HomeMy WebLinkAbout1995 [07] Jul 20 Page 2824 July 20, 1995 Pursuant to due call and notice thereof, the City Council for the City of St. Joseph met in regular session on Thursday, July 20, 1995 at 7:00 p.m. in the City Hall. KEKBERS PRESENT: Mayor Donald Bud Reber; Councilors Ross Rieke, Bob Loso, Ken Hiemenz, Cory Ehlert; Clerk/Administrator Rachel Stapleton. OTHERS PRESENT: Judy Weyrens, Brad Lindgren, Art Hiemenz, Edith Hiemenz, Tara Plaemen, Renee Salzer, Richard Schleper, Al Sie:fert, Mark Zimmer, Gary Schleicher, Ben Poepping, Gary Heltemes, Steve Dehler. Mayor Reber called the meeting to order at 7:00 p.m. with Councilors Loso, and Hiemenz present. AGENDA: Loso made a motion to approve the agenda as revised; seconded by Hiemenz. Ayes: Reber, Loso, Hiemenz. Nayes: None. Motion carried. Cory Ehlert arrived at 7:05 p.m. CONSENT AGENDA: Loso made a motion to approve the Consent Agenda as follows; seconded by Reber. 1. Minutes of the July 6, 1995 City Council meeting as corrected. 2. 1995 Overlay Street Improvement Project - constructing a bituminous overlay on Cypress Drive :from Old Highway 52 around the complete loop and back to Old Highway 52, on East Baker Street :from Seventh Avenue Southeast to the beginning of Pond View Ridge subdivision, and on Ninth Avenue Southeast from East Baker to East Minnesota Street. a) Resolution Ordering Preparation o:f Report on Improvement b) Resolution Receiving Report and Calling for Hearing c) Resolution Approving Plans and Specifications and Ordering Advertisement for Bids 3. Resolution Ordering Preparation o:f a Report for Reconstruction o:f East Minnesota Street between First Avenue East and Ninety First Avenue, and College Avenue :from Minnesota Street to Ash Street North, and the East-West alley from College Avenue to First Street Northwest, between Minnesota Street and Ash Street West. 4. Application :for payment to Asphalt Sur:face Technologies of $15,219.16 íor the sealcoating project. Ayes: Reber, Loso, Hiemenz, Ehlert. Nayes: None. Motion carried. BILLS PAYABLE: Deputy Clerk Judy Weyrens presented the bills payable. Loso made a motion to approve the bills payable check numbers 21245 - 21261; seconded by Hiemenz. Ayes: Reber, Loso, Hiemenz, Ehlert. Nayes: None. Motion carried. Ross Rieke arrived at 7: 10 p. m. TREASURER'S REPORT: Deputy Clerk Judy Weyrens presented the Treasurer's Reports for May and June. After Loso asked to have the monies designated for Northland Park indicated on the report he made a motion to accept the May and June Treasurer's reports. The motion was seconded by Rieke. Ayes: Reber, Rieke, Loso, Hiemenz, Ehlert. Nayes: None. Motion carried. DEPARTMENT HEAD REPORTS: Bradley Lindgren, Chief of Police, presented his monthly police report. 1) He discussed that Reserve Officer John Brunner received a letter of appreciation from the St. Cloud Police Department for his actions in an arrest in St. Cloud. He also stated that Reserve Officer Brunner has resigned and will be moving out of the area. Mayor Reber made a motion to have a plaque made to be presented to him, from the City, in appreciation of his many hours of volunteer efforts in serving the City of St. Joseph as volunteer Reserve Police Officer. The motion was seconded by Rieke. Ayes: Reber, Rieke, Loso, Hiemenz, Ehlert. Nayes: None. Motion cal~ried. 2) Chief Lindgren also requested to purchase a replacement desk chair for his office. Rieke made a motion to approve the request; seconded by Ehlert. Ayes: Reber, Rieke, Loso, Hiemenz, Ehlert. Nayes: None. Motion carried. 3) Officer Jean Gustin resigned as D.A.R.E. Officer :for a number of reasons, one being that it requires so many hours of off duty time. Chief Lindgren stated that he accepted her resignation from this position. None of the other officers are prepared to take on the duties of D.A.R.E. so Chief Lindgren stated that he will request that the Stearns County Sheriff's Department take over these duties faT' a year or two. Perhaps in two years one of our officers will take on these duties. 4) The St. Joseph Lions Club donated funds to purchase tire deflating devices called "stop sticks" . Chief Lindgren demonstrated the devices which were claimed to stop vehicles safely during high speed chases. 5) Mike Ryan for the College of St. Benedict, has agreed to assist in funding the local share of the cost for the Fast Cop program. St. Benedicts has agreed to provide one third of the $7,000 local Page 2826 July 20, 1995 share or a sum of $2,333 per year for the duration of the program. He also stated that St. John's has tentatively agreed to do the same. Chief Lindgren further discussed that this would increase police coverage during the day for community policing. Officer Brad Meyer is willing to fill this position with shifts primarily from mid morning to early evening. This position would fill in open shifts due to officers on vacation, training and such. Hiemenz made a motion to pursue funding efforts for implementation of this position; seconded by Ehlert. Ayes: Reber, Rieke, Loso, Hiemenz, Ehlert. Nayes: None. Motion carried. Councilor Hiemenz requested that the police patrol the post office area. He has noted many dangerous U turns being executed there. Chief Lindgren informed the Council that the 4-way stop