The First State Bank ofSt. Joseph is requesting a Variance to the City's Sign Ordinance. As you
:u;RKI recall, the new bank facility will have office space available for rent by other businesses.
()~IINISTR,\T<)R According to the Ordinance, the Bank and each business can have one sign attached to the
ari Schmidt building, not to exceed 50 square feet per sign. In addition, the facility can have one detached
sign not to exceed 50 square feet identifying one or all of the business located in the building.
First State Bank of St. Joseph is requesting an 83.8 square foot Variance to the detached sign.
OUNCILORS Please find enclosed in your packet a copy of the schematic drawing of the proposed sign. Mr.
ob Loso Reinhart and Bruce Gohman will be attending the meeting to address any questions.

ary Niedenfuer new location of the Farmer's Market. As you recall, the Farmer's Market site was determined
this summer on the City lot south of the Fire Hall. The steering committee has determined that
the site does not meet their needs and now are proposing a site in Milestream Park. The Park
Board must have input regarding the proposed location. Essentially, the Farmer's Market is a
business proposing to be located in an area zoned as Public (i.e. park land) and a Special Use
Permit should be required. Since they need CSAH #75 frontage, an alternative location could be
the lot east of the new bank site, which is zoned HWY #75 Business.
The agenda also includes the continued discussion ofthe Northland Addition road corridor
analysis. Included in your packet is a summary of the alternative road corridors proposed by the
Planning Commission and prepared by Joe Bettendorf, City Engineer. In addition, Judy Weyrens
has determined that a plat of the entire Northland Addition doesn't exist. Please refer to the
memo provided by Judy.
Finally, the new Ordinance book is done and will be handed out at the meeting.

Please enter the following item on the agenda for the St. Joseph City Council
meeting:
The steering committee for the St. Joseph farmers' market of2000 asks to change,
the marketing site on 4th A venue that the St. Joseph City Council granted in
July 1999. Our reason is that producers for the market do not believe that the
4th A venue site is visible enough from Highway 75 to provide for the easy
viewing that seems essential to launch the market effectively next year. We
therefore ask to be part of the agenda for the November 4th Council meeting to
request a tTansfer to a different site--likely MillstTeam Park. The location
and weekly day of the market must be resolved before the November meeting that
the steering committee will hold with producers. The steering committee will
have determined its proposed site and day by the time of the Council meeting.

=-.lert At the October 4, 1999 Planning Commission meeting considerable discussion took place

lv1ary Niedenfuer regarding the development of Northland. As I stated at the meeting I was in the process of
securing a map of the entire addition with all the phases included. In researching the matter I
was able to put together the history of how the development occurred. The maps and verbiage
to follow should help clarify the development. I will be attending the Planning Commission
meeting on November 1, 1999 should you have any questions.
Attachment "A": This attachment is the original map presented by Teny Schmid for the
Development of Northland. After review by the City Engineer it was determined that the
proposed blocks were too long and an east/west road was required in the middle of the proposed
lots. (lllustrated in Orange). Phase one and two were developed using this map. For your
convenience I have highlighted each phase.
After phase two was developed, Terry approached the Council with a new preliminary plat. The
property known as "Indian Hill" was unavailable for parkland and Pete Rothfork was willing to
donate 2.66 acres ofland in another section of Northland. Therefore, Teny Schmid approached
the Council and Planning Commission and the City agreed to a new parkland area. The
parkland area donated would fulfill the parkland dedication area for Northland ill, IV and V.
Therefore, Teny redesigned the plat, a preliminary plat was held in 1994 and approved by the
Planning Commission. Attachment "B" is the revised plat that was approved by both the
Planning Commission and City Council. At this time Teny Schmid is following the preliminary
plat approved by both bodies.

The two attachments provided are the only maps that are part of the Northland Development. Because of the re- .
platting in 1994 the entire development is not placed on one map, other than the City map prepared by Joe
Bettendorf. Since the Planning Commission may not have a ClllTent City map I have included one for your
review. Please note that since Northland N has not yet been filed, it is not on the City map.
Miscellaneous Matters
Review of Plats: Some discussion has arisen regarding the procedure for reviewing plats. In researching the
past Planning Commission minutes, I have discovered that the Planning Commission in the past has reviewed
Phase One, Two and Three of Northland as well as the phases in Pond View Ridge (Final). Once the Planning
Commission reviewed the Final Plat the recommendation was forwarded to the City Council for review and
comment. For some reason Northland N did not make it to the Planning Commission for review and comment.
This phase come late in the season \vith the City installing the improvements. The Council even had difficulty
in receiving the plat. As the Ordinance requires that the plats are reviewed by the Planning Commission we will
continue to forward them to you in the future.

