Pursuant to due call and notice thereo:f, the City Council :for the City I
o:f St. Joseph met in regular session on Thursday, October 7, 1993 at
'/:00 p. m. in the St. Joseph City Hall.
Members Present: Mayor Donald "Bud" Reber. Councilors Stephanie Hazen,
Hoss Hieke, Bob Loso (arriving at 8:55 p. m. ). Deputy Clerk Judy
Weyrens.

Approval o:f Aqenda: Hazen made a motion to approve the agenda with the
addition of ( j ) Bruce Ostendorf, under Old Business. The motion was
seconded by Hieke.

Approval of Minutes: The approval of the minutes :from the September 15,
September 16, and September 21, 1993 City Council meetings was tabled
to the October 21, 1993 City Council Meeting.
Bills Payable: A:fter reviewing the bills payable, Hazen made a motion I
-Lo request the City Building Inspector, Ron Euteneuer, to submit a
quarterly report, indicating contacts he has had, and building permits
issued. The motion was seconded by Rieke.
Ayes: Heber, Hieke, Hazen.
Nayes: None. Motion Carried 3:0:0
Hazen made a motion to approve the bills payable as presented, check
:it's 18763 through 18881 , with the exception o:f Check #18800, which is
to held until the roof is repaired to the City's satisfaction. The
motion was seconded by Hieke.

MAYUH HEPUHTS
Vendinq Machine Request: Mayor Reber has been requested by the Police
Department to allow a food vending machine to be placed in the City
Hall entry. Hazen made a motion to allow the placement of a food
vending machine between the City Council Chambers and the Police
Department. The motion was seconded by Reber.
Ayes: Heber, Rieke, Hazen.

Street Liqhtinq Request: The status o:f the street lighting study was I
questioned. Requests for street lighting have been received by the
City Offices for residents living near tlth Avenue NW. Rieke questioned
if the matter should be referred to the Police Department. A:fter
discussion, the Council agreed to refer this matter to the utility
companies, providing the City with an opinion. All the residents
submitting requests for a street light on 5th Avenue NW and those in
-Lhe newly annexed areas will be noti:fied that the matter is being

Street NUf(lberinq Pr..Q.QosaJ...L I'layor Reber commended O£:ficer Brad Meyer :for
the comprehensive street numbering proposal the Council received.
Hazen made a motion to send a letter of commendation to O:f:ficer Meyer
for his efforts.
Parkinq Lot: Mayor Reber questioned the status o:f the City Hall Annex
parking lot. Deputy Clerk Judy Weyrens stated that the City Engineer
will be discussing this during his report.
CUUHCILOk REPORTS

Parkin~ Concern: Councilor Rieke stated that he received a call :from
JH Studniski on the recent parking changes by his property located on
2nd Avenue NW. Hieke informed those present that he did contact the
City E:ngineer, Joe Bettendorf, and he will be discussing this matter
during his report.
HAZEN
Meeti~ Materials: Hazen discussed the importance of having reference
material at the Council meetings. By having the League Handbook and
City Urdinance Book present at all meetings, the Council could
reference the materials to facilitate the decision making process.
Hazen made a motion to have the Clerk/Administrator bring to each
meeting the League Handbook and the City Ordinance Book. The motion
was seconded by Heber.
Discussion: Councilor Rieke reiterated the need to have a lap top
computer at each meeting to also provide the resource
of the City Council minutes.

Hazen stated that Councilor Hiemenz indicated that the City Offices
have a policy book, where after the Council adopts a policy it is
placed for reference. Council agreed to have the Clerk/Administrator
check into the policy handbook and the status.
Jo~_ pescriptions: Hazen discussed the status of the Job Descriptions as
dra:fted in 1991. When the personnel committee received the
evaluations, they noticed that some employees were using the old
descriptions and some were using the new. Hazen requested the
Clerk/Administrator to check into the status of the job descriptions,
and if they were not formally adopted, they should be brought before
the Council for adoption and distribution.
Volunteer Committee Work: Hazen stated that one day when she and
Councilor Hiemenz were in the City Offices, they noticed the Secretary
was completing the thank you cards for the Core Committee. Both she

and Hiemenz felt that since Core is a volunteer committee, and the City
LJffices are very busy, that the time could have been bet tel~ utilized.
Hookup Fees: In reviewing the past minutes, Hazen noticed the City has
not yet finalized the hookup fees for DBL and the Linnemann Inn. Hazen
:r~equested that this be placed under Old Business until they are
determined.
hetter 0:(. Commendation: Councilor Hazen discussed with the Council the
outstanding work of the City Engineering Department. Hazen made a
motion to send a letter of commendation to City Engineer- Joe
!:let tendorf, b:ngineering Inspectors Jerry George and Jeff Evans. The
motion was seconded by Hieke.

