Adopt the findings as presented in the packet, recommending the Council issue an Interim Use Permit to
. Brandon Kappes to allow an owner occupied rental in a single family zoning district.
COMMENTS/RECOMMENDATIONS
The Rental Housing Inspector has reviewed the property and his report is included in your packet. If the
property is to be occupied by three persons, five parking spaces must be provided. Therefore, one more
space would be required.
For your convenience I have attached the proposed fIndings based on the recent Interim Use Permits
issued over the past months. Please feel free to make any modifications.

Resolution of finding ·
The request of Michael Bader for an Interim Use Permit request came before the Planning Commission
at a public hearing held on October 6, 200. The purpose of the hearing was to consider issuance of an
Interim Use Permit to allow an owner occupied rental unit in a R1 Zoning District.
The property is legally described as The Southerly 17 A feet of Lot 2 and the Northerly 30.2 feet of Lot 3,
in Block 1 Loso's Subdivision of Block 2 of Loso's First Addition Lot Thirteen, Park Terrace, according to
the plat and survey thereof on file and of record in the Office of the County Recorder in and for the County
of Stearns and State of Minnesota located at 32 - 2nd Avenue SE.
St. Joseph Code of Ordinances 52.27. subd 5 allows for an Interim Use permit as follows: Residential
rental provided the unit is owner occupied and provided the room (s) rented does not contain separate
kitchen facilities and is not intended for use as an independent residence. For purposes of establishing if
the property is owner occupied, the owner must be a natural person and the owner occupying the
property as his or her principal residence and must own a fifty percent (50%) or greater interest in the
property.
The request for Interim Use has been submitted by Brandon Kappes- 32 - 2nd Avenue SE St. Joseph MN
56374.
Notice of this matter was duly served and published.
In consideration of the information presented to the Planning Commission and its application to the
Comprehensive Plan and Ordinances of the City of St. Joseph, the Planning Commission makes the
following findings:
The proposed use is consistent with the standards for granting an Interim Use Permit, St. ·
Joseph Code of Ordinances 52:07.04
Therefore, based on the above findings, the Planning Commission makes the following recommendation:
Approval of the Interim Use Permit to allow an owner occupied rental unit in a R1 Zoning District with the
following contingencies:
1 . The rental license in non-transferable and if the property is sold or the ownership changes so
that the aforementioned no longer owns a 50% or greater interest in the property the Interim
Use Permit is null and void.
2. Approval of the Rental Housing Inspector
3. The Planning Commission will review the license annually and revoke the license if the
property is in violation of the St. Joseph Code of Ordinances.
4. The City Office will place a notice in the St. Joseph Newsleader when the owner occupied
rental licenses are reviewed and will accept public comments.

ADMINISTRATOR Ordinance No. 55.11 of the City of St. Joseph Code of Ordinances, requires that "no person shall operate
Judy Weyrens rental property in the City of St. Joseph without first having properly made and filed a registration statement
with the Compliance Official, and without first securing a valid rental license from the City of St. Joseph."
MAYOR The propertY, (of which you are listed as the owner of), located at 32 - 1st Ave SE, St. Joseph, Minnesota is
Larry J. Hosch reportedly being operated as arental property without a valid rental license from the City of St. Joseph, which
is in violation of Ordinance No. 55.11.

Subd. 2: Riqht of Appeal. When it is alleged by any person to whom a Compliance Order is directed that
such Compliance Order is based upon erroneous interpretation of this Ordinance, such person may appeaL
the Compliance Order to the Planning Commission sitting as a Board of Appeals. Such appeals must be in
. writing, must specify the grounds for the appeal, must be accompanied by a filing fee of $15.00 in cash or
cashier's check and must be filed with the City Clerk/Administrator within five (5) business days. The filing of
an appeal shall stay all proceedings in furtherance of the action appealed from, unless such a stay would
cause imminent ¡3eril of life, health or property.
Sub. 3: Board of Appeals Decision. Upon at least five (5) business days notice to the appellant of the time
and place for hearing the appeal, and within forty-five (45) days after said appeal is filed, the Board of
Appeals shall hold a heating thereon, taking into consideration any advice and recommendation from the
Compliance Official. The Board of Appeals may reverse, modify, or affirm, in whole or in part, the
Compliance Order and may order return of all or part Of the filing fee if the appeal is upheld.