Chad, you asked me to look at three options for an alternate route out of the Northland area (alternate
to Gumtree Street). The three options considered are shown on the enclosed sketches. Please excuse
~ the hand drafting, but I wanted to make the packet for the next Planning Commission meeting
-- scheduled for November 1, 1999. I can finalize one or more of these options if necessary, and/or look
at any other alternates the Planning Commission might want to consider.
Option 1
Extend 4th A venue south and then curving east to meet NortWand Drive. This alternate appears
to work fairly well. Street grades are at or below 7 percent, the design allows for residential
development of the Rothfork parcel, and it appears the road would bisect the Brandenberger
parcel at a point where there would be useable commercial property on both sides of the route.
Option 2
Construct a road south of and adjacent to the existing Northland development. This option
presents a number of problems. It creates a jog at 4th A venue that is less than the required 125
feet, and leaves an intersection that would be difficult to control. Even if you curve the road into
4th A venue to minimize the jog, it is still a poor intersection. This option also creates double
frontage lots in NortWand Plat Four, and does little to help the Brandenburger parcel; I don't see
assessable benefit to property on either side of the route. Finally, we have a very steep grade on
the west end of the street; even with a cut at the top of the hill, the grade will reach 10 percent
or more--our Subdivision Ordinance sets the grade limit at 8 percent.

Option 3
. Loop a road into Northland Plat Four, intersecting with the curve at the top of the hill. Most of
the shortcomings of Option 2 are also apparent here. In addition, it would be difficult to get the
200 foot centerline radius required by ordinance. Of the three options considered, I believe this
route would be the least likely to meet your objective of taking traffic off of Gumtree Street.
In summary, I believe Option 1 provides the best alternative for reducing traffic on Gumtree Street.
Let me know if you need any other information, or if you want me to pursue this further.

. Unofficial Minutes - Planning' Commission
Pursuant to due call and notice thereof, the Planning Commission for the-City of St. Joseph met in regular session on
Monday, October 4, 1999 at 7:00 p.m. in the St. Joseph City Hall.
Members Present: Chair Hub Klein. Commissioners S. Kathleen Kalinowski, Marge Lesnick, Gary Utsch, Kurt '
Schneider, Jim Graeve and Cory Ehlert. Planning Commission Secretary Chad A. Carlson.
Others Present: Jim Fredricks, Steve Paasch, Gary Schleicher, Amy Schleicher, Lori Gwost, AI Gwost, Diane
Schreifels, Will Schreifels, and Judy Weyrens.
Site Plan - East Apartments - Collel!e of St. Benedict:
Jim Fredricks and Steve Paasch presented the proposed site plan, renov~tion and new construction plans for the East
Apartments located on -the campus of the College of St. Benedict. The first phase of the project was presented W the
Planning Commission and two buildings have been renovated. The proposed plan will complete phase two of the
project.
The old structures along College Avenue will be demolished and replaced with new construction. A three story, 220
~ed complex will be complet~ in phase two and ~he entire project is schedulec! for cOlllpletion in the spring of200 1.
Current parking spaces total 50 and an additional 21 spaces will ~ available. Paasch identified the emergency and
service entrances to the facility.
Fredri~ks explained that each unit will consist of two and four bedrooms, wash and dryer, and wiUbe handicap
accessible. Construction material will consist of spilt-faced block, steel panel with stucco finish, hipped roof with
shingles and extensive landscaping.
. Lesnick questioned if the height of the 'building would 'be similar to the' Science 'Building.Passch stated that the
complex will be 32 feet high.
Greave questioned if a bastmlent would be constructed. Paasch stated that a crawl space and mechanical area win be
constructed. A basement under the entire structure will not be constructed.
Kalinowski stated that the current emergency entrance is not a road. Paasch stated that emergency vehicles could
continue to enter in this area and the wide walking path on the north side of the facility.
Klein stated that in the spring large emergency vehicles could sink and get stuck in this area. Klein suggested that
the City's Fire Chiefbe contacted to discuss emergency routes.
Paasch stated that he has reviewed the project with Ron Euteneuer and Dave Theisen prior to the meeting and there
were no concerns. Paasch stated that a fire hydrant needs to placed on the north end of the complex and two other
locations for safety.
Ehlert questioned the demolition of one buîldìng and not the other. Is the demolition due the age-and useful life of
the structure? Paasch stated that the building is structurally sound but no longer meets ofthe College.
Utsch questioned if the parking to student ratio is adequate and stated it does not meet the standards of the City
Ordinance. Paasch stated that 21 additional parking spaces will be created. for a total of 71 parking spaces for the
complex.
Ehlert confirmed that if the final phase is completed, the parking lot on the north end of the complex would be lost.
Ehlert stated that the proposed entrance to the facility is on College Avem1elCR #121 and questioned if the County
. Highway Engineer has been contacted. Paasch stated that the existing entrance will be used and the project meets
the City's 30-foot setback. Paasch stated the County is not concerned with Ú1e project and doesn't foresee any
impacts to CR #121.

