AGENDA: Rieke made a motion to approve the agenda

corrections to the minutes. Hiemenz seconded the

MINUTES: Rieke made a motion to approve the minutes of the December 7
meeting with a correction to the resolution adopting the 1996 Le~y and
Budget. The correct amount of the General Fund Levy is $246, 372,! which
makes the total levy for 1996 $274,372. The motion was seconded by
Hiemenz.
Ayes: Reber, Rieke, Loso, Hiemenz, Ehlert.

BILLS PAYABLE: Rachel Stapleton presented the bills payable check
numbers 21871 - 21892 with overtime and call outs. After a short
discussion of various bills Loso made a motion to approve the bills
payable, overtime and call outs as presented; seconded by Hiemenz.
Ayes: Reber, Rieke, Loso, Hiemenz, Ehlert. I

Bradley Lindgren, Chief of Police, prekented

and discussed the monthly police report, and presented a Christmas card
received by the Police Department from the "stucco House" tenants, a
student rental. I
Loso made a motion to approve 99 car washes at $1.75 each, total cost
$188.00; seconded by Hiemenz. '

DEPARTMENT HEAD REPORTS:
Hiemenz made a motion to approve the purchase of seven cases of
ammunition for the yearly duty and practice needs of the Department at
$115 per case, total cost $805; seconded by Loso.
Ayes: Reber, Rieke, Loso, Hiemenz, Ehlert.
Mayes: Mone. Motion carried.
Lindgren also reported that he had contact with Mike Rajkowski.
Rajkowski previously represented the City as the prosecuting attorney,
(prior to his changing law firms) and expressed interest in renewing
these duties for the City. Currently the prosecuting attorney's fees

are about $3,0Ø0 per month.
The Montgomery Jaycees sent a $1,000 donation which they had previously
indicated would be donated to the City of St. Joseph for police
equipment.

MAYOR REPORTS: 1) Cold Spring dropped out of the St. Cloud Area
Economic Development Partnership because 1-94 tends to be the stopping
point for new development. Mayor Reber also presented information on
labor statistics in the St. Cloud area.
2) Methods of controlling offensive odors from manure used for
fertilizer on farm land within the City needs to be considered.
Stapleton will check with the League and other departments as required.
3) The Attorney General's Office is nearly ready to release funds for
the St. Augusta Landfill cleanup.
4) A coalition has been formed to review the highway funding for our
area with the intention of proposing a more equitable formula.
LIQUOR LICENSE TRANSFER: Todd Fultz appeared before the Council
requesting approveal to transfer the liquor license of B1P Inc. d/b/a
Sal's Bar & Grill to Todd Fultz d\b\a Sal's Bar & Grill. Loso made a
motion to approve the transfer as requested contingent upon receiving
proof of the necessary insurance and bond coverage and completion of
the transfer of the business from the present owner to Todd Fultz. The
motion was seconded by Ehlert.

COUNCILORS REPORT
RIEKE: 1) The CORE Committee met and set the date for the February
Speakout for February 20 to be held at CSB.
2) Rieke received a complaint of noise and speed from snowmobiles.
Ehlert stated the Sno-Joes expect to install more speed control signage
and monitor snowmobile traffic through the City. Council also
discussed enforcement by the police and assistance from the Sno-Joes.
EHLERT: 1) Ehlert reported on an information gathering meeting
sponsored by the St. Cloud Times. The Times would like to get more
coverage of the area cities that extend out from St. Cloud. The
newspaper hopes to have this additional coverage in place by spring
early summer.

2) Students had approached Ehlert concerning a block party proposal,
which he took to Chief Lindgren. The matter is simply a proposal
brought up at the CORE Committee meeting.

LOSO: 1) Loso received calls from citizens concerned about driveway
parking problems sidewalks may cause on East Minnesota Street.

2) The Township property owners and residents in the area to
have questions concerning the time schedule for annexation.
recommended making annexation as expedient as possible.
3) Loso requested to review the snow parking policy sometime in the
future. !
4) A committee including Lions members met to discuss the Morningside
Park walking trail project, grant and matching funding, and future
construction and funding plans. The Lions members indicated interest
to support the park projects. Also the Rod and Gun Club will consider
assisting in funding the park projects. City Engineer Joe Bettendorf
waived the costs of all the background work and plan preparation ~or
the park projects. .

