Completed applications for Development Plans and required fees shall be submitted the City of SI. Joseph Zoning Administrator at least 10 days prior to the
proposed date of consideration by the City, The ten days allows the City to review the application and forward the application to other entities for review when

Re: Kaeter Trucking Site Plan Review

Randy Kaeter is proposing to build a 60' x 72' by 26' 7" office warehouse building on Lots 8 and 9,
Block 1 of Rennie Addition. The building will consist of 3,344 square feet of warehouse and 976 square
feet of office space on main level and a 976 square fee of mezzanine space for storage and dispatch
office,
The building will be a post frame style construction on an 8" poured concrete continuous foundation, A .
loading dock with 2 overhead doors will be located on the south side of the building, The landing dock
will be parallel to 19th Avenue,
The exterior finish materials will be steel panels with some decorative wainscoting material on the side
facing 19th Avenue. A total of seven trees are proposed, five deciduous and two conifers. A paved
parking lot is proposed in front of the building for the required parking spaces. The balance of the lot
where the trucks will be circulating is proposed as Class II Gravel. A storm water retention pond is
shown in the southwest comer of the site,

The lot meets the minimum area and frontage requirements of the ordinance however; the plan shows
a proþerty line down the middle, The parking lot and a future building addition cross the property line,
A lot combination /replat must be done to eliminate the property line, All required setbacks are met or
exceeded with the proposed placement of the building on the lot. Site coverage is less than 50% of the
lot area,
The side of the building facing a public street must have a minimum of 25% of the exterior building
materials as face brick, natural stone or cultured rock, glass, vinyl, stucco, aluminum lap siding, cut
block or concrete block with decorative texture applied, The architect has shown a 3' 5" high
CD wainscoting of stenni panel. 3'5" x 60' = 210 square feet. They have also taken credit for the glass in
each window and the door as well as the shingled surface of the eyebrow canopy over the door. Their
calculated area of "decorative materials" is 426 square feet; 324 square feet is required, I think that the
, credits taken stretch the intent of the ordinance, The gable end of the building facing the street is 26' 7"

\ tall to the peak, The 3'5" wainscot appears insignificant. Less credit needs to be given for the windows

and more wainscoting material must be provided. A description of the stenni panels must also be
provided,
. Ordinance requires off street parking for a warehouse storage building be provided at a rate of eight
W plus one for every two employees per shift or minimally one space for every 500 square feet. Office
space is required to provide one space for every 250 square feet of floor area. 8ased on these ratios,
sixteen spaces are required for the warehouse and five spaces are required for the offices. A total of
twenty one spaces are required.
The parking lot is shown with bituminous surfacing but no curb is noted. The parking lot must be
provided with 8612 curb around the perimeter.
ø-Ge dumpster is shOWl1 on the south side of the building. No screening as required by ordinance is
shown. The dumpster and any exterior HV AC equipment must be screened.
~ven trees are shOWl1 as the landscaping. No delails of size or species are provided. A detailed and
'3 nhanced landscape plan is required to be submitted and approved by the Planning Commission.
A lock box is required on the exterior of the building for fire department access prior to occupancy,
Recommendations:

2. Install 324 square feet of decorative wainscoting material on front of the building.
3, A sample of the stenni panel for Planning Commission review and acceptance,
4. Four additional delineated parking spaces,

· Silt fence shall be installed near the west property boundary and southwest corner of
Lot 9.
· Contact City of St. Joseph Public Works prior to connection to water or sewer.

Tom and Mary Kay Lemmer propose to add a wood framed building onto the loading dock they
constructed in 2003, T he e xìsting loading dock c onsisls 0 f poured concrete. I t í s constructed 0 n
continuous frost footings. The top of the doc!< is 4 feet aboVe adjacent grade. The loading dock Is
located 40 feet behind the office and repair building constructed in 2002, The existing office building
was constructed before the adoption of the current zoning ordinance. Wíth the exception of the eight
daHneated bituminous parking spaces, the entire lot is gravel. Landscaping consists of 8 arbor vitae
and 180 sq feet of lawn.
Lemmer Trucking hauls milk and other dairy products for Land 0 Lakes. Three to four truck loads are
hauled in each day and reloaded into other trucks for distribution to various destinations, The proposed
building will provide shelter from the weather and help protect the products. Refrigeration of the .
building is planned in the future.
Empty trucks are parked at the loading dock and at points open on the yard. The loaded trucks are
parked in the 50 foot wide yard of the existing office building. The spaces for the loaded trucks are
designated with'the wooden posts containing electrical outlets for plugging In the refrigeration units on
the trailers and the block heaters on the trucks in cold weather conditions. The door to the repair bay Of
the existing building is located on the front (east) side of the building

The existing building was constructed and the use was approved before adoption of the current
ordinance, therefore there is no adornment or special treatment on the building. The east waH of the
proposed structure faces 19111 Avenue. It Will be screened from view with trucks being loaded and
unloaded.

