Bettendorf and Dick Taufen will be attending the meeting

Pursuant to due call and notice thereot: the Planning Commission for the City of St. Joseph met in regular session on
Wednesday, January 5, 2000 at 7:00 p.m. in the St. Joseph City Hall.
Members Present: Chair Hub Klein. Commissioners S. Kathleen Kalinowski, Marge Lesnick, Gary Utsch, Kurt .
Schneider, Jim Graeve and Cory Ehlert. Planning Commission Secretary Chad A Carlson.
Others Present: Louis Krebsbach, Jim Krebsbach, Mike Deutz, Ellen Wahlstrom. Rick Heid. Bob Herges, Dan Fin
and Ken Twit.
Krebsbach Variance Request - St. Joseph Super America:
Hub Klein opened the public hearing at 7:00 p.m. to hear the Variance requests being made by the St. Joseph Super
America.
Louis Krebsbach addressed the Planning Commission and reviewed the details of the Super America expansion
project. The Super America is requesting a 10 foot rear yard setback variance and a 5 foot side yard variance. The
variances are being requested to place a rubbish confinement structure on the southeast comer of the lot. The site
plan remains the same as presented and approved at the December Planning Commission meeting.
Graeve questioned if the property owners within 350 feet ofthe Super America had been notified of the public
hearing. Carlson stated that notices were sent to the effected property owners within 350 feet in advance of the
meeting as required by State Law.
Ehlert questioned if the confinement structure should be located adjacent to CSAH #75. The Planning Commission
and City Council have taken great strides to improve the aesthetics of the CSAH #75 corridor. Ehlert expressed his
. concern with rubbish overflowing the confmement structure and blowing around the lot and across CSAH #75.
Louis Krebsbach stated that structure will have the same brick material as the main building, shrubs will be planted
around the structure, and the walls of the structure will be done to the ground. Krebsbach passed out pictures of the
Sartell fàcility and examples oflandscaping.
Ehlert questioned if the inside of the structure will be seen :trom CSAH #75 due to the elevation of the road. Jim
Krebsbach stated that walls of the structure will be seven feet tall and the landscaping around the facility should
enclose everything.
Ehlert stated that they don't want the City to be in the same situation as they were in last summer with a new
business. Ehlert suggested that the Planning Commission require a certain amount of landscaping. Louis Krebsbach
stated that the photos only show the minimillll amount ofthe landscaping and they intend to do even more to make
the curb more appealing.
Graeve questioned if the location of the confmement structure is located on Stearns County property. Deutz added
that he met with Jerry Lahr with Stearns County Right-of-Way and they have no documentation in the files allowing
the use of the property for Super America business.
Jim Krebsbach detailed the negotiations that took place when the intersection light was constructed at College
Avenue and CSAH #75. The Krebsbach's donated property for a turn lane on College Avenue and the County
agreed to allow the Super America to use 15 feet of the County's right-of-way for business use. The County also
vacated Cedar Street to College Avenue. Krebsbach further stated that an agreement was made with Doug
Wiezhaar, former Stearns County Engineer and if the County ever needed the property in the future, the company
would have to remove anything within the area.
. Utsch stated that the County's agreement with Super America should be included in the motion for the Variance
requests.

· Utsch made a motion to recommend the City Council approve a 10 foot rear yard Variance and a 5 foot side
yard Variance for the placement of a rubbish confinement structure on the south east corner of the St Joseph
Super America lot in accordance with the agreement between Super America and Stearns County; Seconded
by Kalinowski.
The motion passed with the following vote:
Ayes: Klein, Lesnick, Kalinowski, Schneider, Utsch, Graeve, and Ehlert