The Subdivision Ordinance allows for lot splits provided that non conforming lots are not created. The
proposed lot split meets the minimum requirements of the Zoning District. The property is being split to
allow the construction of an insurance office building. Marcus Marsh is part of the insurance company
who will be requested a site plan review later this year. He will be present at the meeting if you have any
questions.

I have contacted DM Building about the side yard setback and lighting plan. We will have additional
information at the meeting and bring the plan into conformance with the Ordinance. Attached with your
packet is the information received from the Department Heads.
Attached in the packet is a sample development agreement. The agreement should include a concrete
apron from I 9th A venue and a requirement that the rear yard be seeded and maintained according to the
Ordinance.

CITY OF ST. JOSEPH
DEVELOPER AGREEMENT
THIS AGREEMENT, made and entered into this _ day of May, 2003, by and between ,
hereinafter called "Developer", and the City of St. Joseph, Minnesota, a municipal corporation, hereinafter
. called the "City".

WHEREAS, the Developer is the owner of certain real property located within the City limits which is legally
described as , according to the plat thereof on file with the Stearns County, Minnesota
Recorder (the "Property"); and
WHEREAS, the Developer has submitted to the City for approval the plans and drawings listed on Exhibit A
attached hereto ("Development Plan"), which describes the construction project and related facilities
("Project") the Developer proposes to construct on the Property; and
WHEREAS, the City's Code of Ordinances allows the City to require a Development Agreement to provide
for inspection and review during the construction of the Project;
NOW, THEREFORE, in consideration of the mutual covenants expressed herein, IT IS HEREBY AGREED
AS FOLLOWS:
1.0 REQUEST FOR AND CONDITIONS OF DEVELOPMENT PLAN APPROVAL·
1.1 Request for Development Plan Approval. The Developer has asked the City to grant final
. approval of the Development Plan for the Project to be constructed on the Property.
1.2 Conditions of Development Plan approval. The City, after requisite notice and hearing, has .
granted final approval of the Development Plan subject to the tenns and conditions ofthis Agreement.
1.3 Scope of Agreement. This Agreement, and the tel111S and conditions hereof, apply only to the
Project. This Agreement does not obligate Developer to construct the Project, but Developer must comply
with the Agreement if it goes forward with the Project. If Developer elects or is unable to go forward with the
Project, or chooses not to rebuild the Project after a fire or casualty, it may propose to the City a new project
or development for the Property, subject to the regulations then in effect for development approvals, and the
Agreement shall not apply in any manner to such new proposal.
2.0 RIGHT TO PROCEED
The Developer may not grade or otherwise disturb the earth, remove trees, construct sewer lines, water
lines, streets, utilities, public or private improvements, or any buildings, until all the following conditions have
been satisfied: (1) this Agreement has been fully executed by both parties and filed with the City
Administrator; (2) the escrow required in section 3.12 to secure perfonnance ofthe Developer's landscaping
and playground equipment obligations has been received by the City; (3) the City has issued a letter that all
conditions have been satisfied and that the Developer may proceed, which letter will not be unreasonably
withheld or delayed.
3.0 DEVELOPER CONSTRUCTED IMPROVEMENTS
3.1 DEVELOPMENT PLAN COMPLIANCE: All buildings and accessory structures shall be .
sited and constructed on the Property as shown on the Final Site Conditions Plan A prepared
by , dated (referred to in Exhibit A), subject to the
provisions of this agreement. Any deviations from the Final Site Conditions Plan A shall
require prior approval by the City Planning Commission.
3.2 UNITS APPROVED: N/A
3.3 BUILDING CODE COMPLIANCE. All buildings and accessory structures shall be
constructed in accordance with the Minnesota State Building Code as adopted and modified
by the St. Joseph City Code.
3.4 SITE PREPARATION: The Developer shall comply with any erosion control method
ordered by the City for the prevention of damage to adjacent property and the control of
surface water runoff. As the development progresses, the City may impose additional
erosion control requirements if in the opinion of the City Engineer such requirements are
necessary.
3.5 BUILDING ELEVATION: The proposed building(s) will not exceed the building elevations
shown on the Development Plan.

