The house will serve as the office for the pond shop. ORDINANCE: Since the building is already located on the property and not being expanded building meets the requirements of the Ordinance. The building satisfies both the County setback requirement and the City. The Planning Commission at a previous meeting approved a fence permit which has been constructed. Nancy Scott is in the process of reviewing the request. There are some building code issues that will need to be resolved but she does not anticipate a problem. At this time the parking plan has not been submitted but will need to be included before approval. Randy is in the process of preparing the plan. If! receive it before the packets are delivered I will include it or else he will bring it to the meeting with him. ACTION REQUESTED: Authorize Scenic Specialties to secure a building permit .............................................................................. . REQUEST #2: Authorization to secure a sign permit for scenic specialties ORDINANCE: At this time the proposed sign exceeds the requirement of 50 square feet. The sign proposed exceeds the current Ordinance by 100 feet. While the Commission is reviewihg this Ordinance the timing may require Schmitz to apply for a variance. John Scherer has been out of the office all week so I could not discuss this matter with him. This sign falls under the business sign category. I will contact John before Monday night to see what the options are of the Planning Commission. ACTION REQUESTED: Schedule a public hearing for a variance request. . We are wanting to move the original farm home, which is well over 100 years old and restore it to the extent that we will be able to, and move it to a more prominent location. OUr goal will be to use this for our retail store called "the Pond Shop" which is currently at ønothtT location. We want to put the building to a better use and feel it would be a neat addition to our futW'e business here. No advertising sign may be erected within 200 feet of an adjoining residential district. Where the advertising sign location is across the street or roadway from a residential district, compliance with the set-back requirements ofthe zone in which the sign is situated shall be considered adequate. Subd. 12: Business Signs. Business or industrial signs may be erected, attached or painted on to a structure, and maintained in conjunction with a commercial or industrial use provided: a) That the area on one side of all such signs erected on one street frontage of any one premises, shall not exceed fifty (50) square feet. b) Such sign except a directional sign, is erected only on the premises on which the use, to which the sign relates, is conducted. c) Notwithstanding the above, where two or more separate and individual commercial or industrial operations are conducting business in separate areas of a single building or structure, in which each operation owns or leases separate and individual premises, but share in the use and maintenance of common areas within or around the structure, then and in those circumstances, each individual business · operation may be pennitted to display an individual business sign as provided in subdivisions a) and b) ofthis Section, except that said sign must be directly attached to that particular premises actually occupied by the business operation to which the sign relates. In addition to these individual business signs, the combination of business operations occupying the structure, may maintain a 50 square foot sign detached from the structure identifying the structure, the individual business operations located therein, or other reference to the combination of business operations located within the structure. For purposes of this subdivision, a combination of two or more business operations within a single structure includes, but is not limited to, shopping centers, shopping malls, and subdivided retail, office or industrial buildings offered for lease or condominium ownership. Subd. 13: SÜm Removal All signs not maintained and kept in good repair shall be subj ect to removal upon direction of the City Building Inspector. Subd. 14: Accessory Buildings. In all residential districts detached accessory buildings shall be located in the rear yard. When located within ten (10) feet of the rear wall ofthe principal building they shall comply with all yard requirements applicable to the principal building in the district. When the building is completed it will be stucco and brick. Landscaping is provided along 19th A venue, which consists of shrubbery and landscape lights. ORDINANCE: The Ordinance governing Industrial Zoning requires the Planning Commission review the landscape plan (page 162) and the exterior requirements (page 162). American Manufacturing has worked with the EDA Consultants before completing the plans. The plans appear to meet the Ordinance requirements. Facility Management Solutions, Inc. has been asked to represent American Manufacturing at this meeting, therefore I will be present. FMS © OOPYIIGRT 2002: PAco..m M1J«<>ENENT soumONS INDUSTRIAL ZONING REGUlATIONS b) Commercial activities directly relating to a product produced on site. · c) Commercial activities relating to production systems, structural maintenance programs or the construction industry. d) Service structures, public or private, designed and used to serve the uses in the surrounding area, such as electric power substation, telephone buildings, deep . wells, elevated tanks and similar structures and uses. e) When property within a Light Industrial District abuts County State Aid Highway 75: i) Motels ii) Gasoline service stations iii) Restaurant or supperc1ubs iv) Drive-in establishments v) Open sales or temporary rental lots Subd. 5: Lot Area Requirements. a) The lot area shall be the area ofthe recorded lot as filed with the Stearns County Auditor's Office. The lot area shall be identified by the developer and the Planning Commission shall determine the lot has sufficient area to allow the · construction and still conform with the requirements of this Ordinance. Subd. 6: Setback Requirements. Front Yard Setbacks: a) Front yard setback shall be thirty (30) feet from the lot line. On corner lots; the setback from all lot lines abutting a street shall be thirty (30) feet. When an industrial district lot is separated from a residential zone by a city street, the setback from the lot line shall be one hundred (100) feet. b) Front yard boarding upon any roadway: the setback shall be landscaped as in accordance to the requirements of any applicable protective covenants and such reasonable requirements as established by the Planning Commission, and shall not be used for parking. Side Yard Setbacks: a) Side yard setback shall be at least ten (10) feet from the lot line. b) A Light Industrial District side yard adjacent to a residential boundary line shall provide for a landscaped strip of at least sixty (60) feet in