Resolution of Finding
The request of St. Joseph Super America for two Variances came before the Planning Commission at a public
hearing held on January 5,2000. The purpose of the hearing was to consider the issuance of a variance for the side
and rear yard setbacks. The variances are being requested to allow placement of a rubbish confinement structure on
the south east-end comer of the lot
St. Joseph Code of Ordinance 52.22, Subdivision 5 (a) requires a 20 foot setback ITom the County Right-of-way
line.
St. Joseph Code of Ordinance 52.22, Subdivision 5 (b) requires a 10 foot setback ITom the rear property line.
The request has been submitted by St. Joseph Super America, 304 College A venue North, St. Joseph, MN 56374.
Notice ofthis matter was duly served and published.
· In consideration of the information presented to the Planning Commission and its application to the Comprehensive
Plan and Ordinances of the City of St. Joseph, the Planning Commission makes the following findings:
The proposed variance is consistent with the standards for a Variance stated in St. Joseph Code of
Ordinances 52.8 Subd. (a-e).
Therefore, based on the findings above, the Planning Commission makes the following recommendation:
Approve the following Variance requests:
1. A Side Yard Variance of5 feet; and
2. A Rear Yard Variance of 10 feet.
Chair Klein closed the hearing at 7:35 p.m.
Graeve stated that the Planning Commission needs to assure that the landscaping discussed tonight will be
completed. Louis Krebsbach stated that the site plan does include additional landscaping, but the intention of Super
America is to go over and above the landscaping identified. Jim Krebsbach stated that the salt and chemicals ITom
the roads will playa role in the type and amount oflandscaping that will be completed. If the landscaping does die,
it will be replaced.
Utsch made a motion that the St Joseph Super America complete the landscaping as identified on the site
plan as a minimum requirement, including the boulevard on CSAH #75 and College Avenue, and around the
rubbish confinement structure; Seconded by Kalinowski.
· Discussion: Ehlert suggested that the Planning Commission determine the amount of landscaping Super
America should be required to complete. The Commissioner's determined that the amount on the site plan
was a minimum requirement and encouraged the Krebsbach to go. over and above the minimum.

Pond View Ride:e Six and Seven Preliminary Sketch Review
Bob Herges and Rick Heid presented the preliminary plans of Pond View Six and Seven, and Outlots A, B and C of
the Pond View Ridge Four. The Planning Commission requested that they start with Pond View Ridge Four Outlots
A., B and C.
Herges explained that the City Council approved the service of water and sewer to the three lots in question. The
intention is to create three lots for single family homes. The lots are approximately 13,000 square feet and meet the
minimum lot requirements as stated in the Ordinance. The old house and other structures will be removed. Herges
stated that it may be more desirable to have the homes in this area face 12th A venue, serving as the entrance to the
Pond View Ridge development.
Klein stated it is his opinion that the area is not large enough to create three lots. Klein sited the dimensions of
adjacent lots and he questioned if the 231 feet depth from Minnesota Street is accurate. Klein believes there is an
easement on the south lot, which makes the lot too small to develop. Klein further stated that the lot on Minnesota
Street should be developed in order to promote the house facing Minnesota Street, so all the homes align properly.
Utsch stated that he concurs with Klein and the City should promote a consistent visual site line on Minnesota
Street. Utsch questioned if Dale Street and Pond View Lane are stubbed into the Phase Six currently and will they
be extended all the way through Phase Seven right a way.
. Herges stated Dale Street and Pond View Lane will be extended to Eagle Ridge Drive. The road construction will
also include Eagle Ridge Court. The Phase Six will create 27 new residential lots.
Herges summarized the City Council meeting where Herges and Heid proposed the placement of homes along
Klinefelter Park, rather then extending 12th Avenue adjacent to the park. Herges stated that there was consensus
from the City Council that homes would be more desirable then a city street. The new design will allow for large
lots and higher value housing as compared to Pond View Ridge Five. The topography of the area and the park
promotes upper scale housing, which is what they are promoting. Herges further stated that many more trees will be
saved with the new design. Herges did express concern regarding the utility companies and their disregard for
saving trees when they place their utilities.
Heid stated that Stearns Electric Association requires that their lines be placed in the lot line and not the street
easement. Negotiations should take place soon with Stearns Electric Association to discuss the issue.
Ehlert stated that the City would take a position that all utilities will avoid as many trees as possible. Stearns Electric
should not be concerned with placing the line in the road easement since the City already planned for an 80 foot
right-of-way and expansion of this shouldn't occur. Carlson stated that he will contact Stearns Electric to start
negotiations.
Lesnick questioned Herges if there will be an access to Klinefelter Park off of 12th Avenue. An access to Klinefelter
Park would be beneficial to the development and the maintenance ofthe park. Herges stated that he would pursue
an access to the park off of 12th Avenue with his engineer to avoid the wetland.
Ehlert stated that it is essential to get to the east side of Klinefelter Park for the maintenance crews. The bridge built
across the stream is not sufficient to handle the maintenance trucks. Ehlert suggested that the park access connects
. with the sidewalk and the access should be paved. Herges stated that the access would occur during the
development of Phase Seven to avoid impacts to the wetland and holding pond area.