3.7 INGRESS/EGRESS: Vehicular access to the Property shall be constructed as shown on the
Final Site Conditions Plan A, dated , referred to in Exhibit A.
3.8 SIGNAGE: The building will have a sign of not more than 50 square feet, which shall not be
located in the right of way.
3.9 LIGHTING:
3.10 OFF STREET PARKING AND LOADING: The Developer shall provide at least_ off
street parking spaces, including _ handicapped spaces and loading area( s), as shown on the
Development Plan. The parking lot shall be constructed with a hard surface consisting of
asphalt or a similar surface material approved by the City Engineer.
3.11 GRADING/DRAINAGE:
3.12 LANDSCAPING/FENCING/SCREENING: As directed by the landscape design, the
. Property will have a minimum of _ trees and _shrubs. The vegetation shall be planted
as shown on the landscape design. All lawn sodding and other landscaping shall be
substantially complete by the "Completion Date" (See Sec. 3.20). ~eveloper shall post
$ in escrow with the City to ensure compliance with the landscape design
requirements under this Section The escrowed funds shall be released to Developer when
the landscaping have been installed. The HV AC equipment, dumpsters and off-street parking
shall be screened from view as shown on the Development Plan. The City may inspect the
Project to ensure that all required vegetation, fencing and screening are installed.
3.13 FIRE HYDRANT/FIRE LANE: As shown on the Development Plan.
3.14 UTILITY PLAN: As shown on the Development Plan.
3.15 ADDITIONAL IMPROVEMENTS:
3.16 NPDES/CITY OF ST. JOSEPH SWPPP:
3.17 FIRE/SAFETY REQUIREMENTS: Project must be constructed to comply with City Code
and statutory requirements.
3.18 REQUIREMENTS FOR BUILDING PERMIT: No building pennit shall be issued for this
Property until the Developer has signed and returned this Development Agreement, obtained

any necessary easements and provided the City with a copy of the easement documents, and .
submitted any additional information as directed by the City Engineer.
3.19 REQUIREMENTS FOR CER TIFICA TE OF OCCUPANCY: Per State and City building
codes.
3.20 CONSTRUCTION SCHEDULE: The Developer shall apply for a building permit within
one year of the execution ofthis agreement. Failure to apply within the one year period, shall
render this agreement null and void. The improvements shall be substantially completed by
the first (l st) anniversary of the date the building permit for the Project has been issued to
Developer, and no later than the second anniversary of the execution of this agreement,
subject to reasonable extension for delays due to force majuere causes and material supply
shortages beyond the control of Developer (the "Completion Date").
4.0 GENERAL TERMS AND CONDITIONS
4.1 Title. The Developer hereby warrants and represents to the City, that Developer's interest in
the Development is fee owner.
4.2 Binding Effect on Parties and Successors. The terms and provisions ofthis Agreement shall
be binding upon and accrue to the benefit of the heirs, representatives, successors and assigns
of the parties hereto and shall be binding upon all future owners of all or any part of the .
Development and shall be deemed covenants running with the land. Reference herein to
Developer, if there be more than one, shall mean each and all of them. This Agreement, at
the option of the City, shall be placed on record so as to give notice hereof to subsequent
purchasers and encumbrances of all or any part of the Property and/or Project and all
recording fees shall be paid by the Developer. If the Property and Project are sold or
conveyed to a third party, and the third party, in a writing satisfactory to the City, takes an
assignment of, and agrees to assume the obligations ofthe Developer under, this Agreement,
the prior owner/transferor will, from and after the effective date of the assignment and
assumption, be released from any further obligations under this Agreement; provided
however, that in no event will Summit Management, LLC be released from its obligations
under this Agreement prior to the City's issuance of a certificate of occupancy for the Proj ecL
4.3 Notice. Any notices permitted or required to be given or made pursuant to this Agreement
shall be delivered personally or mailed by United States mail to the addresses set forth in this
paragraph, by certified or registered mail. Such notices, demand or payment shall be deemed
timely given or made when delivered personally or deposited in the United States mail in
accordance with the above. Addresses of the parties hereto are as follows:

4.4 Incorporation of Documents by Reference. All of the Development Plan documents
identified in attached Exhibit A are incorporated by reference in this Agreement.
4.5 License to Enter Land. The Developer hereby grants the City, its agents, employees, officers
and contractors a license to enter the Property to perform inspections deemed appropriate by
the City during the development of the Property.

4.6 Certificate of Compliance. This Agreement shall remain in effect until such time as
Developer shall have fully performed all of its duties and obligations under this Agreement.
Upon the written request ofthe Developer and upon the adoption of a resolution by the City
Council finding that the Developer has fully complied with all the terms of this Agreement
and finding that the Developer has completed performance of all Developer's duties
mandated by this Agreement, the City shall issue to the Developer on behalf of the City an
appropriate certificate of compliance. The Certificate of Compliance shall be in recordable
form and shall constitute prima facie evidence that the Developer has performed its duties
and obligations under this Agreement.
4.7 Assignment. At any time before a Certificate of Compliance has been issued, this Agreement
may not be assigned by Developer except upon obtaining the express written consent of the
· City.
4.8 Integration. This Agreement contains all ofthe understandings and agreeme1!ts between the
parties. This Agreement may not be amended, -changed, or modified without the express,
written consent of the parties hereto.
4.9 Execution in Counterparts. This Agreement may be executed in any number of counterparts,
each of which shall constitute one and the same instrument.
4.10 Governed by Minnesota Law. This Agreement shall be interpreted under the laws of the
State of Minnesota.
4.11 Representation. Rajkowski Hansmeier Ltd. represents the City with regard to this
Agreement. Developer is hereby advised to seek, and has consulted, an independent legal
advisor prior to execution of this Agreement.
4.12 Additional Terms. The following additional terms are being made a part of this
Development Agreement to continue in force and effect as though they were dedications of
the Development Plan, unless according to their terms are intended to terminate earlier: Not
Applicable.
5.0 DEFAULT AND REMEDIES

5.1 Default. Failure by the Developer to observe and perform any covenant, condition, or .
obligation contained in this Agreement shall be considered a default by the Developer under
the Agreement.
5.2 Right to Cure. The City shall give the Developer written notice of any default under this
Agreement. The Developer shall have 10 days in which to cure the default (or in which to
commence good faith efforts to cure if the default is one which cannot reasonably be cured in
10 days).
5.3 Remedies. If an event of default is not cured by the Developer within the applicable cure
period, the City may do any, all or any combination of the following:
(a) halt all further approvals regarding improvements or issuance ofbuilding permits or
occupancy permits relating to the Development Property;
(b) seek injunctive relief;
(c) take any other action at law or in equity which may be available to the City.

PREVIOUS ACTION
The Planning Commission approved a building permit request in 2002 with three contingencies. As
stated in the memo from Rand Schaper they are still working on the landscaping portion of the first
building pennit.
RECOMMENDED PLANNING COMMISSION ACTION
.- Approve the site plan provided that the exterior requirements meet the Ordinance
COMMENTS/RECOMMENDATIONS
Since the addition to American Manufacturing, the Ordinance has changed regarding exterior
requirements. Currently if a post frame building is constructed a perimeter footing must be included. The
plans as presented do not satisfY the requirement and the owner representative will be asking for relief
from this requirement. Unless the Planning Commission determines the addition differently if the
exterior requirements are not satisfied the property owner can apply for a variance.