PERbUNNEL PULICY CUMMITTEE REPOHTS
Duties of Personnel Committee: Tabled to October 14, 1993.
Council Aqenda Suqqestions: The Council discussed the Standard
Oper-ating Pr-ocedure for agendas that was enclosed in the Council
packets. Those present discussed the need for Leo Sadlo to receive a
full council packet. While it is important for 11r. Sadlo to receive
information that is necessary for his services, he wouldn't need to
receive all the information. Hazen made a motion to discontinue
sending Mr. Sadlo all the packet information, unless he requests to
receive such information. The motion was seconded by Reber.

Hazen made a motion to adopt the Council Agenda procedures as developed
and recommended by the personnel committee. The motion was seconded by
Hieke.

Agenda Policy
1- The final agenda will be prepared the Friday before the regularly
scheduled meetings. No additions or other matters accepted after
Thursday, unless the Council makes an exception by unanimous vote for
matters of urgency. (ie: b:mergency, crisis)
2. All written materials that require action the night of the meeting
shall be included in Mayor/Councilor packets which are sent out four
days before the meeting. This will help allow for proper preparation
on the subject. Any items handed out that night of the meeting would
not be acted on that night and would be laid over to the next meeting.
(!::;xceptions would include bills payable)
3. All items, other than routine (standard) items on the agenda, will
have a brief explanation, reason, or clarification as to why it's on
the agenda. This will be part of the Clerks written detail report to

the agenda.
4. Agenda's are posted and distributed to councilors four days
(Monday) before the regular scheduled Thursday meetings.
5. The Clerk/Adm report to :follow councilor reports instead of at the
end of the meeting. This report would include all actions requested
:from the previous meeting. Just give the date when an action was taken
or completed unless council asked :for copies o:f letters and memos.
b. Department Heads reports will be given :following the Clerk/Adm
report. Have only two department heads report per regular meeting
unless there is a need :for more.
'/ . Could have a miscellaneous or announcements item at the end o:f the
agenda so Clerk or Council can capture all last minute items.
8. Assure the Planning/Zoning, Parks, Personnel and Core items are
referred to the respective committee :for review and or recommendation
and brought back to council table :for consideration.
The Council concurred that the department head reports are very
important and should not be placed at the end o:f the agenda. Usually
-Lhe reports at the end o:f the meeting are abbreviated or cut short.
Therefore, effective October 7, 1993, the Clerk/Adm Reports will
immediately follow the Council Heports.
CLERK I ADKIIUSTRA TOR REPORTS
Annexation petition request: John & Yvonne Lieser are requesting
annexation to receive municipal utility services. The Township has
already agree to and signed the annexation agreement. Reber made a
motion accepting the petition of John & Yvonne Liesor and approving the
following properties to be annexed to the City o:f St. Joseph.
Parcel !..L Parcel No. 31-20786-000 (Janice Mensinger)
Parcel 2: Parcel No. 31-21413-000 (Ben Hollermann)
Parcel 3: Parcel No. 31-21359-000 (John & Yvonne Liesor)

The petitions for annexation :for parcels 1 & 2 were accepted at a
previous meeting.
Kern. DeWenter, Vierre Aqreement: The auditors have sent a letter o:f
intent for the audit o:f 1994. The Council accepted the report and
terms of the letter.
ADA Telecon:ference: The Minnesota Department o:f Employee Relations is
sponsoring a seminar on Understanding the Americans with Disability
Act. The seminar will be held on October 28, 1993 at the Stearns
County Courthouse. Hazen made a motion to send the City Clerk/Adm to

the conference and authorize the expenditure of $20.00. The motion was
seconded by Reber.

