Hub K 1 i en ca lied the meeting to order. Rachel Stapleton then
read the notice of hearing. The purpose of the hearing is to
consider a request of a variance of fifteen (15) fee t, on the
rear yard set back, adjacent to Rai 1 road ROW, to allow for
the construction of an Eleven ( 11> unit apartment building
in a Multiple Family, R-3 Zone on the following described
property:
PARCEL "B"
Beginning at a point 132 feet West of the Southeast corner of
said Lot 16, being on the North line of Pine Street; thence
North parallel to the East 1 i ne of said Lot to the South line
of the Great Northern Railway Right-of-way: thence West along
said Right-ot-Way to the West line of said lot 16: thence
Southwesterly following said west 1 i ne to a point, to-wit:
The Southeast corner of Lot Three (3) of said Auditor's
Subdivision; thence East 38 fee t , more or less, to a point
192 feet West of the East line of said Lot 16, Auditor's
Subdivision No. 4; thence South to the North line of Pine
Street of Auditor's Subdivisidn No. 9, in the Village of St.
Joseph; thence East 60 feet to the place of beginning. LESS
and EXCEPT the southerly 200.00 feet thereof.

Hundred Thirty-Two (Ely 132' ) Feet of Lot Four (4) of
Auditor's Subdivision No. Nine (9) , in the Village of St.

PARCEL "E"
The Easterly 66 feet of the Southerly 200 feet of Lot 4 of
Auditor's Subdivision No. 9 of Lots 14, 15, 16, and 17 of
Auditor's Subdivision No, 4 of the SW 1/4 of the NW 1/4 and
SE 1/4 of NW 1/4 of Section 10, all in Township 124, Range 29
The request for variance has been submitted by Mark Lambert,
521 second St. SE, St Cloud, MN 56304.
Mark Lambert passed out copies of the building proposal for
the property. A fifteen foot set back is needed to make
maximum use of the property.
Hub Klien asked for discussion.
Art Budde asked if the R.R. had been contacted on the
proposa I.
Rachel Stapleton said that yes, they had been contacted and
the notice sent to the property tax department in Fort Worth
Texas.
Art Budde then asked how much room would be a 11 owed for the
roadway.
Mark Lambert: 25 ft. , The variance would a 11 ow the two
buildings to be placed farther apart to allow the fire
department to come between them.
Art Budde asked if a six foot fence would encircle the entire
property? Mark Lambert said the plan calls for two fences
along the east and west line.
Bob Loso asked what type of fencing is Lambert planning to
use? Mark Lambert said that he is planning some chain 1 ink,
but he doesn't want the place to look like a penitentiary.
He is planning 4 ft. fence on the front and the rest at a six
foot level.
Loso recommended a 6 ft fence and somewhat of a privacy
fence. He then asked i f there would be a hired caretaker on
the premises? Lambert said yes, and also a student caretaker
for the buildings.
Hub K I i en then asked for input from the public.
Diane Gohman proposed a 6 ft. privacy fence on the west side
of the property.
Mike Deutz talked about the problems he has had with people
walking on his property, He thinks a fence would help

alleviate the problem.
Mark Lambert then said that the ordinance does not require
him to have a fence, but if the city council and planning
oommission recommends it, he will. He then questioned the
necessity of a 6 ft. privacy fence on the west side, as the
Gohmans have their property for sale and if a business buys
the property, the fence wouldn't be necessary. He again
stated that he didn't want the property to look like a
penitentiary. He asks that the Board let the 4 ft. height
stand.
Ken Hiemenz then asked if Date Street was ever extended,
would the proposed plan allow it?
Mark Lambert stated that if Date Street goes through, there
will still be good access into the property.
Art Budde made a motion for recommendation to the City
Counc i 1 to accept the request for the 15 ft. variance with
the stipulation that the counoil consider a 6 ft. privacy
fence along the west 200 ft. or so. of the driveway.
Diane Gohman stated that a chain link fence is okay with
her if it runs up to the street.
Mark Lambert asked that he be allowed some discretion on
the type of fence allowed.
Dan Nierengarten seconded the motion.
Ayes: Nierengarten, Hiemenz, K 1 i en, Loso, Budde.
Nayes: None. Motion passed, 5 to 0
Art Budde then made a motion to approve the site plan as
shown in Scheme A.
Ken Hiemenz seconded.
Ayes: Nierengarten, Hiemenz, K 1 i en, Loso, Budde.
Nayes: None Motion carried, 5 to 0
The meeting adjourned at 8:15.