· Graeve questioned if wetlands have been found within the development area. Herges stated that Wet Tech
Consultants were requested to assess Lots 9, 10, and 11 along Pond View Land E. There are grassy areas on these
lots and the consultants will prepare a report for the City. The wetlands will either be avoided or replaced through
the wetland bank program. Herges further stated that the soil conditions in the area have required that 18 inches of
the road bed will be removed and replaced with Class 5 prior to paving. Herges discussed the possibility of placing
drain tile on each lot to control runoff and/or any potential water problems for the homes.
Schneider expressed is support for the idea of placing drain tile within each lot. The drain tile would control excess
runoff and should be connected to the City's stonn sewer system. Herges stated that it is just a concept at this point
and cost/benefit analysis will be completed.
Herges stated that he would work with Carlson and the City Engineer to address the concerns express by the
Planning Commission. The plan is to get preliminary approval for Phase Six and Seven. Phase Six will consist of
24 residential lots and should be completed within the Summer of2000. Phase Seven will be completed in 2001,
depending on the market
Wahlstrom questioned who will contact the utility companies to get them on board with the City's desires. Carlson
stated he would contact the appropriate individuals prior to the preliminary plat hearing.
Rental Housin!! and Affordable Housin!! Discussion:
Klein introduced Councilor Twit. Councilor Twit prefaced his comments by stating that he is addressing the
Planning Commission as a concerned citizen of St. Joseph and comments should not reflect the views of the St.
Joseph City Council. Twit stated that many of the older homes in neighborhoods throughout the community are
being put on the market and sold to individuals who's sole intent is to rent them to students. The process is taking
affordable housing off the market for first time homebuyers and new families wanting a home. Twit requested that
the Planning Commission consider recommending to the City Council a moratorium on issuing new rental license
· permits within the City. The moratorium would allow the Planning Commission to research and address the Zoning
Ordinance. Twit stated there are portions of the Zoning Ordinance that promote converting older homes to rental
units. In fact, every home within the City ofSt. Joseph could be converted to a rental unit under the current
Ordinance. Twit further stated that the Colleges are promoting on campus living and the City is not cooperating in
this effort by issuing more and more student rental permits every year.
Carlson informed the Planning Commission of research he has conducted with the League of Minnesota Cities.
Many college communities are facing the same issues and the research staff for the League will be contacting him
within the next week with information.
Utsch suggested changing the defmition of family as a starting point of discussion. Utsch suggested eliminating the
last sentence ofthe definition referring to unrelated persons. Carlson stated that the League is researching that
possibility, but State Law is very clear that unrelated persons must be included in the definition of family due to
group homes and daycare facilities.
Twit suggested the Planning Commission consider all multi-family and rental uses be subject to a Special Use
Permit. Twit stated that community goals would need to be established, the goals would then need to be protected,
and neighborhoods would benefit ttom the process. Utsch questioned Councilor Twit if the City Council would
consider a moratorium on issuing rental licenses.
Carlson stated that the City Council would need to initiate the process for a moratorium. The Planning Commission
can recommend City Council consider a moratorium.
Utsch made a motion that the City Council consider a moratorium on the issuance of rental licenses in the
City of St. Joseph to allow the Planning Commission to study and recommend solutions to the City Council;
Seconded by Lesnick.