Noise Complaint: The City Offices were notified of a 1st Violation of
the St. Joseph Noise Ordinance for the property located at 320 Old
Highway 52.
ULO BUSINESS
P~rsonne.:!... Poli"'pY:__ Hazen stated that the personnel policy has been
completed and reviewed by the City Attorney. With the approval of the
City AttorneYt Hazen made a motion to approve and adopt the personnel
pCJlicy. The policy should be copied and distributed to all the
employees and Council Members. The motion was seconded by Reber.

Plumbinq/Heatinq Inspector: The Council questioned the status and if
ì1r. !::uteneuer has responded. Hazen made a motion to send a second
letter of request to Mr. Euteneuert requesting a written job
description for the position. The motion was seconded by Reber.

W?ter Aqreement: The agreement has been app:coved and is waiting
execution by St. Benedict. This item is to be removed from Uld
Business.
CSB ProRerty Offer: No new information available.
Street Numberinq Proposal: Bl-ad r1eyer, St. Joseph Police Officel-,
discussed a proposal to assign street house numbers to the recently
annexed property. Meyer also stated that he has reviewed all the
flumbering and has some changes. When the new developments were
assigned street namest two of the streets, Elm & Dalet where not
aligned properly. He is requesting for these streets to be renamed.
ì1eyer also requested the City consider adopting an Ordinance requiring
all property owners to post clearly the street address on the front of
theÜ~ home. The Council thanked Officer Meyer for his repo:ct and
tabled the matter until Uctober 21t 1993. AdditionallYt the Council
requested that the City Attorney, John Scherer, be contacted and asked
for' his upinion and suggestion on this matter. Mr. Scherer should also
provide the City with some guidance as to the procedure for changing
address and street names, and how to educate and inform the residents.

Daryl Counter - Variance Request: A hearing was held on September 13,
-
1993 to consider a variance request of Daryl Counter. The property
owner is requesting to locate an additional accessory building o:f up to
24' by 40' (960 square :feet) on his property. He is requesting a 636
foot variance on the maximum area allowed :for accessory buildings, and
a 491 foot variance is being sought on the maximum lot coverage
allowed.
Hazen made a motion verifying the recommendation o:f the Planning
Commission approving of a variance o:f St. Joseph Code o:f Ordinances
No. ~2.1b subd 4(e)[i] & [ ii ] , allowing the property owner to combine
the footage as :follows:
a. maximum square :footage o:f 900 square :feet :for an accessory
building
PLUS
b. the square :footage :for an accessory building, o:f 120 square
feet.
The property owner can build an additional storage shed not to exceed
22' x 20' (440) square :feet. Additionally, no additional storage sheds
can be constructed on this property.

Claude Menzhuber - Variance Request: The Planning Commission
conducted a public hearing on October 4, 1993 to consider the request
o:f Claude Menzhuber. The purpose o:f the hearing was to consider a
request for a two hundred thirty-eight (238) :foot variance on the size
of a business sign in a General Business zone, in conjunction with an
existing business. Zoning Ordinance No. 52 o:f the St. Joseph Code o:f
Ordinances allows a maximum o:f :fifty (50) square :feet on one side.
The property is located at 200 - 2nd Ave NW and legally described as
follows: Lot-D09; All o:f Lots 9 & 10 Lying S o:f Hwy 52; Bet IA and San
Fran Sts, Less b:250' & Less Sts; Auditor's Subdivision No. 4.
Hazen made a motion to veri:fy the recommendations o:f the Planning
Commission and approve the two hundred thirty eight (238) :foot variance
as requested based on the :following :findings:
1 ) St. Joseph Code o:f Ordinance No. 52.7 subd 2(b)
That the literal interpretation o:f the provisions o:f this
Urdinance would deprive the petitioner o:f rights commonly
enjoyed by other properties in the same district under the
terms of this Ordinance.
2) St. Joseph Code o:f Ordinance No. 52.7 subd 2(c)
That granting the variance requested will not con:fer on the
applicant any special privilege that is denied by this
- Urdinance to other lands in the same district.

