I Pursuant to due call and nøtice thereøf, the City Council for the City
of St. Joseph met in regular session on Thul~sday, June 1, 1995 at 7:00
p. n1. in the St. Joseph City HalL
Members Present: Mayor Donald "Bud" Reber. Councilors Ross Rieke, Bob
LOBo, Ken Hiemenz, Cory Ehlert. Deputy Clerk Judy Weyrens.
Others Present: Steve Streng, Josh Rieke, Ben Poepping, Bruce Backes,
Hub Klein, Mike Deutz, Joe Bet tendor':f, Jim Schwagel.
Aqenda Approval: Loso made a motion to approve the agenda with the
following additions: Consent agenda ( b ) outdoor liquor per'mi t ;
Clerk/Adm Reports (c) Noise Violation. The motion was seconded by
Rieke.

Consent Aqenda: Rieke made a motion to approve the consent agenda as
:follows:
a) Approval of the May 18, 1995 City Council minutes as presented.
b) Approval o:f an outdoor' liquor permit tCI the La Playette for
an event to be held on June 2, 1995. Council waives the 30 day
waiting period.
The motion was seconded by Hiemenz.

OvertimE' & Call outs: Loso questioned the ef:fectiveness and safety of
patrol o:f:ficers working 12 hour shi:fts. Mayor' Reber stated he would
check with Chief Lindgren on this matter and report back to the
Counci l. Loso made a motion to approve the overtime and callouts as
pr'esented; seconded by Rieke.

OLD BUSINESS
AWAIR Sa:fety Manual: The Safety Committee has met and adapted the City
o:f Albany's sa:fety manual to meet the needs o:f the City of St. Joseph.
Reber' stated that he has reviewed the manual and feels comfortable with
it as it is revised. La so made a motion to adopt the safety manual as
I revised; seconded by Hiemenz.

Riel.o;:e state that it is important to cha:cge a fee for a vaL'iance
hearing. Additionally, the Council needs to be alert to variance I
l-equests that al'e of a l-eCU1-rent n at u l' e , viewing such as a possible
need fox' modification of City Ordinance. Loso stated that he feels the
fee is too high, and l"equests al'e honored with inadequate findings.
Re bel-, Hiemenz, and Rieke concurred that a fee needs to be charged and
it may be best to leave the fee at the CU1"rent rate. After
considel-able discussion, Mayor Reber requested the Councilors bl'ing
suggestions to the next meeting £01" l-esolution.
CITY ENGINEER REPORTS
Pumphouse Renovation Bids: City Engineer' Joe Bettendorf pn?sented the
results of the bid opening for the Pump house No. 2 Rehabilitation.
Loso made a motion to award the bid to PreUSSel" Construction for $
4'3,'331; seconded by Rieke.
Ayes: Rebel" , Rieke, LOBo, Hiemenz, Eh ler t.
Nayes: None. Motion Carried 5:Ø:Ø
Application for Payment #1, Well No. 4: Bettendorf presented an
application £01- payment to Donabauer Well for completed work on Well
No. 4. Hiemenz made a motion authorizing application of payment #1 to
Donabauer Well in the amount of $ 2,845.57; seconded by Loso.
Ayes: Reber, Rieke, Loso, Hiemenz, Ehlert.

4-Way Stop Request: Bettendorf was l-equested to determine if a 4-way I
stop is wal"ranted at the intel~8ection of gist Avenue and East Baker
Street. At thi.s time Bettendol-f stated that there is not enough
tl'aff ic volume to Wal"l'an t a 4-way stop. Installing a 4-way stop on a
thl'ough street where it is not necessal'y for access 01" safety
Íl'equently l'esul ts in drivers coasting tlwough the intersection, 01'
ignoring the signs all together. The Council agreed to monitor the
situation QVel' the next months and leave the intel'section as it is
currently signed.
Parkinq alonq Date Street: Bettendorf T'eviewed the recent parking
c.clmplaints on Date Stree't between College Avenue and 1st Avenue NE.
Bettendorf recommended that the first course o:f action should be
contacting the landlord of the apa:c-tment complex, Mark Lambert, and see
if he could assist with the parking. If the pr'oblems re- occuy' ~ the
City could sign the str'eet with timed par'king. T}-¡e Council agr'eed to
moni to:c the a r' e a and at this time leave the street pa:r--king as it is
cur:r-ently designated.
Generator Set: Bettendorf reported that he and Dick Taufen loaked at
the used genex-'ator' at Centel- City. The generato:r" is a 1967 Cummins
madel that was used by the Air Force. Bettendorf exp:cessed concern as I
to whether' replacement pa:cts would be available for' the generator'.
Taufen has checked with a welder in Albany who could fab:c'icate a

