Pursuant to due call and notice thereo£, the City Council :for the
City o£ St. Joseph met in special session on Monday, June 27, 1994
at 4:00 p. m. in the City Hall.

Mayor Heber called the meeting to order at 4:00 p. m. and stated
that the purpose of the meeting is to consider acquisition of
property for the fire hall, advertising for bids for the :tire
truck, and the Star City video.

Township Attorney, stated that the Township wants to have joint
ownership of the property for the fire hall, and that Minnesota
statute would allow such ownership. John Scherer, City Attorney,
stated that he concurred that joint ownership could be accomplished
but there are other issues to address along with joint ownershi p.
If the Hoske property is purchased only part of it would be used
for the fire hall. Associated issues would be use of part of it in
the future for other city facilities, or if merger is achieved.
Also the terms for disposal of any portion o:f it could be an issue.
Mayor Heber questioned if the City purchased property and could a
portion be sold at a later date. John Scherer stated that this
type of sale would be handled as surplus property. Loso questioned
if an issue which was brought up to a re:ferendum in the past and
failed, could be reconsidered again. Scherer stated that this is
not the same issue, but a similar issue. Also statutes would allow
it.
Mayor Heber stated that he wants all the costs presented to the
taxpayers before any final decisions are made, and requested to
have the Scherer property appraised as well as the other properties
being considered. The Scherer property purchase price would be the
appraised value. Mayor Heber also proposed to consider the Zimmer
property next door for expansìon. Joe Bechtold stated that the
¿:immer property would require the trucks to continue to back in the
~torage building rather than drive through. Hazen questioned who
would do the appraisal, what would be the cost o:f it, and when it
would be completed. Hieke stated that this would require a
commercial appraiser with an estimated minimum cost of $1,5Ø0.
Hazen made a motion to offer $5,0Ø0 as earnest money for the Roske
property for a period o:f 120 days and get an appraisal on it in the
interim; seconded by Hieke.
Ayes: Heber, Hieke, Loso, Hazen, Hiemenz.
Nayes: None. Motion carried.

Nayor Heber moved to have the Scherer property appraised also;
se80nded by Loso.
Ayes: Reber, Loso.
Nayes: Hieke, Hazen, Hiemenz. Motion failed.
Hazen made a motion to approve Bill Wasner to act as negotiator for
-Lhe City, un the Hoske property and to involve John Scherer in the
negotiation and bring a {Jrice back to the Council. The motion was
8E'cunded by Hieke.
Discussion - Mayor Heber asked the City Attorney if Bill Wasner
legally could negotiate :tor the City. John Scherer stated that the
Council cuuld appoint the negotiator, and may want to give him some
guidelines. Final approval of the contract price would have to be
by -Lhe Cuuncil. The Council discussed financing mechanisms and
that a bund issue probably would require a referendum. Bechtold
s-La'led that he is not sure it needs to go to a referendum, except
for {Jolitical reasons. John Scherer stated that some negotiation
between the City and Township needs to take place concerning
uwnershi{J u:t the pruper'ly, concurrently with negotiation :tor p:cicE'
un the pruperty.
Ayes: Heber, Hieke, Loso, Hazen, Hiemenz.
Nayes: None. Motion carried.
There was discussion i:t the earnest money will be taken out of the
Fire Fund or the City General Fund, and the need to draft a joint
powers agreement between the City and Township to purchase property
together. The Council was in general agreement to have an
appraisal or an estimate of value prepared on the Hoske property.
'rhe Clerk/Administrator was requested to get proposals from two
cummer'cial appraisers.
Hiemenz stated that the Planning Commission should be involved in
making a recommendation on these plans. Mayor Reber stated that
they would be approached when the City and Township are ready to
make a purchase.
BIUB ¥UH ¥lHE THUGK: The Council considered the plans and
specifications :tor the new fire truck. Hazen made a motion to
advert,ise :tor' bids as requested by the Fire Department. Both the
City and Township Attorneys have reviewed the plans and specs.
Kirby Dahl stated that he does not know fire trucks but the plans
and specs appeared acceptable if they are generic in nature and do
n cd. eXGlude all othe:c- tr'ucks. John Scherer stated that he has the
same opinion as Kirby Dahl. He felt that the specs are acceptable
unless only one manufacturer can meet the specs. Dave Theisen
stated -Lhat the specs also required that the manufacturer is
located within 2~Ø miles from St. Joseph to provide for maintenance
o:t 'lhe truck.
Ayes: Heber, Hieke, Loso, Hazen, Hiemenz.
Nayes: None. Motion carried.
~TAk CITY VIUEU: Hiemenz presented a proposal and made a motion to

approve a proposal :for the City o:f St. Joseph video :from
Diversi:fied Marketing Resource, Inc. with the total cost o:f
$6,8':1:5. øø, and a payment schedule in three equal increments. The
motion was seconded by Hazen.
Ayes: Reber, Rieke, Loso, Hazen, Hiemenz.
Mayes: None. l'lotion carried.
UUlUII::R I::l'IPLUY1'II::NT: Dick Tau:fen reported that one summer
maintenance worker has terminated employment with the City. Gary
Donabauer is available to :fill the position. Hiemenz made a motion
to hire Gary Donabauer as a temporary maintenance employee to :fill
the position; seconded by Rieke.
Ayes: Reber, Rieke, Loso, Hazen, Hiemenz.
Nayes: None. Motion carried.