Affordable Housine: Discussion:
Graeve introduced Dan Fin. Dan Fin is a member of Great Rive Inter Peace (GRIP). GRIP is a collaboration of
churches concerned with the lack of affordable and low income housing in the greater St. Cloud Area. Fin explamed
the purpose tonight is to inform the Planning Commission that the need for affordable housing is not a S1. Cloud
problem, but a regional problem including S1. Joseph. Fin addressed the following questions prepared by GRIP:
1) Affordable housing: What is the problem?
2) Who can afford what?
3) Isn't affordable housing just a problem for the City ofSt. Cloud?
4) What is the cost of housing in the area?
5) What kind of wages do people earn in our area?
6) But don't most families have two wage earners?
7) What kind of housing gets built in our area?
Fin stated GRIP has provided input to the St. Cloud Area Master Plan development and will be a key component in
a proposed regional housing board that will address affordable housing. GRIP has realized that steps need to be
taken to help hard working citizens of greater S1. Cloud in affording housing. Fin further stated that cities and the
public need to become involved to find solutions to the affordable housing concern.
Graeve stated he appreciated the presentation by Mr. Fin. Graeve stated the presentation gave the Planning
Commission a better understanding of the affordable housing issue and how St. Joseph can be a part of the solution.
Utsch stated that S1. Joseph has many homes that were built for low-income people. Many of the homes are now in
disrepair and need major renovation. Utsch further stated that affordable housing construction must be monitored
· carefully as not construct sub-standard housing in the community.
Schneider stated that contractors must be persuaded to construct affordable housing because they cannot make
money on the projects. Contractors cannot simply affordable to build $70-$80,000 dollar homes and expect to stay
in business. Schneider further stated that there are contractors out there that construct low income housing, but the
product must be monitored closely.
Fin stated that the area cities must become involved in creating policies and goals for low-income housing. It may
become a monetary involvement at some point for the City of St. Joseph. The cities must create an atmosphere that
promotes affordable housing or nothing will change.
Utsch stated that the discussion tonight involving rental units might help ftee up affordable housing in the
community. Young couples and families should have an opportunity to own a home in St. Joseph. Schneider stated
that older homes can be an answer, but many of the homes require extensive renovations.
Ehlert stated that consmners and the City must be careful regarding the construction materials used. Many of the
homes in the Northland Addition are affordable housing, but many of the foundations are stick built and not
masonry. These homes tend to depreciate, rather then appreciate, in value. Ehlert further stated that City has a
fiscal responsibility to provide services to the residents. City services are paid through property taxes and when a
development doesn't support the services, the entire community subsidizes the development. The EDA completed a
preliminary study, which has shown a new home must have a value of $98,000 for the City to break even with
services provided by the City. The City must stay in the loop regarding the affordable housing issue.
Fin stated that the new regional housing board and GRIP will be addressing issues raised tonight and information
will be forwarded to the City.

11) After approval of the plat by the City Council, and the completed
development of Part One by the Developer, the City will review drainage
and utilities for possible alterations/additions. If the City determines that
. there are inadequacies in these areas they Developer will be responsible for
all corrections.

Dear Mayor and Members of the Council and Planning Commission:
I reviewed the information I was provided for the preliminary plat for Pond View Ridge Six.
Since some of the required submittal information is missing, I cannot complete my review at this
time. I will provided some general comments below, and have enclosed additional comments
· with regard to the St. Joseph Subdivision Ordinance. I have also enclosed a copy of my
memorandum to you dated August 2, 1999.
1. While I am in general agreement with the lot and street layout, I believe the City should
require an access to Klinefelter Park for pedestrians and maintenance vehicles. The
Subdivision Ordinance requires pedestrian access where blocks are over 800 feet in length.
We should also determine whether we want sewer and water extended into the park from
12th Avenue.
2. The Drainage, Grading and Utility Plan shows absolutely nothing with respect to grading or
drainage. These willbe major issues and need to be addressed in detail before the preliminary
plat is approved. I would like to see as much of the surface runoff as possible retained on the
lots. A storm water outlet will have to be found for the south half of the plat. The grading
plan, when submitted, should include an erosion control plan.
..., The utility plan does not show pipe sizes. No utilities whatsoever are shown for Lot Nos. 18,
.J.
19, 20, and 21. There will likely be a need for additional easement across the front of these
lots to allow for sewer and water. We will want to see water main extended to the south in
the vicinity of Pond View Court, so we can eventually loop the system.