trailer for the generatol~ that was previously bid. Bettendorf ~t~ted
I he would check with the company who bid the genel~at()r to see if they
would sell just. the generator set. Reber stated that Cummins is a very
reputable company that has been in existence :for many years, and would
like Bettendoi.'£ to considel~ fUi.~ther the used generator. Hiemenz
questioned Bettendorf if he could contact Cummins with the model of the
used geiìerator to check on the availability of parts. Bettendorf will
check into the 13ptions available to the City and report back at th¡?
next Cou.ncil meeting.
Water Filtration Pro;ect: Bettendor:f stated that he has checked into an
air stripper :for well #1 to take caT'€' O:f the Benzene. The app:c-o:>dmate
cost of the stripper is $4Ø,0Ø0 to $50,000. Jim No:c,ton o:f SEH will be
present at the next meeting to discuss the options available to the
City. It may be more cost e:t::fective to abandon the well and drill a
new well. If this would happen, the well house would be taken down.
Bettendorf stated that even with the absence o:f the building the City
will still need to obtain easements :from the adjoining pT'Clperty owners.
At this time the projected starting date is June 1, 1 ~19E..
Capital Improvement Plan: Bettendor:f and Tau:fen are working on the
plan, and will p:cesent it to the CCluncil for cClmment in ~1uly. Reber
:felt that since this is a time consuming p:c'ocess, a special meeting
should be established when they are ready to present the plan.
Roske Property: Rieke questioned Bettendor:f when it would be
I appropr'iate to list :for sale the excess prclp€'rty on the RClske site.
Bettendor:f stated that bef or'e a realtor is allowed to list the
property, the rClad and utilities will need to be platted. At the
p:c-esent time there is enough in:f o:f'maticlJJ available for' a prc,specti ve
buyer to r'eview.
Millstream Park: Loso questioned Bettendor:f as whether a map existed
that illustrates the elevations. Bettendorf stated that he has a
layout map but not an elevaticln map. In Clr'der to gener'ate such a map,
a surveyor would need to be contr'aeted and would cost between $1,000
and $1,500. Loso stated that he is inte:c'est in dr'8wing 8 youth
athletic :field to be used for sClccer and baseball. Bettendorf stated
that drawing a layout map would be an additional cost. The Council
authorized Bettendor:f and Loso to wOT'k on this matter.
City Flaq: Hiemenz stated that Steve Dehler approached him to request
the City consider making a City Flag. Dehler' has contacted
a member' of the cClmmuni ty who is willing to make the :flag with the
design being the City skyline. Hiemenz questioned Bet tendo:c'f i:f he
could generate the skyline :for a :flag. Bettendorf stated he did have
the skyline and would need the dimensions o:f the flag tel assur'e an
appropriate size. HieTflenz made a motion to adopt the skyline design on
I the water tower as the c,:f:f icial City lc'go, and have a :flag const:c'uc'ted
with this logo. The motion was seconded by Rieke.

Jill) Schwaqel - Bus Stop Request: Jim Schwagel appeal~ed before the
Council to l'equ.est. the removal of the bus stop sign located on 2nd I
Avenue NW by the Cl'eamel'Y Apal'tments. Sch wagË'l stated that the bus
stop creates ne.! ise problems, property damage and a refuse problem.
~3ince he has pUl'chased the p l' 0 pel' t y he has spent many hours cleaning u,p
the debl~is. Addi t iona.lly, less than 50'l. of his tenants al'e students
and are ,,-wakened at night by the noise fl'om the bus stop. Schwagel
stated. that he is trying to get away f l' 0 m student l'ental and does not
want the bus stop in front of his propei.'ty to detl'act f l' 0 m the l'ental
market. He also feels that if the College is inclined to provide bus
stops they shou.ld provide heated facilities.
RebE.'l' felt that this problem needs to be addressed and repl'esentati ves
f1'O\l1 the City, 5t. Benedic~t' s and Mr. Schwagel should establish a
meeting to l~eso 1 ve this matter. Possible 21.1 tei.'na t i ves would be to put
cl bus stop by the medical clinic 01' on the corner of 2nd Avenue NW and
MinnGsota Street. If the alternative sites are considered, the
pi'opel't y ownei~S affected should be invited to the meeting as well.
Loso felt the f:>igî1 should just be removed. Re bel' stated that l'ernov i09
the sign does not l~esol ve the mattel" and he is confident a resolution
can be reached with all parties involved.

Noise Violations: R e bel' l'ead a notice from the St. Cloud Times Whel"e
the City of St. Cloud had amended the i l' noise oi.-dinance. The pl' oposal

the newly installed pay telephone and was concerned as -to the misuse o:f
the telephone.

AWAIR: As part CI:f the safety manual the City needs to supply basic
:first aid kits in each o:f the vehicles and the park shelters. In
addi ticlT1, each employee should be provided with a protective airway
mask. Losoroade a motion to purctlase 1~1 first aid kits :from Zee
Medical at a total cost o:f $ 734.25 and 15 aiT'way packs at a cost o:f
$112.5Ø~ seconded by Ehler-t.

equipment. Hiemenz made a motion authclrizing the purchase of eight (8 )
ear protection devices to be given to the Maintenance Department
employees. The motion was seconded by Rieke.
