Joseph met in session on Thursday, July 18, 1985 at 7:30 p.m. in City Hall. Members Present: Mayor Mike Loso; Councilmen: Bud Reber, steve Dehler, Leo Sadlo, I Ross Rieke; City Clerk, Bob Johnson. others Present: Engineer Joe Bettendorf; Bob Walz, Courier Editor; steve Schirber, resident. Engineer Reports: Engineer Bettendorf presented bid tabulations, cost estimate change and other pertinent data relating to the Park Terrace Addition Improvement Project. Bids received were: 1) Hardrives, Inc., st. Cloud -------- $153,534.46 2) Bauerly Bros., Sauk Rapids -------- 166,377.10 3) Channel Construction, Inc., Isle -- 172,269.40 Project expected to be contained in the original $182,000 estimate. Replacement of defective water main shut-off valves to be included in project. Motion of Award: A motion was made by Dehler seconded by Reber to accept the low bid of Hardrives, Inc., st. Cloud. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None Motion carried. Assessment Hearing: A motion was made by Sadlo seconded by Rieke to re-schedule assessment hearing for August 15, 1985 on the Park Terrace Improvement Project. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None Motion carried. I Tennis-Basketball Court: A request from the Park Commission to obtain an estimate of cost to re-surface the tennis court in Memorial Park to be used for tennis and basketball will be considered. An estimate of cost will be obtained from the Engineer's office. Force Main - Wastewater: A brief discussion about wastewater force main location and direction was held with engineer. Minutes: A motion was made by Dehler seconded by Reber to approve the Council minutes of July 3, 1985 as presented. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None Motion carried. Rental Housing Hearing: The Gamades rental housing hearing was opened by Mayor Loso at 8:00 p.m. and turned over to Attorney Fred Grunke, representing the City of st. Joseph. Attorney William schroeder was present and spoke on behalf of Robert and Mary Gamades. The hearing was scheduled after a third possible rental housing violation (Noise Ordinance) had been recorded by the st. Joseph Police Department for property located at 111 College Avenue North. Attorney Schroeder indicated owners had 16 other rental units in the city - this was the first incidence of violation. Schroeder also stated the owners were not in a position to deny the allegations. Attorney Fred Grunke called Officer Young to testify and present evidence of the I violations as recorded by the Police Department. Steve Schirber, neighbor, also testified and indicated there were many more incidents of possible violation that were never reported. Schirber also stated he was interested in owner taking some action and not in a revocation of their license. 16)00 _ UcJ!Ù A motion was made by Councilman Dehler, seconded by Councilman Sadlo to suspend the rental housing license of Robert and Mary Gamades, for the proporty located at 111 College Avenue North in the City of st. Joseph, for a period of 60 days, effective July 18, 1985, with early re-instatment in 30 days. The property is hereby placed under a one-year probation and requires documentation of an improved owner-renter lease agreement with a copy submitted to the City of st. Joseph. One officially recorded complaint during the probationary period will result in a scheduled hearing before the city Council. Voting for the above motion: Loso, Reber, Dehler, Sadlo, Rieke. Voting against motion: None. Motion carried. (This rental housing violation hearing was tape recorded.) A motion was made by Sadlo seconded by Rieke to close hearing at 8:53 p.m. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None Motion carried. (Copies of resolution to be submitted to: Mary Gamades; Attorney's Schroeder and Grunke; Steve Schirber and Art Reber.) (Council recessed at 8:56 p.m. - reconvened at 9:05 p.m.) NSP: Norm Ecklund, NSP representative, appeared to present NSP franchises, electric - and gas, for renewal. A motion was made by Reber seconded by Sadlo to renew both NSP franchses as: Ordinance No. 1985 - electric; Ordinance 1985-A for gas. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None Motion carried. Police Policy Additions: Proposed additions to police department policies adopted by Council after review were: 1 ) Misconduct Allegations - order No. 130.0-130.07 2) Disciplinary Procedures - Order No. 131. 03-131. 09 3) Use of Force - Order No. 133.01-133.07 The above policies were adopted on motion by Dehler seconded by Rieke. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None Motion carried. Housing Classification: Classification change to duplex to be reviewed on single family residence located at 114 East Minnesota. Former owners: Utsch, Peep, Belford, Sand. Matter to be reviewed with City Attorney. Dale Schneider - Fence Permit: A motion was made by Reber seconded by Sadlo to approve a permit to install fencing to enclose an outdoor type beer garden according to City regulations and stipulations of Planning Commission: no bar, no drinks served, no music played. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None Motion carried. Council Reports: (Sadlo) - Presented water pumping report: 500,000gallons per day. May soon need sprinkling ban. Presented two applications for fire department membership: John Meyer and Bill Lowell Jr. A motion was made by Rieke seconded by Sadlo to approve applications. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. I Nayes: None Motion carried. (Reber) - Reported complaint received: 1) body shop - spray painting - air hammer at night in a R-l residential district. Building inspector to be directed to investigate - Police department investigate junk cars. 2) rifle shooting in City complaint presented (July 5th). _33Ll . (Rieke) - Chamber of Commerce representatives on next agenda. (Dehler) - 1) Rec. Assn. meeting report presented. 2) Loans to other organizations possible. I 3) Drainage improvements. 4) Monkey rings in parks. 5) Outdoor vendors - 4th of July - a problem. 6) Church fencing on College - replace on church property. 7) Funeral home parking - off street. Mayor Report: 1) Meeting of Hanson (APO ) , Rice (County) expected in near future regards signal lights on County Road #75 and #2. Funding available (F AU) . APO preparing a preliminary plan for review. 2) Meeting with Police Department held relating to: a) noise ordinance procedures b) warnlngs c) phone calls to owners - numbers to be obtained d) RCR reporting procedures reviewed - Chief to approve reports - make necessary corrections d) log keeping Adjournment: Motion to adjourn made at 10:55 p.m. Ayes: Loso, Reber, Dehler, Sadlo, Rieke.
