengarten, Budde, Klein, Loso, Hiemenz,
Ka 1 inowsk i.
Nayes: None. Motion carried 6-0.
S. Kathleen made a motion to accept the Sept. 4 and 10th
planning commission minutes; seconded by Hiemenz.
Discussion: Bob Loso asked to amend the Sept. 4 minutes
on page 3, 1st paragraph to read "The commission is concerned
about the citizens and how they feel, not just the
landlords."
Dan Nierengarten recommended to accept the amended Sept. 4
minutes and the Sept. 10th minutes.
Ayes: Budde, Hiemenz, Loso, Kalinowski, Nierengarten,
Klein.
Nayes: None. Motion carried 6-0.
Hub Klein opened discussion of the Public Hearing: Rezoning
of the Industrial district North of CSAH 15 & South of the
railroad tracks.
Ken Hiemenz spoke, saying he favored zoning the area as
general business and multiple (R-3) housing, as no overture
has been made by any industry in that area. S. Kathleen
concurred.
Discussion Continued. The planning commission was in
agreement that the frontage property, East and West of CSAH
75, would best be utilized as commercial property and should
be zoned as such.
Ken Hiemenz then made a motion to recommend to the city
council that Block 25 be left public; everything East of 1st
Ave. N.W.; South of Elm Street West and East, North of Date
Street West and East to R.R. ROW except that part now
designated trailer park be rezoned to R-3, Multi Family and
except Block 23, which will be zoned B - General Business.
Everthing South of Date Street West and East of R.R. ROW

except that part now owned by NSP be designated B - General
Business; seconded by Dan Nierengarten.
Ayes: Budde, Klein, Loso, Kalinowski, Nierengarten,
Hiemenz.
Nayes: None. Motion carried 6-0.
Discussion was then opened on the Public Hearing: Re
Definition of a "Family"
Mike Hazen asked if the intent of the redefinition is to move
rentals out of the neighborhoods or to control noise and
parties?
Bob Loso explained that the intent of the ordinance change
is to move rentals out of residential areas. He said it
would give the city back to the neighborhoods.
S. Kathleen stated that moving from 5 to 3 would not solve
the enforcement problems and it will cause more expense for
the students. She advised giving the landlords association a
year to try to improve renter/city relations.
Bob Loso made a motion to recommend to the city council to
accept the redefinition of family from 5 to 3, as it would go
along with the comprehensive plan for the city and get the
rentals out of residential areas and also promote more
apartment growth in the city,
More discussion followed. Art Reber spoke to the commission,
elaborating on the problems he has encountered with students
in his neighborhood. He feels moving family size from 5 to 3
is a good idea.
Art Budde stated that without enforcement, nothing would be
solved by going from 5 to 3. S. Kathleen opted for waiting
for the entire zoning ordinance amendment before amending the
IIFami ly" ordinance. Dan Nierengarten stated that improving
relations is a question of respect: students for residents
and residents for students.
Ken Hiemenz seconded the motion and called for a vote.
Ayes: Loso, Nierengarten, Hiemenz.
Nayes: Klein, Kal inowski, Budde.
Motion failed due to a tie vote.
As there was no new business, the meeting was adjourned.