Chair Utsch stated that the purpose ofthe meeting is to review the site plan of American Manufacturing. The
Planning Commission considered the matter on April!, 2002 and requested the property owner revise the plans to
include landscaping (around surrounding the parking lot), a parking lot plan to include number of parking spaces,
type of material, lighting plan and proposed signage.
Rand Schaefer representing American Manufacturing presented the Planning Commission with revised plans to
allow for the construction of an addition to American Manufacturing. The addition is proposed to be 4054 square
feet. The revised plan includes the following:
Parking Spaces - Required 13, provided 19
Landscaping - The area surrounding the parking lot will be seeded and landscaping will be provided along
the new entrance.
Parking Lot - Crushed rock (class 2)
Lighting Plan - Provided for the lighting of the parking lot
Signage - The building will include a wall sign that will meet the requirements of the Ordinance.
Deutz made a motion authorizing Rand Schaefer on behalf of American Manufacturing to make application
for a building permit based on the site plan submitted. Authorization is contingent upon the following:
1. Landscaping be completed before the certificate of occupancy is issued. Landscaping .
includes shrubbery around the front of the building and grass around the parking lot.
2. The parking lot will be crushed rock (class 2)
3. The Planning Commission strongly encourages the property owner to repair the existiIlg
retaining wall and paint the existing structure to match the new addition.
The motion was seconded by Lesnick and passed unanimously by those present.

AMERICAN MANUFACTURING
Cold Storage Expansion - 2003
PROJECT NARRATIVE
American Manufacturing requests that the City of St. Joseph allow an expansion onto the
rear of their existing facility. The proposed size of the expansion is approximately 20'x117'
or 2340 sq. ft. in area. The expansion will be built out of a post and frame wood structure
with pre-ímished steel panels to match the rear of the 2003 expansion.
The use of the proposed unheated storage area expansion is for additional space to be used
for the storage and staging of steel materials used in the manufacture of metal products. This
is a permitted use in Ordinance 52.33.i.
In addition to the proposed expansion, the retaining walls at the front of the existing
building are being removed as previously agreed. This work was being held off until it was
determined where the proposed expansion would be located.
The owner wishes to commence construction as soon as possible, and the completion date
for constructing the expansion has been set for mid November 2003. We thank the Planning .
Commission in advance for their cooperation in allowing this much needed space to be added
to this facility.

ORDINANCE 52.33: LI-LIGHT INDUSTRIAL DISTRICT.
Subd. 1: Intent. The Light Industrial District provides space for industrial activities
involving a minimum degree of refuse byproducts and air or noise pollution, and requiring a
relatively low level of on-premise processing. These activities may include secondary
commercial functions which are conducted on site.
Subd. 2: Permitted Uses. The following use shall be permitted within the LI-Light
Industrial District:
a) Assembly plants and manufacturing enterprises of a wide variety of products that
do not cause noxious odors or noise, including excessive users of water and
sewer. Examples of such uses include: fabrication or assembly of small products
such as opticals, electronics, pharmaceuticals, medical supplies and small
equipment.
b) Publishing establishments.
. c) Clothing or apparel manufacturing or assembly.
d) Business incubator facilities.
e) Bottling establishments.
£) Dry cleaning and drying establishments.
g) Manufacturing/assembly of crates, boxes, baskets,fumiture, veneer,
cabinets and similar word items.
h) Building materials sales and storage/ lumberyards.
i) Manufacturing of plastic, fiberglass and metal products.
j) Mini -storage.
k) Major automotive repair.
1) Offices/showroom/retail space as a portion of the principal industrial use provided
they do not exceed a combined 25 percent of the total square footage of the
principal use.
. m) Appliance assembly and warehousing.

n) Industrial research laboratories. .
0) Manufacturing of small electrical parts and service.
p) Newspaper and printing plants.
q) Telecommunication facilities, base stations.
r) Telemarketing and mail order establishments.
s) Warehousing, of non-explosive material and equipment within the structure.
t) Wholesale or distributor storage and distribution of non-hazardous materials.