Ordinance Section 52.33 SubdivisÎon 9C requires a minimum of 25% of the exterior building 1inish
. directly facing streets consist of decorative materials comparable to face brick, natural stone. cultured
rock.; glass, vinyl, stucco. aluminum lap siding etc. The east side of the proposed building is over 65%
\....:: door openings. Adomment of this side of the building will be negligible. The current site conditions
exemplify the need for the more restrictive aesthetic requirements of the current ordinance.
Recommendations
Site enhancement through building adommentwill best be achieved by addressing the aesthetics of
@ the existing building. I recommend that the applicant apply the requirement for 25% adornment to the
t;J. existing building end to the north side of the proposed building. The minimum adornment of each of
,.' these building elevations should be a contrasting steel lap siding.
Also within 10 months of the issuance of a building permit for the proposed structure. all truck parking
except those being loaded, unloaded or repaired shall be located west of the loading dock or plans to
effectively screen trucks from view from the street must be submitted for review and approval by the
Planning Commission.

are listed below:
· No utilities are involved with this project.
· Changes to surface water drainage patterns are not proposed.
· Drainage around the new truck dock building shall to be contained on-site and directed to
the holding pond.
· The existing driveway is gravel surface, The City's current zoning ordinance requires
@ paved driveway and parking surfaces (including loading dock areas). The ordinance
allows applicant to apply for a conditional use permit to allow Class-2 surfacing for .
specific industrial uses. However, the paved driveway (at least up to the building) is
recommended to eliminate loose gravel being carried out to the street. The driveway
shall have a concrete apron per the attached detail.

For information purposes I am providing you with correspondence that has been occurring with Dave
Puchalla regarding the potential construction of an R3, Structure. Dave currently owns the property on 2nd
Avenue NW adjacent to the ball park (known as the "bullpen"). He is proposing to demolish the existing
structure and construct a new facility.
The first plan included four - four bedroom units. The submittal was not adequate and cursory review
concluded that the project was overbuilding the site. The second plan was submitted reducing the facility
to two four bedrooJP. units. While most of the information was presented a significant ~µ1oµnt of
information was missing. The plan again has been rejected and staff has since met with the Pl1QPlllrpr
owner and consulting engineer. Dave may be requesting a special meeting, however we will not schedule
such until the submittal is complete.

Judy Weyrens I am in receipt of your revised site plan to develop a multifamily structure. The plan is still
considered incomplete and we are requesting the following information:

Councilors Avenue NW and then northward to Birch Street West where it is then collected.

3. Utilities - In reviewing the, current utility lines, it appears as your current sewer

property will be serviced with water and sewer including the size of water line
that will be installed. The current water service is only a one-inch water service
and that will not be adequate for the facility you are planning,
4. Density calculations - In a letter dated July 19, 2004 we requested that you
. provide your density calculations
5. Access from the alley - If you are requesting to use the alley as an
ingress/egress provide details as to how the area will be improved along with
financial commitment to pay for such.
In an effort to obtain the additional information, I contacted both you and Trish as Cole Group.
During that conversation I was informed that the site plan would be changing. Therefore, based
on the additional information that is need and the submittal of a third plan, your development
plan cannot move forward to the Planning Commission. As soon as you submit yourfina/ plan
with the additional information requested above, the matter will be scheduled on the next
available Planning Commission agenda.

. session on Wednesday. September 8. 2004 at 7:00 PM in the St. Joseph City Hall.

Deutz made a motion to approve the minutes of July 26, 2004 as presented; seconded by

Public HearinQ, Interim Use Permit - Jim OdeQard: Chair Utsch called the hearing to order and stated the
purpose of the hearing is to consider an Interim Use Permit to allow an owner occupied rental unit in an
R-1, Single Family Zoning District. The property is located at 736 College Avenue South,
. St. Joseph Code of Ordinances 52.27, subd 5 allows for an Interim Use permit as follows: Residential
rental provided the unit is owner occupied and provided the room (s) rented does not contain separate
kitchen facilities and is not intended for use as an independent residence. For purposes of establishing if
the property is owner occupied, the owner must be a natural person and the owner occupying the
property as his or her principal residence and must own a fifty percent (50%) or greater interest in the
property.
Jim Odegard spoke on his own behalf. Odegard stated that his property was recently annexed to the City
of St. Joseph and he was unaware that he needed a rental license if part of his home is rented. Odegard
stated that he originally was a tenant in the lower portion of the home and decided to purchase the home
shortly before the property was annexed. The home functions as a duplex with two separate kitchen
facilities and a common entrance. Odegard stated that the upper unit is rented to three unrelated persons
and he questioned the portion of the Ordinance relating to separate kitchen facilities,
Their being no one present to speak the public hearing was closed.
Loso made a motion recommend the Council approve the Interim Use Permit for Jim Odegard
allowing an owner occupied rental unit at 736 College Avenue South with the following
contingencies:
1. The license will be reviewed annually, verifying Ordinance compliance.
2. The license in non-transferable
3. Approval of the Rental Housing Inspector.
The motion was seconded by Graeve.
Discussion
Lesnick questioned if the home was rented to a family or individuals, Odegard responded that the
- tenants include three individuals and at this time he does not wish to reduce the number of tenants,