Bruce OstendOl~f =- Lot Split: Bl-'uce Ostendorf, 524 1st Avenue NE,
appeared beiore the Council to l~equest a simple lot split. Mr.
Ostendorf has recently purchased a piece of property adjacent to his
l'E'sidence, 520 - 1st Ave NE, and is requesting to split 15.5 feet off
his residence to add to this property. Additionally, the outlot that
is located South of the recently purchased property would be combined
into the legal descl-iption of the lot. Both parcels would exceed the
minimum lot square footage. The properties would have the following
legal descriptions.
Parcel A: That part of lot twelve ( 12) , Auditor's Subdivision No. 4 in
the Village of St. Joseph, Stea:cns County, l'1innesota, described as

Hazen question whether or not a Council Member has the authority to
make motion while acting as a Liaison. Council requested clarification
from the City Attorney as to whether or not a liaison to the Planning
Commission has the authority to make motions.
OPEN TO THE PUBLIC
Mike Deutz: Mr. Deutz was concerned with the student problems near the
campus villa apartments. The original special use permit required Mr.
Lambert to fence his entire parcel of property. Since that time Mr.
Lambert requested relief from this requirement and the Council agreed
to change the conditions of the special use permit. Mr. Deutz stated
that the students are walking across his property and would like the
Council to reconsider the requirements. During the recess Deputy Clerk
Weyrens will check the minutes so the Council can take some action
tonight.
Mr. Deutz stated that he felt there was a conflict of interest by a
Planning Commissioner, due to his employment. The Council agreed to
review and inform all boards with regards to the state statues
regulating conflict of interest.
JR_ Studniski: Mr. Studniski questioned why the parking along the East
side of 2nd Avenue NW was removed. The Council requested the Mr.
Studniski wait until the Engineer arrives to discuss this matter.
Hazen made a motion to recess at 8:10 p. m. ; seconded by Rieke.

Mayor Reber reconvenned the meeting at 8:30 p. m.
Mayor Heber read the minutes of the August 2, 1993 Planning Commission
meeting at which time they conducted a hearing to relieve Mr. Lambert
of the fencing requirements. The Council agreed that the West side of
Mr. Lambert's property should be fenced, and requested that he be
invited to attend the next City Council meeting. The City Offices will
notify Mr. Deutz as to the date and time Mr. Lambert will be appearing.

CITY ENGINEER
2nd Avenue NW Parkin9...!- Joe Bettendorf, City Engineer, discussed the
placement of parking stalls along 2nd Avenue NW. Traffic Laws regula-\.
that the first parking stall must be a minimum of 20' from the
crosswalk. Councilor Rieke stated that the Council as recommended by
the Planning Commission authorized the removal of the three parking
stalls on the East side of I'linnesota Street. Mayor Reber stated that
the intersection is extremely dangerous and caution needs to be taken
at this intersection. The Council agreed to check the minutes as to
why the parking stalls have been removed and discuss this mat tel- at the
next regular City Council Meeting. This item shall be placed under Old
Business.
Chanqe Order: Engineer Bet tendo:.f presented a change order for the East
Minnesota Street Project. In trying to get the Sanitary Sewer from the
Casing under the highway 75 to 90th Avenue has been very difficult due
1.0 underground utility lines. In an effort to resolve the situation,
a change in plans is necessary. Rieke made a motion approving the
change order which included moving the location of the sanitary sewer
between 11anhole #1 and Manhole #4 and allow additional compensation to
the Contractor for this cost, reducing the restoration costs. The
motion was seconded by Hazen.

Councilor Loso arrived at 8:55 p. m.
Parkinq Lot: Bettendorf stated that he has received the quote from
Har-drives for the annex parking lot. The total quote price was
$8,b30.UU, which includes the removal, excavation and restoration of
sod. Those present agreed to underwrite the cost of the parking lot,
billing the adjoining property owners their portion. Hazen made a
motion to accept the bid of Hardrives in the amount of $8,b30.00 and to
underwrite the cost of the project, billing the adjoining property
owner"s. The motion was seconded by Rieke.

Curb Restoration: Bettendorf has contacted Hardrives with regal~d to the
restoration of the areas receiving curb. The restoration should be
complete shortly. Councilor Loso also questioned Mr. Bettendorf
concerning the alley between College Avenue North and 1st Avenue NW,
their appears to be a low spot where water is pooling. Mr. Bettendorf
will check into the matter-.
Test Well: Bettendorf stated that he has met with Leo Sadlo and Dick
Taufen to discuss drilling a test well. Well #2 has not been
functioning to expectations, and an alternative site should be checked.
Bettendorf stated that the best solution would be to run a test well
near well #2. Hieke made a motion to authorize the drilling of a test
well in the vicinity of well number 2, as recommended by the City
Engineer. The motion was seconded by Hazen.