u) Wholesale water conditioning systems.
v) Uses determined to be of a similar nature as those contained in this section upon a
finding that the uses will not be detrimental to the health, safety and welfare of the
City, and that the use is consistent with the stated intent of the zone as contained
in Subd. 1.
Subd. 3: Pennitted Accessory Uses. The following uses shall be pennitted as an
Accessory Use in the Light Industrial District and subject to the all the requirements in this .
Section:
a) Restaurant, lunch counters, confectioneries to serve the employees employed
within the District.
b) Residential structures and related residential uses necessary for security and safety
reasons in relation to the principal use.
c) Off-street parking and off-street loading.
d) Outdoor storage as regulated in Section 52.12, Subd. 12.
e) Office accessory to the principal use.
£) Business identification signs as regulated in Subd. 11.
g) Temporary buildings for construction purposes for a period not to exceed a period
of 12 months.
Subd. 4: Uses Under Special Use Pennit. The following uses shall require a Special Use
Pennit based on the procedures set forth in this Ordinance.

. a) Side yard setback shall be at least twenty-five (25) feet from the lot line.
b) A Light Industrial District side yard adjacent to a residential boundary line shall
provide for a landscaped strip of at least sixty (60) feet in width along the lot
boundary line. A portion of this landscaped strip shall be planted to provide a
screen. The governing body may require additional side yard setback in these
cases. When such additional width is required, such additional width shall not
exceed one hundred (100) feet and paring in this area will be permitted.
c) Side yard boarding upon any roadway: the setback shall be landscaped in
accordance with any applicable protective covenants and such reasonable
requirements as established by the Planning Commission.
Rear Yard Setback.
a) Rear yard setback shall be at least twenty (20) feet, which may be used for
parking.
Subd. 7: Height Requirements.
a) No building constructed in any Light Industrial District shall be more than fifty-
five (55) feet in height. Berming the building does not allow a building to be
. constructed higher than 55 feet. Elevation for the building shall be determined by
the average grade of the land.
Subd. 8: Site Coverage. No structure or combination of structures shall occupy-more
than 50 percent of the lot area.
Subd. 9: Other Requirements.
a) Parking Lots. All parking lots shall conform to the standards set forth in Section
52.10. All lots shall include parking controls and other landscaping techniques to
improve their aesthetic quality and to direct the flow of traffic.
b) Loading Docks. All loading docks shall conform to the standards set forth in
Section 52.10. No loading docks or overhead doors shall directly face County
State Aid Highway 75.
c) Building Exteriors. All construction of new facilities shall consist of pre-cast or
cast tip up concrete walls, concrete block (painted or decorative), post frame/steel
frame with a concrete block or poured concrete complete perimeter foundation
with frost footings extending a minimum of eight inches (8") above the final
grade, and stick built construction. Pre-finished architectural metal panels, with a
minimum twenty (20) year manufacturer color-fast warranty, may be used as a
. construction material. A minimum of twenty-five (25%) of the exterior building
finish directly facing streets shall consist of materials comparable to: face brick;

natural stone or cultured rock; glass; vinyl; stucco, aluminum lap siding; cut block; ·
and, concrete block (the surface must be treated with an applied decorative texture
or material). Pre-cast or cast in place concrete buildings shall provide as much
adornment as is possible considering their exterior finish limitations.
d) Every applicant for a permit develop or expand any industrial property in the City
shall be required to submit a complete and accurate statement concerning the
specific nature of the use to which the property is to be put and shall certify that
the proposed use shall comply with all regulations, ordinances, or special
provisions which may apply.
e) The Planning Commission shall have the right to require any additional
information, corrections, or control, deemed necessary for the protection of the
public. The Planning Commission shall have the right to hire expert consultants,
at the permittees' expense, to assist in the establishment of special restrictions for
any Industrial Use.
£) Every applicant shall be required to submit for approval of the Planning
Commission a landscape plan providing for the planting of trees and other
vegetation.
g) Any use creating periodic earthshaking vibration shall be prohibited if undue
vibrations are perceptible beyond boundaries of the property on which the use is ·
located. This standard shall not apply to vibrations created during the process of
construction.
h) Any use requiring the storage, utilization or manufacture of products which could
decompose by detonation shall be located not less than 400 feet ftom any
residence. This section shall not apply to the storage or usage of liquid petroleum,
natural gas for normal residential or business use providing other performance
standards are met.
i) All activities that emit radioactivity shall comply with the minimum requirements
of the Federal regulatory body.
j) All uses associated with bulk storage of oil, gasoline, liquid fertilizer, chemicals,
similar liquids and hazardous substances shall comply with the requirements of
the Minnesota State Fire Marshall, the Minnesota Department of Agriculture and
other hazardous substance legislation by the Federal government. The user of
such material shall have documents ftom the above offices that the use is in
compliance. All existing above ground liquid storage tanks with a capacity of
2,000 gallons or more, shall comply with the requirements of the Minnesota State
Fire Marshall's office within 12 months following enactment of this Ordinance.
k) Screening. All heating, ventilation and air conditioning equipment, and refuse
storage areas shall be screened and in a suitable location as determined by the ·