· Lesnick moved to approved the site plan for the East Apartments presented by the College of St Benedict as
presented subject to review and approval from the City Building Inspector and City Fire Chief; Seconded by
Ehlert. The motion passed with the following vote:
Ayes: Klein, Lesnick, Kalinowski, Schneider, Utsch, Greave, and Ehlert
Nays: None Motion Carried
Arts and Herita!!e Center - Parkin!! Plan Update:
Carlson presented a finding by the City Building Official determining that the Arts and Heritage Center must have a
parking plan incorporated into the project and submitted to the City prior to receiving a Certificate of Occupancy.
Carlson stated that the Ordinance is being interpreted differently by the Building Official and city staff. City staff
interpretation is that the City cannot require the parking plan as a prerequisite for obtaining a Certificate of
Occupancy.
Ehlert questioned why the Ordinance is in conflict. The Planning Commission has always determined that the EE
District is not subject to the provisions of the Ordinance. The request for a parking plan was out of courtesy only.
Weyrens stated that staff at Great Northern Building Inspection has determined that a parking plan is a requirement
and must be provided to the City. Weyrens stated that in the future, the Planning Commission should require a
report :/Ì'om the Building Official prior to reviewing any development in the EE District. If any interpretation
differences occur, they can be addressed by city staff prior the Planning Commission meeting.
Klein stated that the Planning Commission has determined that development in the EE District is not subject to the
provisions of the Ordinances, except for the review of the site plan. The Building Official needs to understand and
acknowledge the Planning Commission's position in the EE District.
· Utsch disagreed and stated that the College ofSt. Benedict and the Monastery are part of the community. The City
Council and Planning Commission have an obligation and responsibility to review and approve development in the
EE District subject to all the provisions set forth in the Ordinance.
Kalinowski stated that Dave Theisen, Fire Chief: is the only person that needs to know where parking will be located
for emergency purposes. The gift shop is extremely small and will not generate a huge amount of traffic. The circle
drive and alley on the Monastery's campus will be sufficient for the Center's parking needs.
Ehlert questioned why the Monastery is not submitting a parking plan when they said they would a month ago.
Kalinowski stated that the Monastery is completing an overall parking plan for the campus and the Arts and
Heritage Center project is only a small portion of the overall plan.
Ehlert stated his concern with patrons of the Arts and Heritage Center using Minnesota Street were the City has
already identified a parking problem.
Carlson stated that the Planning Commission needs to make a determination whether or not a parking plan would be
required to obtain a Certificate of Occupancy.
Lesnick suggested that the Planning Commission determine that a parking plan will not be required for the Arts and
Heritage Center project based on the fact the Planning Commission has never required parking plan for past projects
in the EE District.
Ehlert stated that he agrees with Utsch and that the City has a responsibility to put the best interest of the community
fIrst. The Ordinances need to be enforced uniformly throughout the community. Ehlert further stated it is his
opinion that the request for a parking plan :/Ì'om the Monastery has been blown way out of proportion.
· Kalinowski stated again that an overall parking plan would be completed for the campus in the future and will be