sign age has been installed at Minnesota Street West and Second Avenue West. ST WENDEL TOWN BOARD - COIIPOST: St. Wendel Town Board requested that their residents are allowed to use the City compost area. A£ter discussion Loso made a motion to allow St. Wendel Town residents to use the compost area on a tentative basis, with St. Wendel Township providing any donation they £eel is necessary. The motion was seconded by Rieke. Ayes: Reber, Rieke, Loso, Hiemenz, Ehlert. Nayes: None. Motion carried. liS-TRAil: Gary Schleicher for the Recreational Association, and Mark Zimmer appeared be£ore the Council to request a "Special Event" Non-Intoxicating malt liquor license and a permit for outdoor live entertainment for the TRAM event to be held July 26. This is a bicycle touring event to raise funds £or MS. Loso made a motion to approve the request and waive the fees; seconded by Hiemenz. Ayes: Reber, Rieke, Loso, Hiemenz, Ehlert. Nayes: None. Motion carried. OCTOBER FEST: Mark Zimmer presented his plans to hold an Octoberfest October 20 - 21 - 22. He intends to have an outdoor tent set up with music and £ood and beverage. Loso made a motion to approve the outdoor liquor permit and entertainment as requested and to be considered one event £or permit £ee purposes. The motion was seconded by Rieke. Ayes: Reber, Rieke, Loso, Hiemenz, Ehlert. Nayes: None. Motion carried. }fAYOR REPORTS: No report. COUNCIL REPORTS RIEKI::: No report. EHLERT: No report. Page 2827 July 20, 1995 LUSU: 1) Loso discussed and made a motion to accept a quote for Centennial Pal~k project for lights and an exhaust fan from Cold Spring Electric Services, Inc. for $27'3. The motion was seconded by Rieke. Ayes: Reber, Rieke, Loso, Hiemenz, Ehlert. Nayes: None. Motion carried. HIEI'ŒNZ: 1) A garbage situation was noted by the bookstore, but Hiemenz reported that it was being remedied with a dumpster. 2) The Maintenance personnel and Police Officers should take note when there is garbage, refuse, weeds, trash and junk cars while they are patrolling the city. Any notice of these conditions should be reported or acted on without complaints being received. Council discussed this issue and generally agreed that these conditions need to be acted on as they are noticed by the City employees. 3) A member o:f a Community Committee noted to Hiemenz that there ar'e weeds in Pond View Addition on the vacant lots that need mowing. 4) Hiemenz discussed the letter that the Council received from Mrs. Hemmesch concerning the problems she has experienced from Terry Schmid's Company's construction of her townhome. Mayor Heber discussed that the City is only seeking information currently and that a contractor constructs what the specifications call for. OPEN TO THE PUBLIC: No one responded to the Mayor's request for public response. Loso made a motion to recess at 8:00 p. m. for 15 minutes; seconded by Hiemenz. Ayes: Reber, Rieke, Loso, Hiemenz, Ehlert. Nayes: None. Motion carried. Mayor Reber reconvened the meeting at 8: 15 p. m. Because more public was now in attendance, Mayor Reber again opened the floor to the public, but there was no public input. CLERK/ADMINISTRATOR REPORTS: 1) Berkley Administrators, the wor'kers comp insurance company, presented a proposal for various deductible amounts. After discussion Rieke, made a motion to accept the $5Ø0 deductible premium amounts; seconded by Loso. Discussion - after a year the history will be reviewed by the Council to reconsider deductible. Ayes: Reber, Rieke, Loso, Hiemenz, Ehlert. Nayes: None. Motion car:cied. 2) The City received a complaint of a fence being constructed with the less finished side to the adjacent property. Mayor Reber will Page 2828 July 20, 1995 discuss the issue with the fence owner to see if an acceptable agreement can be worked out. OLD BUSINESS RIGHT OF WAY PROPERTY: Stapleton discussed that the City Attorney has recommended the City :follow vacation procedures for consideration of releasing the triangle property on the corner of Minnesota Street West and Second Avenue Northwest. Hiemenz stated that the Design Team has recommended to retain this property :for community use. Rieke made a motion to table the matter until a later date; seconded by Loso. Ayes: Reber, Rieke, Loso, Hiemenz, Ehlert. Nayes: None. Motion carried. DOG ISSUE: Councilor Hiemenz stepped down :from his chair at 8:40 p. m. Mike Hiemenz appeared before the Council and discussed that his dog got away because he was enticed by the neighbor children to play with them. A neighbor locked the dog in a garage and then called the police to pick it up. He :felt this was un:fair. He also questioned the manner that the police handled the situation. He also stated that he has taken measures to contain the dog within his yard so that it will not run away again. After :further discussion Loso made a motion to split the cost o:f the boarding fee :for the dog with Mr. Hiemenz, waive the $25 pickup :fee, and get more in:formation from the police of:ficer. The motion was seconded by Rieke. Ayes: Reber, Rieke, Loso, Ehlert. Nayes: None. Motion carried. Councilor Hiemenz resumed his chair at 8:50 p.m. ADJOURN: Loso made a motion to adjourn at 8:51 p. m.. ; seconded by Hiemenz. Ayes: Reber, Rieke, Loso, Hiemenz, Ehlert. Mayes: None.