· Planning Commission.
1) Lighting. All lighting shall be hooded and no light may directly strike any
streetlhighway or areas outside of the development.
m) Stops and Curbs. Concrete curb to B-612 specifications shall be used for all
automobile stops and for all drive and parking areas.
n) Landscaping. In addition to requirements relating to parking lots, the
Development Plan shall show a unified landscaping scheme for the development.
0) Signs. All proposed business signs shall be an element of the Development Plan.
All signs shall confonn to the requirements of Subd. 11.
p) A Lock Box shall be installed on all buildings before a certificate of occupancy
will be issued.
Subd. 10: Development Plan Requirements. No building pennit shall be issued until the
Planning Commission reviews the development plan to detennine that the use and development
is compatible with adjacent land uses, and consistent with the stated intent of this zone. Upon the
request of the Planning Commission the City Council will make the final detennination on site
plan approval. The developer shall provide the following items to the Planning Commission and
· City Council for any development located in the LI - Light Industrial District:
a) Building location on the lot, drawn to scale.
b) Building elevations;rront, rear and side.
c) Building exterior materials and color.
d) Locations of ingress and egress points.
e) Dumpster and solid waste pick-up areas and proposed screening material.
f) Sign location and dimensions.
g) Lighting standard and hood detail.
h) Parking and loading areas identified.
i) Drainage by the use of arrows and/or contours.
j) Screening of heating, ventilation and air-conditioning equipment.
k) Landscaping material including the location, type of plant and size.

1) Fire hydrant and fire lane locations. ·
m) Utility locations.
n) Any other fencing, screening, or building accessories to be located in the
development area.
0) When required, evidence of completion of National Pollutant Discharge
Elimination System (NPDES) permitting program and/or the City of St. Joseph
Storm Water Pollution Prevention Program (SWPPP).
p) If applicable, evidence of compliance with federal, state and local pollution and
nuisance laws and regulations, including, but not limited to glare, smoke, dust,
odors and noise. The burden of proof for compliance with appropriate standards
shall lie with the applicant.
q) Required Feel Agreement.
1. Payment Required. Any person filing a petition requesting development
plan review shall pay a fee according to the schedule established by the
City Council.
2. Amount. Fees payable under this section for development plan review ·
shall be in an amount as established by resolution of the City Council.
Preparation and review of all elements of the required development plan,
as listed and described above, is to be at the sole expense of the developer
and at no expense to the public. The fee is payable atthe time of filing a
petition and is not refundable. In addition to the above fees and in the
event the City incurs professional fees, either legal, engineering or
professional planners, or any other cost, including but not limited to,
postage and publication expenses, the applicants shall reimburse the City
for those fees, and the City officials may require an escrow deposit,
cashier's check or letter of credit for these fees prior to the final action on
the application for development plan review. Such escrow or letter of
credit shall be in the form approved by the City Attorney.
3. Development Agreement. In the event additional review by the City or its
assigns is anticipated and/or needed during implementation of
Development Plan, or other similar circumstance, the City shall require the
property owner(s) and/or developer(s) enter into a development agreement
with the City. The development agreement shall stipulate the conditions
for approval and the City's authority to inspect the development. The
agreement shall further require the owner or developer, as the case may
require, furnish a cashier's check, escrow account or irrevocable letter of
credit in favor of the City in an amount equal to II 0% of all costs
associated with City's review of the development, including but not ·

