o± St. Joseph met in regular session on Thursday, July 21, 1994 at
ï:Ø(ð p. m. in the City Hall.
MEMBERS PRESENT: Mayor Donald Bud Reber; Council Hoss Rieke, Bob Loso,
Ken Hiemenz; Clerk/Administrator Rachel Stapleton. Stephanie Hazen was
absen-L.
OTHEHS PHESENT: Judy Weyrens, Joe Bettendorf, Leo Sadlo, Brad

1'11 NUTES : Hiemenz made a motion to approve the minutes of the July 7
meeting as presented; seconded by Loso.

lHLLS PAYABLE: Judy Weyrens presented and discussed the bills payable. I
Hiemenz made a motion to approve the bills payable as presented, check
numbers 1~881-19898; seconded by Rieke.
Ayes: Heber, Hieke, Loso, Hiemenz.
Nayes: None. Motion carried.
Hieme::onz made a motion to approve the overtime and call outs as
presented by Weyrens; seconded by Rieke.
Ayes: Heber, Hieke, Loso, Hiemenz.

MAYUH HEPURTS: 1 ) Mayor Heber reported on a meeting he attended with
Mike Hyan, Sister Mary terese, Greg Reinhart, and Bob Krebsbach to
discuss preliminary plans on how to attract people to patronize the
businesses in St. Joseph. They agreed to meet with professionals to
assist them.
2) He also reported on an Economic Development Partnership meeting he
and Greg Heinhart attended. Une item of discussion was the lack 0:E
availability of day labor in this area.
3) The proposed scheduled abandonment of the railroad is in about three
years. Abandonment of it sooner would help the City to develop better
roadway plans in new developments, particularly the industrial area.
Hiemenz made a motion to send a letter of request to Burlington
Northern Hailroad asking them to advance the date 0:E the scheduled I
abandonment of the railroad and to turn over control of the railroad
right of way property to the City. The motion was seconded by Rieke.

4) Mayor Reber presented a request :from the Boy Scouts to pay for the
monthly costs o:f heating the Boy Scout building for their meetings.
They intend to have natural gas installed in the building. Rieke made
a motion to approve the request .for monthly service; seconded by Loso.
Ayes: Heber, Rieke, Loso, Hiemenz.
Mayes: None. Motion carried.
Loso made a motion to have the Fire Chie:f inspect the Boy Scout
building for :fire sa:fety, and extinguishers; seconded by Rieke.
Ayes: Heber, Rieke, Loso, Hiemenz.
Mayes: None. Motion carried.
CUUNCIL REPURTS
IHl:::KE: Rieke reported that he has received many calls on the Fire Hall
issue and on the HHA issue.
LUSU: 1 ) Loso reported that he has spoken with Sharon Loso, one of the
owners of the Bill Loso property, a proposed site for the new .fire
hall. She informed Councilor Loso that she would like some time to
consider the matter.
2) There have been problems with the closing of the park bathrooms and
equipment missing at the parks. Chief Lindgren requested that he is
informed when there is a problem and he will talk to the specific
officers involved.
8) Loso made a motion to send a directive to the Maintenance Department
to take down the light poles at Kennedy Elementary School by the old
hockey rink area, as time permits before winter. The motion was
seconded by Rieke.

4) The JayCees donated $900 for equipment for the Hollow Park Tot Lot
ior a swing set, park bench, and garbage receptacle. Loso made a
motion to approve purchase of this equipment as proposed; seconded by
Hieke.

Mayes: None. Motion carried.
~) Loso and Hieke as the Personnel Committee, sent out a memo
requesting employee response on their requests for wage, salary and
benefit increases for 1995.
b) The lawn mower deck on the John Deere is worn out, and this
equipment is obsolete. Loso made a motion to allow up to $2,ØØØ :for
Mike Sworski to replace the mower deck from budget number 45202-540;
seconded by Rieke.

Nayes: None. Motion carried.
Hll:::Ml:::NZ: Hiemenz reported that he received many calls also on the Fire
Department and HHA issues.
CHll:::~ U~ PULICl::: HE::PUHTS: Chief Brad Lindgren presented his monthly
repoI't, and stated that the police are getting considerably busier each

sumrnel~ ; that they are seeking a reserve officer to replace Dani Barubè;
there were several minor calls on the Fourth of July, but it went
relatively well; questioned if the Planning Commission has discussed
and made recommendations for the NO PARKING signs by Grand Slam Pizza.
Hiemenz stated that he will bring this matter to the next Planning
Commission meeting. Chief Lindgren also informed the Council that the
State o± Minnesota requires that all custodial situations must be tape
recorded. In order to use statements made by suspects, the entire time
that they are questioned while in custody must be tape recorded. Reber
stated that because this is required the City needs to provide
equipment for this service. Chief Lindgren recommended that he would
gel:. a recorder at a cost of about $150, for sensitive cases and each
of:ficC?r have his own tape recorder at a cost of about $50 each. Reber
made a motion to approve the purchase of the equipment as recommended
by the Chief; seconded by Hiemenz.

UUTDUUH LHJUUH PEHMll': Loso made a motion to approve an application
ior' an Uutdoor Liquor Permit for the LaPlayette Bar, ior an event to be
held c.ln August 20 with live music and a pig roast. The motion was
seconded by Hiernenz.

Nayes: None. Motion carried.
BASE HALL PARK: Pat Schneider prepares the baseball field for
tournament games and has asked for $10 for each preparation. Rieke
made a mútion to approve the i~equest ; seconded by Hiemenz.