3. Pond View Drive should be renamed Pond View Lane to match the street already in place to
the north. It won't fit the grid for the City because where Pond View Drive connects to 12th
A venue, the grid shows a street beginning with the letter liE". Since Eagle Ridge Drive
already takes care of this, we could leave the street as Pond View Lane.
4. When we get to reviewing construction plans later in the process, I would like to see a street
design based on soil borings since the soils are difficult at best in this area.
5. The Developer should contact me before preliminary construction plans are prepared,
because we have updated the City's standard construction details and I want to be sure these
are included in the next project. I want to see preliminary construction plans so changes can
be made without a lot of additional rework.
6. To the best of my knowledge, there is still not an executed agreement between the Developer
and Northern Natural Gas with regard to developing over their easement. This affects Pond
View Ridge Four as well as the current plat. Someone forwarded the blank agreement forms
to me while Pond View Four was under construction, though they were addressed to the
Developer's Engineer. I will return these to the Developer for execution.
· 7. There are numerous punch list items outstanding on Pond View Ridge Three and Four. There
was ample opportunity to get these done last summer while Pond View Five was under
construction, but as of October 19, 1999, they were still incomplete. I ask that the City
Council not permit any construction on Pond View Six until the punch list items for Pond
View Three and Four are completed.

exceeds 800 feet along Pond View Drive, but I do not see any
advantage to a pedestrian access in this location.

I understand the next addition to Pond View Ridge is coming soon and want to remind everyone of several
issues that should be resolved before the platting process gets too far along.
1. A final decision needs to be made regarding the location of 12th Avenue SE as it goes past Klinefelter
Park. We need to agree on either the road going past the park or having lots back up against the park.
2. We should consider an access to the park from 12th Avenue SE for maintenance purposes, and perhaps
to take some of the public traffic out oftheCloverdale neighborhood. We currently have a rather indirect
access through Cloverdale (you have to wind through residential streets), and plan to construct a second
access from Seventh Avenue SE; the current parking lot plans will accommodate both locations. Do we
· need to get the general public into the park on the east side?
3. Do we want to extend utilities into the park from 12th Ave SE?
4. The original plan for Pond View included bringing drainage from the next addition through the park as
we did with Pond View Four. During my original review, I noted the need for a sedimentation pond for
the water prior to entering the park. This must still be provided for, and routing the water through the
park needs to be checked.
5. I would like to see a preliminarY layout of the utilities, street grades, and proposed drainage before they
become final and too hard to change. I want to be sure we have enough storm sewer inlets properly
located to handle the steep street slopes, and 1 want to see some of the rear yard runoff captured with
swayles and a catch basin so the water doesn't all run down the lot line and over the curb at 12th. Ideally,
some temporary ponding to slow the water down in the rear yards would help.
6, I would like to see a grading plan that establishes pad elevations for each lot, that provides the building
inspector with enough information (satisfactory to the inspector) to determine that lot grading by the
builder is proceeding in accordance with the plan, and that effectively addresses the erosion problems
\ve had with Pond View Four. The plan should also allow us to save as mmy trees as possible, and limit
stripping ofthe surface to only those lots that can be built on immediately, All silt must be contained on
the site. Silt fences that don't stay up won't do it.
7. Finally, I recall a document that was circulated between the Developer, his Engineer, and me regardirg
an easement owned by Northern Natural Gas Company that affects the southerly extension of 12th
A venue SE. Noone knew what to do with it at the time, and I believe it ultimately landed on mydesk.