Northland Addition - Road Corridor Discussion:
Carlson infonned the Planning Commission thäf the Area Planning Organization (APO) would be willing to assist
the City in determining the feasibility of alternative road corridors adjacent to the Northland Addition.
The City Engineer will be contacting Carlson to discuss engineering and future development issues for an overall
assessment of the Northland Addition. Carlson stated that the preliminary plat of the Northland Addition included
the connection of Gruntree Street to a future north/south road, connecting to CSAH #75. According to the City
Engineer. Gruntree Street was designed to connect to the north/south road to effectively move traffic out of the
Northland Addition. Northland Drive will provide another access that is badly needed to the Northland Addition.
Residents living on Gruntree Street are requesting that the Planning Commission discuss an alternative east/west
corridor.
Klein questioned if the City Offices could provide the Planning Commission members with a copy of plat for the
entire Northland development. Klein further stated that the City Council and developer changed the Northland Plat
without consulting with the Planning Commission. The names of streets and the location of the park changed after
the Plannin~ Commission approved the preliminary plat.
Weyrens stated that a copy of the Northland Addition Plat would be presented to the Planning Commission on
November 1st, including the latest addition. Weyrens stated that many months of the discussion took place with the
. City Council and the developer regarding the location of the park. The final plat reflects the new location of the
park as it currently exists arid the street names were changed to correspond with the City's grid system.
Ehlert stated that all plats associated with the Northland Addition have been approved and have not been changed
after fmal approval by the City Council.
~~l1n~iger stated that a decision has been made to connect Gmntree Street to Northland Drive and little can be done
now to change the design. Schneider further stated that the residents are requesting that the Planning Commission
research the feasibility of another east/west road connecting to Northland Drive to relieve the traffic pressure that
will occur on Gumtree Street.
Lesnick stated that the original development plans of the Northland Addition included the extension of Gruntree
Street to the east and connecting with County Road #133. Ehlert explained that connecting Gmntree Street to
County Road #133 was discussed and eliminated due to environmental issues and development restraints.
Ehlert stated that the City Council discussed the potential traffic impact to residents living Gmntree Street by
connecting it to Northland Drive. The City Council is requesting that the Planning Commission review alternate
road corridors. Ehlert stated in his opinion the push for the construction of Northland Drive is coming :/Ì'om the
residents on Old County Road #2 and the City's Fire Chief. Gary Schleicher, Northland resident, stated that the City
is taking a traffic problem on west side of the Northland Addition and moving it to the east side.
Ehlert suggested that the Planning Commission study options of extending Fir Street or 4th Aven~ through the
Rothfork and Brandenburger properties, to connect with Northland Drive.
Utsch suggested that before he or the Planning Commission can make an educated decision on alternative road
corridors. they need to review a copy ofthe current plat Weyrens stated that Northland plat would be available by
November 1st.
. Ehlert stated that the City Council discussed the option of extending Fir Street for over 40 minutes. The City
Engineer indicated that the extension of Fir Street is not feasible due to grade and soil conditions.
October 4, 1999 Minutes
. Gary Schleicher stated that 5th Avenue has a similar grade and 5th Avenue is being constructed. Gary Schleicher
further stated that he doesn't agree with the City Engineer's assessment and the City Council did not allow the
public to speak or con:/Ì'ont the City Engineer.
Amy Schleicher, Northland resident, stated that City Council made the decision to construct Northland Drive in the
best interest of the developer and not the community or the Northland neighborhood.
Klein stated that Avon Lumber One did not construct the development as presented to the Planning Commission. A
road north of the development connecting to County Road #2 and multi-unit structures were included in the original
plan and neither has been constructed.
Gary Schleicher stated that he bought his house in 1996 and according to plat, 4th Avenue was going to carry the
traffic south out of the addition. The plat must have been changed since he purchased his home and Northland Drive
was added to the development.
Lesnick stated that a road corridor is identified north of the City to parallel CSAH #75. Carlson stated that the APO
2020 plan does indicate a road corridor north of the community connecting County Road #2 with County Road # 134
at Fingerhut.
Ehlert presented possible 4th Avenue and Fir Street extension alternatives and stated that the Planning Commission
and City Council have made a commitment to research corridor alternatives for the Northland Addition. Gary
Schleicher stated he appreciates the efforts of the Planning Commission and City Council and suggested that they
curtail and scrutinize any further development in the Northland Addition until this issue is resolved.
Greave stated that the Planning Commission should preserve possible road corridors as development occurs. Greave
. suggested that the City purchase easement and right-of-way to avoid similar situations in the future.
Carlson presented a memorandum :/Ì'om the APO detailing the steps to preserve road corridors for future
development. The memorandum states that an official map needs to be created in order to protect the corridors.
Carlson further stated that an official map adopted by the City could preserve corridors but there is a potential
financial liability to the City over a period of time. The City Council must be involved in the process of preserving
road corridors.
Utsch suggested that the City needs to contact the Rothfork and Brandenburger families to present the possible road
alternatives discussed by the Planning Commission. Utsch further stated that if the City constructed the roads, the
City could assess the property owners for the project. Weyrens stated that the City Council can not assess property
unless a benefit is shown as a result of the project.
Gary Schleicher questioned why Fir Street wasn't extended to the east as presented in the original plan of the
development. ScWeicher referred to an original schematic drawing of the development. Klein added that the
original plat presented to the Planning Commission was changed by Avon Lumber One and the Rothforks, approved
by the City Council, and never re-presented to the Planning Commission.
Ehlert stated that the City Council was pushed to construct Northland Drive to Gumtree Street and there wasn't
enough time to plan or discuss alternatives prior to the project. Ehlert further stated that the industrial park project
and Northland Drive were included in the same bonding package and the City Council could not delay the bond
Issue.
Gary Schleicher stated it is his opinion that the City Council didn't research alternatives to Northland Drive and put
the interests of the developer ahead of the community.
Utsch made a motion to have Carlson work with the City Engineer to study the proposed extensions. of Fir
. Street and 4th Avenue as presented and have Carlson contact the Rothfork and Brandenburger pro~
owners to discuss the proposed alternatives; Seconded by Ehlert