Nayes: None. Motion carried.
DUG CUMPLAINT: Stapleton received a complaint about people leaving dog
dr'oppings whé>n they walk their dogs. The Council requested that the
Cit.y Attürney be consulted an this matter far possible consideration of
an ordinance to control this nuisance.
HENï'AL HUUS1NG: Luso made a motion to approve an extension of the
rental housing licen8ing requirements from the August 1 deadline to
late August for Hobert McManus, Stearns County Partners for the
pr'o pE:'r·t y located at :'H4 & :.:lib Uld Highway 52, as requested. The motion
was seconded by Hieke.
Ayes: Heber, Hieke, Loso, Hiemenz.
Nayes: Nune. Motion carried.
WELL CL!::AN1NG: Stapleton presented a proposal to clean and acid treat
Well #2, from Donabauer Well and Pump Co. oi $1, 370. Lea Sadlo
discussed it with the Council. He stated that this is a measure to
keep the well functioning over winter. It will give the Council a
little time to proceed with the new well project. Loso made a motion
to approve the proposal to clean and acid treat well #2 as proposed;
seconded by Hiemenz. Ayes: Heber, Rieke, Loso, Hiemenz.

PARK PROJECTS: Millstream Park - Leo Sadlo discussed proposals Íor
driveway and handicap access to the shelter area, as proposed by the
Lions Club and security of the bathrooms and park shelter. Council
requested that the City Engineer view the plans for the driveway and
walkway. Morningside Park - The City Engineer will review the access
easement from the Seventh Avenue area.
MORNINGSIOE PARK: The City Engineer will review the access easement
from Seventh Avenue for possible upgrading to an entrance.
POLICE CHrE~ CONTRACT: The Council set a special meeting to be held on
July 28 at 3:0Ø to discuss this issue.
OPEN 1'0 THE PUBLIC
ALLJ:o:Y VACATlUN: Jerry Helph, representing the Sisters of the Order of
St. Benedict, appeared at the public portion of the meeting and
presented a petition to vacate several alleys adjacent to their
þr·operty. The petition was signed by the Sisters of the Urder and the
Church of St. Joseph. The Council received the petition and set the
date of the public hearing for September 1 with a motion by Loso;
seconded by Hieke.
Ayes: Heber, Hieke, Loso, Hiemenz.
Nayes: None. Motion carried.
DUG UHDlNANCE CUNSIDERATIUN: Karen Erickson questioned the status of
the Council consideration to allow more than two dogs per household,
and requested to be placed on the August 4 agenda to request an
allowance for three dogs for her property.
Hiemenz made a motion to recess at 8:14 p.m.; seconded by Rieke.
Ayes: Heber, Rieke, Loso, Hiemenz.
Nayes: None. Motion carried.
Mayor Heber reconvened the meeting at 8:30 p.m.
GAMBLING LlCENSE EXEMPTION: Loso made a motion to approve an
application for authorization for exemption from Lawful Gambling
License from the st. Joseph Volunteer Fire Department for an event to
be held on August 19, 1994 at the LaPlayette; seconded by Reber.
Ayes: Heber, Hieke, Loso, Hiemenz.
Nayes: None. Motion carried.
ST. JUSEPH ~lRE~lGHTERS' RELIEF ASSOCIATION: Ken Twit appeared before
the Council to present the financial report for 1993 and the
requirements for 1995 for the City contribution. Loso made a motion to
approve the requested City contribution of $4,139 to the st. Joseph
~irefighter's Relief Association for the 1995 budget year; seconded by
Hiemenz.
Ayes: Heber, Hieke, Loso, Hiemenz.
Nayes: None. Motion carried.
SlGNAL LlGHT: Loso moved that County Engineer Doug Weiszhaar is
contacted regarding the signal light on C5AH 75, to consider scheduling

the lights to a flashing red and yellow mode during the night hours.

ULD HIGHWAY ~2 STHEI:::T IMPROVEMENT PHUJECT: Bettendorf presented
Applicat ion for Payment No. 1 and recommended approval. Rieke made a
motion -La approve Application for Payment No. 1 to Hardrives, Inc. of
$14, :;~B. {ð'/; seconded by Loso.

Bettendorf pr'esented Change Urder No. 1 of $4,425.25 for water system
impruvement in the project which included a hydrant, gate valves, and
main. Hiemenz made a motion to approve Change Order No. 1 as
pr'esented; seconded by Hieke.
Ayes: Heber, Hieke, Loso, Hiemenz.
Nayes: None. Motion carried.
NUI-nHLAND ADDITION: Bettendorf stated that he met with the Developer,
the Developer's Engineers, and his partner, Dale Salo to discuss the
par"k land and drainage. Bettendorf presented proposals for making
optimum use of the park area. This area could be used to allow storm
drainage into the park area from runoff, but the conditions should
allow the ar'ea to drain or dry shor'tly after a storm. The second
proposal for storm drainage was runoff from only backyards and roofs,
no r'un of from streets. This would provide for better park land, and
keep the dirt, sand and salt from the street drainage out of the park.
Hiem~nz made a motion to approve a study on the cost of installation of
a pipe for' drainage, the cost to be born by the development; seconded
by Hieke.

Nayes: None. Motion carried.
Council requested that Joe Bettendorf present the proposals to the
Planning Commission for their recommendation.
HHA PHUPUSAL: Mayor Heber stated that the Planning Commission heard
UÜs proposal and has made a recommendation. Jim Degiovanni,
representing HHA, presented several other proposals and asked the