7. The three lots located at the intersection of Minnesota Street and 12th Avenue appear to
be undersized in width, at least the southerly two lots. The zoning statute requires lots to
have an average width of75 feet (See Section 52.17, Subd. 5). The two southern lots
have a front width of75 feet and a rear width ofless. I believe that it will either be
necessary to replat this area into two lots or secure a variance with regard to the lot width.
Due to the unique nature of this property (a smaller unplatted parcel located at a comer)
and the extra depth of the lots, the variance would be appropriate. The other lots in the
plat appear to be properly sized.
I presume that Joe Bettendorrvvill take a closer look at the design characteristic3 of the Plat.
When the matter comes before the Planning Commission for consideration, if any specific
conditions are required, please advise me. We can have those included in the developer's
agreement. ,,'
Before the final plat is brought forward for approval, I suggest that we meet with the developer

Per your request, we have reviewed the above referenced
preliminary plat relative to transportation planning issues.
st. Josefh City and Township Transportation Plans have
identified 12 h Avenue S.E. as a new collector corridor from
Minnesota street South to C.R. 121. The st. Cloud Area Planning
Organization (APO) 2020 Roadway Plan also includes 12th Avenue
S.E. as a corridor for preservation. It states that from a
. roadway system perspective, it would be desirable to have a
north/south collector extending south of CSAH 75 at C.R. 133 to
C.R. 121 at Jade Road.
The Preliminary Plat of Pond View Ridge six has
appropriately included 12th Avenue S.E. as a 44 foot roadway
within 80 feet of right-of-way. However, the plat layout, with
direct lot access onto 12th Avenue is inconsistent with the
collector function of 12th Avenue. To enhance this collector
function, the plat should be designed to eliminate driveway
access to the extent possible. A suitable example would be on
the east side of 12th Avenue S.E. between East Baker street and
East Dale street.
Encouraging compatible plat designs will allow 12th Avenue
S.E. to safely and efficiently perform its planned collector
function.

I live at 1512 Dale St. E. which is Pond View Ridge Four Lot 002 Block 004. I am
the second house west of what was 91st which is now called 16th Ave. SEe My
property directly adjoins the new proposed Pond View Ridge Six.
I am not able to attend the Public hearing on Monday February 7, 2000 because I
. will be out of town. I am writing because directly behind my house is a wetland. I
strongly want to see that wetland area preserved. I grew up in Northern Minnesota
on a lake and have been taught to value and appreciate nature and that we need to
take care of the habitat around us and preserve it. Tbese natural habitats are
exactly what they are called....natural. They just aren't made anymore. I chose the
lot that I have because of the wooded area and wetland area which is around me. It
provides a lot of nature to this area which I do not want to see disturbed or taken
away. I am an avid bird watcher and it is amazing the bird activity which occurs in
my yard and in our neighborhood because of those trees and wetland.
In the 1 ~ years that I have lived on Dale St. I have had deer, rabbit, fox and many
many birds in and around my yard. I feed the birds regularly and they enjoy the
area behind me. There are ducks which are also in the wetland especially in the
spring and early summer. Geese are also around on a frequent basis. The wetland
has a lot of water in the spring and early summer - to the point that it begins to
creep up into my yard in the back. I've seen many 3 and 4 wheelers get stuck
behind my house as they try to drive through there in the spring and summer. If we
get a lot of rain, once again, the wetland is quite wet and is a water storage area
which stays wet during those times. When we have rain, I have had water begin to
come up in the back yard from the wetland so it does contain a fair amount of water
for those months of the year. It is not a dry area. It is very wet in the spring and
summer. If we have a rainy fall, the water once again fdls up there.
. I am writing in support of maintaining the wetland area which is behind my house.
It provides a lot of nature for the neighborhood and provides a country/nature like
. setting for those of us that live in Pond View Ridge. Please do not destroy that or
take that away from us or myself. The properties which will be built back there will
be much more valuable in many ways if the wetland is protected and kept. Many
people will be able to enjoy the nature and setting it provides - a value that money
can't buy.
Thank you for your consideration. My family has been involved in nature
preservation for years and we have worked with the DNR and other agencies to
preserve nature while growing up on a lake for 25 years, being part of a lake
association, protection of Bald Eagle nesting areas, Blue Herron nesting areas and
studies to maintain good water quality in the lake. So, nature preservation has been
a part of my life for many years. I wish to see this wetland maintained.