HIEMENZ: 1) Several businesses extended a thank you for the excellent
job of snow removal. They appreciated it being removed early. I
2) There is a survey being circulated asking for opinions concerrling
the various parts of the East Minnesota Street project. It appe~rs
that some of the affected property owners feel they were not properly
involved in the planning process.
3) Hiemenz discussed a meeting he attended concerning property rights
and compensation for taking issues. I
4) The Star City has prepared an EDA resolution and request apprlval
for the City Attorney to review it, prior to consideration by the
Council. Ehlert made a motion to approve attorney review of thel
proposed EDA resolution as requested; seconded by Rieke. I

CITY ENGINEER JOE BETTENDORF REPORTS I

PUMPHOUSE NUMBER 2 REHABILITATION: Loso made a motion to approve
Application for Payment Mo. 2 (Final) to Preusser Construction, Inc. of
$4,951.20 as presented; seconded by Rieke. Discussion - Payment will
be contingent on verification of meter calibration. I
Ayes: Reber, Rieke, Loso, Hiemenz, Ehlert. '

WATER PLANT PROJECT AND WELL NUMBER 5: Recommendations from Leo Sadlo
and Joe Bettendorf were to take well number one out of service and
install another well in order to have more than two sources of water.
Loso made a motion to approve incorporating construction of Well Mumber
5 in the water project; seconded by Hiemenz. Discussion - Council
discussed if this well was already included in the financing prpposals.

EAST MINNESOTA STREET: Bettendorf questioned if concerns were being
received on this project, of such a nature to hold up the project.

assistance are available they would be considered. The benefits of
including Morningside Park Improvement with the East Minnesota Street I
bids were discussed. Rieke stated that the Council needs to respond
responsibly, because this is a good and necessary project and the City
needs to move forward with it. There will be a certain amount of
adversity to any project. Council generally concurred to move forward
with the project.
OPEN TO THE PUBLIC: Art Reber expressed concern for speed and manner
of operation of snow mobiles on the trail by his residence. Council
agreed that enforcement is a problem but measures will be taken to
enforce speed limits, both through the Police Department and the Sno-
Joes.
CLERK/ADMINISTRATOR REPORTS: 1) Stapleton discussed the property
liability insurance premium and optional coverages. Loso made a motion
to approve payment of $24,815 insurance premium, and approve a blanket
Faithful Performance Bond premium of $660, to COver all City Officials,
and Open Meeting Law coverage premium of $500. The motion was seconded
by Rieke.

Stapleton also introduced excess liability coverage (umbrella). Mayor
Reber requested the City Attorney advise the City on this matter.
2) The Township notified the City that it is in agreement to proceed I
with the development plans of the Roske Addition. Rieke made a motion
to notify the City Engineer to proceed with development plans as
mutually agreed upon by the City and Township. The motion was seconded
by Hiemenz.

CRIMINAL PROSECUTION PROPOSAL: Mike Rajkowski presented a proposal for
representing the City in criminal prosecution. He would provide this
service for a flat rate of $22,000 for 11 months to be billed monthly
at $2,000. This proposal would begin service on February 1. He stated
he is familiar with the City and has worked with the Police Officers
previously in this capacity.
Mayor Reber stated the City would want to request the same offer from
our current firm because our loyalty lies with them, and we have been
pleased with their work. Rieke recommended getting a counter proposal
from our current firm. Hiemenz stated going with this firm would
expand our resources. He also questioned what type of increase could.
be expected at the end of the contract period. Rajkowski stated the
fees are based on past history of the work load. He did not expect
fees to increase drastically, but would increase fees slightly if
circumstances under this proposal would cause the firm to lose money.
The Council thanked Mike Rajkowski for his proposal.

NEW COKER PACKETS: Mayor Reber read a letter from Gregg Reinhart
commending the Chief of Police for offering his department to take on

the duties of deLivering new comer packets to new' residents to lour
community. Chief Lindgren also stated he recently purchased a carbon
monoxide detector for the city hall because the furnace has been
malfunctioning.