Deutz questioned that if the property in question is a duplex, was the property assessed accordingly, .
Weyrens stated that the City was not aware the property was being used as a duplex, therefore it was
assessed as a single family unit. Weyrens stated that since the property is operating as a duplex the
maximum occupancy will have to be determined by the City Attorney and Rental Housing Inspector.
During the review of the property, the assessment issue will also be addressed,
Graeve questioned if the matter should be tabled until the outstanding,issues are resolved. Weyrens
stated that if the Planning Commission agrees with the Interim Use Permit, then the approval can include
the contingency that the maximum occupancy is to be determined by the City Attorney and Building
Official.
Loso agreed to amend the motion to add the following contingency
4. The maximum density will be determined by the City Attorney and Building Official.
Graeve concurred with the amended motion and the motion carried unanimously.
Safeshred - Amended Site Plan: Weyrens reported that Safeshred has submitted a revised site plan
which reduces significantly the landscaping plan, The Planning Commission on August 2, 2004 approved
the site plan for the construction of a 12,000 square foot facility, A requirement of the site plan is a unified
landscaping plan, The builder has indicated that cost of the landscaping plan is prohibitive and has
recommended removing the tree lines on the north and south property lines,
Weyrens stated that the revision will also require EDA approval as the covenants for the St. Joseph
Business Park requires screening of overhead doors and a more extensive landscaping plan, The St.
Joseph Code of Ordinances only requires a unified landscaping plan, Based on that requirement the
revised plan does meet the intent of the Ordinance, but requires approval by the Planning Commission,
After considerable discussion Loso made a motion to accept the revised site plan with the addition .
of 8 trees which should be placed on the property as follows: 2 on the north property line, 2 on
the south property line and 4 abutting the parking area. The motion was seconded by Deutz and
passed unanimously by those present.
OTHER MATTERS
Candidate Forum: Graeve announced that the HCP and area civic groups will be hosting a candidate
forum on October 12, 2004, The candidate forum is an opportunity to question the candidates running for
the Mayor and Council positions, The forum will include prepared questions as well as random questions
from those present.
Proposed Amendment to the B2 Zoninq District: Deutz stated that he has previously discussed with
Chair Utsch the amending of the B2 Zoning District to allow non-owner occupied rental units. Deutz
stated that the homes along Birch Street are on the market and are too small for individual development.
Therefore, he questioned if their could be a transition period where rental would be allowed. The
Commissioners agreed to consider this request after the R4 Zoning District is completed.
Special Meetinq Request: Weyrens stated that Dave Puchalla is re~uesting a special meeting of the
Planning Commission to consider the construction of a duplex on 2n Avenue NW, The Commission
agreed to meet on September 21,2004 at 7:00 PM provided the application is complete,

affordable housing, but he cannot construct a house for $130,000,
Graeve questioned the protection of the Sauk River and if in Ekola's opinion the area is protected. €keIa
stated th3t the developer h35 done more to protect the river than that required by the DNR. Ekola stated
that the City Ordinance is more restrictive then the DNR regulations thereby requiring a more stringent
protection of the Sauk River. Packer assured the Planning Commission that the development will not
destroy the shoreland and he too has a desire to preserve the area.
The Planning Commission by consensus accepted the concept plan for River's Edge and instructed
Packer to contact the Park Board before beginning the Preliminary Plat process,
September Meetinq: Due to the September Planning Commission meeting date falling on Labor Day,
Weyrens asked the Commissioners to chose an alternate date to which it was determined the regular
meeting will be held on Wednesday, September 8, 2004 7:00PM

From the loading Dock, to the Front of the existing Building in Brick 4' up, across the
Front facing 19th Avenue.
In reference to 2 -C dated 9/2/04 the Color of the Building will be all Kelly Green
not 2 Toned in the Front Facing 19th Avenue.