Commissioner Announcements:
Klein announced a public hearing that is scheduled for Wednesday, October 6th at 7:00 p.m. in the Westwood
Elementary School Gymnasium. Klein stated that the APO is planning road corridors within St. Joseph Township
and the City of St. Joseph. Klein further stated that the Planning Commission should review St. Joseph Township
and APO transportation plans and make sure they are in the best interest of St. Joseph.
Carlson explained that the public hearing is being held in conjunction with West Metro Corridor Study. The study is
an attempt to identify road corridors to move traffic :/Ì'om growing areas of Sartell into S1. Cloud and to address the
traffic congestion on the 8th Street bridge. Carlson further stated that the Planning Commission reviewed and
accepted the Township's transportation plan earlier this summer.
Utsch stated that he recalls a discussion of extending the Delwin Road south as a part of a north/south road corridor
for the community. In his opinion, the extension of the Delwin Road is a good idea.
Ehlert stated it is his opinion that Stearns County and the APO are more concerned with traffic flow then the impacts
to the residents and neighborhoods. Neighborhoods and residents are not involved in the transportation planning
· process.
Carlson announced that the new Zoning Ordinances are being completed and will be presented at the November 1 sl
meeting.

Weyrens clarified that Heid and Herges have changed the design of the original plat presented in 1991.
St. Joseph Code of Ordinances requires a public hearing if any changes are made to the original plat.
Heid stated that the design of the plat has been changed to add five (5) lots. While the sketch plan
presented at this hearing contains two lots which do not meet the minimum lot requirements, they will be
changed before presentation to the City Council.
Kevin Schirmers, 30355 - 9151 Avenue, questioned the type of housing that will be constructed in certain
areas.
Heid responded that Pond View Five (5) will be a mix of patio homes and traditional homes. The patio
homes are intended to provide a buffer on 1 ih Avenue SE. All the homes constructed in phase five will
meet the covenant requirements of a minimum floor area of 1100 square feet.
Gary Heltemes, 30309 - 90th Avenue questioned at what point street lights are installed in new developments.
Heid responded that street lights are the responsibility of the City.
. Jane Reber, 1314 East Minnesota Street, stated that along the northern edge of the proposed plat is a twenty foot
easement that adjoining property owners have been using to access the rear of their properties. Reber questioned
who owns and maintains this easement and if the adjoining property owners will be allowed access to such.
Heid responded that ten feet of the easement belongs to property he owns and the remaining ten feet
belong to the adjoining property owners. This easement is a recorded utility easement and does not
provide for roadway. After Pond View Five is developed, the easement will be privately owned by the home
owner whose lot includes the easement, just as the adjoining property owners privately own the property
with the easement.
Irvin Klocker, 1404 East Minnesota Street, questioned why property owners will not be allowed to continue to use the
property since they have been using it for over 40 years. He questioned how a grandfather status would apply.
Weyrens responded that the easement is a recorded document filed on the property owners deeds. The
City used this easement to place water and sewer lines as did other utility companies. The easement area
cannot be built upon or fenced over. Heid further stated that he owns the property and that easement area
has been configured into the lot sizes. If the easement were excluded, some of the lots may not meet the
minimum requirments.
Ronald Kostreba, 1007 Able Street East, questioned the status of 1ih Avenue SE and discussion he has had with the
City regarding such.
Weyrens responded that the City Engineer has completed drafting the legal description and is working with
the City Attorney to prepare the necessary paperwork for Kostreba to sign.
Ehlert responded that the City Council has discussed and listened to public comments with regard to the
extension of 12th Avenue SE. Stearns County is requiring that when County Road 133 is realigned, 12'h
Avenue be extended. The County is in the process of updating the transportation plan and had indicated
that 1ih Avenue SE is needed to help move traffic out of Pond View Ridge and there is a need to move
traffic to County Road 75 quicker. Further, when County Road 133 is realigned, the existing crossing used
