Rezoning Request - Birch Street East

Public Hearing - Rezoning of Property abutting Birch Street East
PREVIOUS ACTION
The Planning Commission conducted a public hearing on May 3, 2004 and considered the same request.
The Planning Commission recommended the Council approve the request as it was consistent with the
Comprehensive Plan. The City Council on May 20,2004 voted to accept the recommendation of the
Planning Commission, but the vote was 3 ayes and 2 nays. Rezoning from Rl to Business or Industrial
requires a super majority vote. Therefore the rezoning was denied. The Council members voting against
sited lack of a development plan, lack of zoning control and questionable process as reason for denial.
With regard to the first two, lack of development plan and lack of zoning control. Of the eight
. properties affected by the rezoning, only one property was requesting to convert to a business use and that
was an office space. One of the concerns raised was that once the property was re-zoned the City would
have no control over the development and something such as a strip mall could be constructed. The
comment continued, that depending on the tenants of the building, a traffic hazard could be created or it ~
could have a negative impact on the neighborhood. Discussion included whether or not the City should
amend the Ordinance to include a special use provision for development abutting a residential
neighborhood. For an opinion, the matter was referred to the City Attorney for review and comment.
Enclosed in your packet is the opinion whereby the City Attorney agrees that a mechanism for
development approval is already in place and the City would have the ability to deny a permitted use if it
is determined that the use is incompatible with adjacent land uses or inconsistent with the intent of the B2
Zone.
Within the same comment, it was questioned if the City would be creating non-conforming business lots.
In your packet is an illustration of the affected properties with i11ustrating the setbacks and the remaining
building pad. Any development or redevelopment that occurs must meet all the setback requirements. I
think the Planning Commission already agreed that development or redevelopment might require the
purchase of more than one lot.
With regard to the process. The question arose as to how the petition was initiated and whether or not the
procedure was followed. The request for rezoning at this time has been initiated by the City Council.
Therefore the Planning Commission need only act on the request. A boundary survey and site plan does
not need to be submitted.

RECOMMENDED PLANNING COMMISSION ACTION .
Recommend the Council rezone the property abutting East Birch Street as it is consistent with the
Comprehensive Plan.

Dear Judy:
The City has asked us to evaluate whether the B2 Zoning Ordinance provides the City
with enough discretion and independent judgment to deny a building permit for the
proposed development of a strip mall.
Please be advised that Subdivision 9 of the B2 Zoning Ordinance does give the City .
discretion to deny a building permit for the strip mall. However, the Planning
Commission must first review the development plan and determine that the use and

City of St. Joseph
The St. Joseph Planning Commission will be conducting a public hearing on Monday, June
Administrotor 21,2004 at 7:00 PM in the St. Joseph City Hall. The purpose of the hearing is to consider the
ludy Weyrens rezoning of all property north of the east/west alley abutting Birch Street East between the
north/south alley between College Avenue North and 1st Avenue NE and the north/south
Moyor alley between I st Avenue NE and 2nd Avenue NE. The property is currently zoned R-l.

Variance - Sign Request - Stonehouse Tavern

PREVIOUS ACTION
The Planning Commission conducted a public hearing on June 7, 2004 for a 44' variance on the size of a
business sign for Stonehouse Tavern and Eatery. The general consensus of the Planning Commission
was that their were no findings to grant a variance and were heading towards denial. The contractor for
the project requested clarification on how the maximum size of a sign is determined and indicated that in
the industry signs are measured on the size of the lettering. In addition, the property owner indicated that
a hardship would be present if the variance was denied. Therefore, the Planning Commission tabled the
. matter to June 21, to allow the property owner to reconsider the findings for granting a variance and an
opinion from the City Attorney determining how a sign face is measured could be rendered.
RECOMMENDED PLANNING COMMISSION ACTION
Deny the variance request as the property owner has re-designed the sign to meet the Ordinance and their
were no findings to grant a variance.
COMMENTS/RECOMMENDATIONS
The property owner has resubmitted the sign design and it now fits within the Ordinance. Therefore the
variance is not needed. In order to satisfy the procedural requirements of a variance, the Planning
Commission should formally deny the request.

The City has asked us to research ho\v signs are measured. Please be advised that a sign should
be measured by its outmost physical limits, not by the wording or graphics on the sign.
First, the City Ordinance defines "sign" as:
a name, identification, description, display, illustration
or device which is affixed to or represented directly or .
indirectly upon a building, structure or land in view of the
general public and which directs attention to a product, place,
activity, person, institution or business.

College of St. Benedict, request to rezone the property east of County Road 121, south of Kennedy
Elementary School.

A public hearing needs to be established for the rezoning of the attached property as it is currently zoned
Agricultural. The Planning Commission should also determine what process will be required. It is the
recommendation of staff that the property be platted and rezoned Rl with a special use permit.
. COMMENTS/RECOMMENDATIONS
The College of St. Benedict has requested to construct a Presidents Residence across from the main
entrance. This has been a difficult plan to review. First, a determination of appropriate zoning must be
made. When the Planning Commission worked on the Comprehensive Plan, the are in discussion was
guided for mixed density. Their was some hesitancy to include E & E as a future land use. In reviewing
this request, the proposed use is not a problem, in fact, it is nice to see that the President of the College
will be a resident of St. Joseph. It appears as the best way to rezone this property is to rezone only the
portion of property where the house will be located as Rl with a special use permit. The Special Use
Permit would be very specific and wi11 place limitations such as that the property could not be converted
to rental. The College is requesting a hearing to rezone to E & E, as staff we believe the hearing should
be for Rl and a special use permit.
The second issue is platting. The property should be platted before it is developed. I requested the
College submit a plan for the entire parcel. Jim Fredricks has indicated that the plan submitted is only a
"best guess" and any further development could be many years in the future. Regardless, the property
could be platted with outlots that could be subdivided at a later time. If the Planning Commission concurs
the College would be required to complete the Preliminary Plat process. The subject property is metes
and bounds.
The City also needs to discuss access issues. Representatives from the City will be meeting with Steams
County next week. This information will be available for review before the public hearing.

Dear Ms Weyren,
The College is beginning to develop of 62 acres of property located just east of the existing
campus across College Avenue. We have included a proposed Ghost plat/site layout of what we
envision for the future on that site.
. We are however only proposing to build a Presidents residence as soon as practical and the
remainder of the facilities would come at a later date probably 5 - 10 years. As you may know or
not know the College is hiring a new President who will begin employment on August 1 sr, 2004.
The President has indicated a strong desire to live in the community and a donor has come for-
ward and is interested in supporting this initiative. We anticipate the residence to be approx-
imately 5,000 square feet in size would include a larger Hospitality space and placed on a 4 acre
site.
The current zoning on the property is Ag and as we discussed earlier last week Ecclesiastical/ ·
Educational would be the best fit for our future development plans. Because of the small portion
being developed we have not fully addressed the stonn water issue other then to incorporate the
Callaway Street run off with our future plans. We look forward working with your staff, the
Planning Commission and the City Council on this important project. If you have any questions

RE: Proposed Presidential Residence
Dear Judy:
. The City has asked us to analyze how the area with the proposed presidential residence
should be rezoned. The area is currently zoned as agricultural and must be rezoned if the
City chooses to accommodate the presidential palace and future developments.