width along the lot · 161 boundary line. A portion of this landscaped strip shall be planted to provide a ¡ screen. The governing body may require additional side yard setback in these . cases. When such additional width is required, such additional width shall not exceed one hundred (l00) feet and paring in this area will be pennitted. c) Side yard boarding upon any roadway: the setback shall be landscaped in accordance with any applicable protective covenants and such reasonable requirements as established by the Planning Commission. Rear Yard Setback: a) Rear yard setback shall be at least twenty (20) feet, which may be used for parking. Subd. 7: Height Requirements. a) No building constructed in any Light Industrial District shall be more than fifty- five (55) feet in height. Subd. 8: Perfonnance Standards. a) Applicants for a pennit to develop any industrial property in the City of St. Joseph shall be required to submit a complete and accurate statement to the Planning \ Commission concerning the specific nature of the use to which the property is to -. ! be put. This statement shall include detailed infonnation relative to the control of smoke, odors, noise, vibrations or other impacts, as stated in Section 52.14 Subd. 19, which may be considered by the Planning Commission as detrimental to the health, safety, and general welfare. The Planning Commission may require any additional infonnation, corrections or control deemed necessary for the protection of the public. b) Before the issuance of a building permit, buildings constructed in the Light Industrial District must have a landscape plan approved by the Planning Commission. c) Before the issuance of a building permit, all buildings constructed, or undergoing exterior renovation or remodeling in the Light Industrial District must have the exterior finish design and materials approved by the Planning commission. Section 52.24: E E - EDUCATIONAL - ECCLESIASTICAL DISTRICT. Subd. 1: Intent. It is the intent of this district to provide for an area occupied by an educational and ecclesiastical institution. The institutions of the Order of Saint Benedict and the College of Saint Benedict predate the adoption of this Ordinance. In recognition of the historic significance and cultural, religious and educational function of these institutions. However, this ì . 162 . Northland Plat Six.............. REQUEST: Authorization conduct a preliminary plat hearing based on the proposed plat. The plat consists of 103 single family homes with 40 requiring a variance. ORDINANCE: In your packet please find a development schedule that is provided to all developers when initiating platting. The schedule lays out the process and timeline needed to complete each task. Northland Plat Six is at step three. If a public hearing is ordered the plans should be drafted with any changes of the Planning Commission. Their has been some discussion of developing Northland Plat Six as a PURD. However, according to the Ordinance a PURD is only applicable when mixed housing is involved. The proposed housing is solely single family therefore R! regulations apply. Ted is requesting a variance on 34 lots. The variance includes lot frontage and lot size. In reviewing the plat I noticed that an additional six lots do not meet the minimum square footage requirement. Therefore, the public hearing for the preliminary plat will include a variance for 40 lots. In determining a variance the Planning Commission must use the standards established on page 110. . ACTION REQUESTED: Ted is requesting authorization to schedule a public hearing for the preliminary plat and variance. The lead time for submittals shown below is necessary to allow City staff time to review and comment on the documents provided. Additiona11ead time wi11 be required if the City detennines that the potential impacts require more detailed study, or if review by other agencies is required. IÌ1complete submittals will be tabled unti1 all required information has been provided. For a straightforward plat that is not controversial, with minimal impacts, Subdividers should anow six months to complete the platting process. STANDARDS FOR GRANTING A VARIANCE Board, or the Council in reviewing the Board's decision, may prescribe appropriate conditions in conformity with this Ordinance to protect properties and the health and safety of persons residing ~ ., or working in the neighborhood. When such conditions are made part of the terms under which . the variance is granted, violation of the conditions is a violation of this Ordinance. A variance shall not be granted by the Board, or by the Council upon review, unless they find the following facts: a) That there are exceptional or extraordinary circumstances or conditions applying to the property in question as to the intended use of the property that do not apply generally to other properties in the same zoning district. The exceptional or extraordinary circumstances must not be the result of actions taken by the petitioner. -. b) That the literal interpretation of the provisions of this Ordinance would deprive the petitioner of rights commonly enjoyed by other properties in the same district under the terms of this Ordinance. c) That granting the variance requested will not confer on the applicant any special privilege that is denied by this Ordinance to other lands in the same district. d) That the proposed variance will not impair an adequate supply of light and air to adjacent property, or diminish or impair established property values within the surrounding area, or in any other respect impair the public health, safety or welfare . of the residents of the City. e) That the condition or situation of a specific piece of property, or the intended use of said property, for which the variance was sought, is not of so general or recurrent a nature as to make reasonably practicable the formulation of a general regulation for such conditions or a situation. Subd. 1: Procedure. Application for a variance or appeal under the provisions of this section shall be made to the Secretary of the Board of Appeals and Adjustments, in the form of a written application, called a Development Review Application. The Development Review Application must be submitted three weeks prior to a variance request. a) The Secretary of the Board of Appeals and Adjustment shall review all Development Review Applications and upon completion of the requirements of the application shaµ schedule a public hearing. The Secretary shall have ten (10) days to review the application for completeness. Notice of such hearing shall be mailed not less than ten (10) days nor more than thirty (30) days to property owners within 350 feet of the affected parcel as determined by the City Clerk. Such notice shall also be published in the official newspaper within the above time period. . Failure of a property owner to receive said notice shall not invalidate any such proceedings. . 110 11~ .1,.