by Scherer Trucking will need to be relocated and 1ih Avenue SE is a logical choice.
Ehlert also discussed the ramifications if the City does not abide by County regulations. When East
Minnesota Street was reconstructed a large portion of the funding came from Stearns County because MN
Street is a County Road. MN Street was designed and built for large volumes and weights of traffic. If the

. City would restrict traffic we could be required to reimburse the County for the funds based on an amortized
life (use) schedule. Ehlert further clarified that the City relies on the expertise and financial assistance of
both the St. Cloud Area Partnership Organization and Stearns County.
Ellen Wahlstrom stated that she attended the open house conducted by Stearns County where the
County Comprehensive Plan was displayed. It is Wahlstrom's understandin~ that the Stearns County
Comprehensive Plan has changed the design of the southerly extension of 12 h Avenue. Therefore, is it
necessary to build 1ih Avenue as a major roadway.
Herges and Heid stated that when the original plat was presented in 1991 the City required a roadway
easement of 80 feet to be used for 12th Avenue SE with sidewalk on one side. Therefore, a portion of the
development already has 12th Avenue built with a 80 foot right of way. It is too late to change the
configuration as the road widths would vary throughout the development. Heid suggested rather than to
change the road configuration, a bicycle lane be constructed adjacent to 12th Avenue SE.
Kevin Schirmers, 30355 - 915t Avenue, questioned if the holding pond would be sufficient.
Hied responded that the City Engineer has indicated that the holding pond will need to be doubled. To
accommodate this the existing pond will be excavated south. Heid questioned the need for doubling the
pond and he would like to see that downsized if possible.
Ellen Wahsltrom questioned if the pond extension would be seeded with prairie grass as is the original
part of the pond.
Herges indicated that he would be willing to accommodate this request.
Ehlert questioned Herges and Heid as to why they chose not to develop Pond View Five as a PURD as
they had previously discussed with the Planning Commission.
Herges responded that because the roads are already built it would have been difficult to redesign the
project and a PURD development requires additional work that they did not wish to deal with. Further, they
. did not feel the property owners in Pond View would be receptive to smaller lots.
Brian Orcutt, 128 - 13th Avenue SE, question the size of the lots proposed in Pond View Five and if they
will meet the convents of the development.
Heid responded that the lots will be slightly smaller than the original plat and all the homes will meet the
minimum floor requirement of 1,100 square feet.
Orcutt stated that the covenants he received when he built in Pond View Two indicates the minimum floor
area was 1 ,200 square feet. He further questioned how the covenants could be changed without
notification to the property owners. Heid responded that the covenants where changed after the first
development phase.
The public present discussed concerns with the contractor building patio homes in Pond View Four. All
the existing patio homes appear to be the same design. Those present encouraged the Planning
Commission to prohibit the construction of patio homes of similar design on adjoining property.
Herges responded that the contractor being discussed currently has three house plans and they will ask the
contractor to change the front elevation on adjoining property.
The Planning Commission discussed including a contingency in approving the plat that no more than two
similar home designs can be contiguous. Heid stated that he would not readily agree to such a provision,
as it would have a direct impact on bi-Ievel homes. He clarified that they would encourage the builders of
patio homes to chan~e the front elevations. The Commission questioned if all the patio homes would be
constructed along 12 h Avenue SE or if they would be mixed within the development.
Heid stated that the market will dictate where and what types of homes will be built. Conceptually they feel
that patio homes will be built along 12th Avenue but will allow them to built on any lot in the plat. Heid also
encouraged the Planning Commission to not judge patio or town homes as they can be built as nice as any
traditional home.
Schneider reminded the Planning Commission that patio homes can include more than one living level
and the homes currently built in Pond View are California Ramblers. Ben Poepping stated that it is his
opinion that the patio homes constructed in Pond View Ridge should not have been allowed.