· limited to, engineering, legal, fiscal and administrative, as estimated by the
City. Such escrow or letter of credit shall be in the fonn approved by the
City Attorney, shall be conditioned upon the approval of the development
plan.
Subd. 11: ~. In theL-I Light Industrial district the general provisions apply to all
SIgnS.
a) Special and Temporary Signs.
1. One (1) identification sign not exceeding thirty-five (35) square feet in
area for the following uses: church, school, or similar uses. Such signs
shall be solely for the name and of the use and its activities and may be
illuminated but not flashing.
2. Temporary signs advertising a new subdivision development limited to the
following: (1) maximum size shall be thirty-two (32) square feet in
surface area, (2) maximum height of fifteen (15) feet above ground level.
3. Real estate signs, including signs advertising the sale or rental of premises,
are pennitted provided the area on one side of any such signs shall not
exceed six (6) square feet.
· 4. Temporary signs of contractors, architects, mechanics, special events and
artisans are pennitted, provided that such signs shall be removed promptly
upon completion ofthe work and further provided that such signs shall noC
exceed thirty-two (32) square feet in area.
b) Portable Signs.
1. Definition. A portable sign is one that is movable from one location to
another and is not pennanently affixed to the ground, sales display device,
or structure.
2. Pennit Required. A business seeking to use or display a portable sign
shall obtain a pennit from the City for the period of display. Pennits will
specify the length of time the sign will be displayed, location of the sign,
and business applying to use the sign.
3. Length of Use. The duration of time a portable sign can be located on a
property is limited to a maximum of forty (40) days in anyone calendar
year.
4. Size. A portable sign shall not exceed 50 square feet which accounts for
all letters, numbers and attachments; excluding material required to
· support the sign.

c) Business or Commercial Signs .
1. Signs shall have a surface area not exceeding one hundred (100) square
feet per sign with an aggregate total not to exceed two hundred (200)
square feet if double faced.
2. Such sign except a directional sign, is erected only on the premises on
which the use, to which the sign relates, is conducted.
3. Notwithstanding the above, where two or more separate and individual
commercial operations are conducting business in separate areas of a
single building or structure, in which each operation owns or leases
separate and individual premises, but share in the use and maintenance of
common areas within or around the structure, then and in those
circumstances, each individual business operation may be pennitted to
display an individual business sign as provided in subdivisions a) and b),
except that said sign must be directly attached to that particular premises
actually occupied by the business operation to which the sign relates. In
addition to these individual business signs, the combination of business
operations occupying the structure, may maintain a 50 square foot sign
detached from the structure identifying the structure, the individual
business operations located therein, or other reference to the combination .
of business operations located within the structure. For purposes of this
subdivision, a combination of two or more business operations within a
single structure includes, but is not limited to, shopping--eenters, shopping
malls, and subdivided retail, office or industrial buildings offered for lease
or condominium ownership.
d) Advertising or pylon signs shall not be pennitted.
e) Sign Removal. All signs not maintained and kept in good repair shall be subject
to removal upon direction of the City Building Inspector.
Subd. 12: Regulation of Activities Adiacent to Wetlands.
a) The following activity shall be subject to a 50 foot setback from wetlands:
The construction or maintenance of a building attached to a foundation,
including but not limited to, pole buildings. For purposes of this
paragraph, pump houses, moveable storage sheds, recreational docks and
stonn water or erosion control devices shall not be considered buildings.
b) The following activity shall be subject to a 75 foot setback from wetlands:
The construction or maintenance of paved driveways or areas designed for
the parking of a vehicle or trailer.

· c) The following activities shall be subject to a 100 foot setback from
. wetlands:
1. The construction or maintenance of a well used for agricultural
irrigation, or any well less than 50 feet in depth.
2. External storage of materials used in conjunction with industrial or
commercial processing or manufacturing.
3. The storage of waste or refuse generated by industrial or
commercial activities.
4. The construction or maintenance of a septic system.