Weyrens informed the Commission that the Mayor reviewed the preliminary plat and would like the
developers to considering redesigning the plat to eliminate the cul-de-sac and replace it with a circle
drive. The Mayor indicated that cul-de-sacs are difficult to maintain, especially with snow removal and
are more costly to a City.
Graeve stated that it is his opinion that cul-de-sacs provide a "quality of life" people are looking for and it
should remain in the plat. Commissioners present concurred.
Heid and Herges stated that people look to purchase lots along cul-de-sacs and they do not wish to remove
it. Further. in removing the cul-de-sac will loose two additional lots.
Wahlstrom questioned if the Public Works Director Dick Taufen had an opportunity to review the plat and
if so what were his comments.
Weyrens stated that Taufen noted the road labeled East Able Drive needs to be corrected to East Able
Street until the bend in the road at which point it needs to be corrected to 13th Avenue SE.
As far as the cul-de-sac, Taufen stated that he does not like cul-de-sacs and encourages alternatives to
such. However, he also realizes that cul-de-sacs are popular areas to live on, and will work with them if left
in the plat.
Kevin Schirmers stated that he feels the Pond View Ridge Addition is an asset to St. Joseph and the
developers should continue developing as they have been and to encourage builders to rotate house
designs.
Heid and Herges were questioned as to why when they are ready to develop a parcel of land the property
is stripped of all the trees. Heid responded that the utility companies dictate which trees are to be
removed. For development purposes, the property is more marketable with trees.
. Heid stated that the hearing at this time is for preliminary plat approval only. The design work and final
layouts will be completed once preliminary plat approval is granted. It is costly to prepare the design work
and he and Herges do not wish to redesign the plat if the City Council does not approve the preliminary
plat. The City will have a second opportunity to review the plat at the time of submitting the final plat.
There being no additional public comments, Klein closed the hearing at 8:30 p.m.
Ehlert made a motion to recommend the City Council approve the preliminary plat of Pond View Five and
Resolution of Findings; seconded by Lesnick and passed unanimously by those present.
R£SOLIJTION OF FINDINGS
The request of Rick Heid and Bob Herges for a Preliminary Plat request for Pond View Ridge Five
came before the Planning Commission at a public hearing held on April 6, 1998. The purpose of the
hearing was to consider a preliminary plat for Pond View Ridge Five to allow for the construction of 41
homes on approximately 17 acres. The proposed subdivision is zoned R-1 Single Family. Notice of
this matter was duly served and published.
Approval is based on the following contingencies:
1. Review and approval of the City Engineer, to include but not limited to the following:
a. Satisfaction that all lots meet the minimum square footage requirement
b. The size of the drainage pond is reviewed to determined if the pond needs to be doubled.
c. Current status of 1 ih Avenue and correspondence as to the best interest of the City for
the construction and development of 1 ih Avenue.
d. Satisfaction of the design standards as required by St. Joseph Code of Ordinances.
2. Correction of the Street names as noted by the Public Works Director.
