Joseph met in session on Thursday, October 3, 1985 at 7:30 p.m. in City Hall. Members Present: Mayor Mike Loso; Councilmen: steve Dehler, Leo Sadlo, Ross Rieke; City Clerk, Bob Johnson. (Absent: Councilman Bud Reber, working out of town.) Others Present: Kathy Bruns, Courier Editor; approximately 12 st. John's students; John Scherer, Attorney; Chief of Police Lorentz; Patrolman Pete Jansky; Patrolman Jeff Young; Elmer Rakotz. Council Minutes: The Council minutes of September 5 and September 19, 1985 were approved on motion by Sadlo seconded by Rieke. Ayes: Loso, Dehler, Sadlo, Rieke. ¡ Nayes: None Motion carried. Bills Presented: Bills were approved for payment as presented on motion by Sadlo seconded by Dehler. Ayes: Loso, Dehler, Sadlo, Rieke. Nayes: None Motion carried. Park Terrace Project Payment #1: The Park Terrace Improvement Project payment #1 was approved as recommended by Engineer Bettendorf, in the amount of $78,627.79. Ayes: Loso, Dehler, Sadlo, Rieke. Nayes: None Motion carried. Flow Meter Measuring Device: A quotation, in the amount of $12,795.00 for two flow meters (model 260), a portable processor, cable, software, paper, ribbons, 3 cassettes, Epson printer and cable mounting bands for 8", 10", 12" and 18" pipe, was received from Marsh-McBirney, Inc. for Council review and consideration. A question of permanent installation will be reviewed. The system is primarily being considered for College-Convent sewerage flow measurement. Council members, City employees and Dennis Jordan, st. Ben's, have viewed demonstrations of the system locally. st. Benedict's 45% Billing: A motion was made by Dehler seconded by Rieke to approve use of 45% as a participation ratio, on a temporary basis, for billing st. Benedict's for sewer project and plant operation and maintenance costs starting with operating cost period of July 1, 1984. The 45% participation ratio was recommended by Engineer Bettendorf after most recent analysis of water pumping records. Ayes: Loso, Dehler, Sadlo, Rieke Nayes: None Motion carried. Watertower Paint & Repair Epoxy Quote: A proposed contract and quote to paint the inside of the City water tank with 2 coats of epoxy and perform other related work was received and presented for Council review and consideration. The quote was in the amount of $8,200.00. If project is completed in 1986 the balance of the yearly maintenance cost would be $1,478.00 - a saving of $410.00 for the year. Westel, Inc. Cable Co.: A request for increase of rates on the following was received from Westel, Inc., City cable franchisee, to be effective December 1, 1985: Basic (expanded where applicable) $10.95 Remote control converter 4.00 Additional outlets 2.00 FM service 2.00 The rate change procedure requires the city to schedule and conduct a public hearing within 45 days after receipt of request. ~10/¡ C ~U7U A motion was made by Dehler seconded by Rieke to schedule public hearing. Ayes: Loso, Dehler, Sadlo, Rieke. Nayes: None Motion carried. 8:00 p.m. - Rental Housing Hearing: The scheduled hearing on a possible rental housing violation was opened by Mayor Loso and turned over to Acting City Attorney John Scherer. Dan Rebischke - manager of the property cited for possible violation, 314 Old Highway 52, appeared before Council to review complaints and possible violation. Rebischke questioned location of violation - informed police complaint records indicated Apt. 314 had the possible violation. Attorney John Scherer called officers Young and Jansky to testify and describe incidents recorded on 2/24/85, 9/02/85 and 9/07/85. Some of the renters (students) who were all present testified they cooperated with officers - did not realize loud music ívas playing in apartment as they were all out in back yard. Students also indicated they did not know about ordinance or February violation. Violation reports were filed as exhibits #1- #2 - #3. Motion by Dehler second by Sadlo to record that a violation did occur on dates recorded. Ayes: Loso, Dehler, Sadlo,Rieke. Nayes:None. Motion carried. Motion of Suspension: A motion was made by Dehler seconded by Sadlo to suspend rental housing license for 314 Old Highway 52 for a period of 10 months and stay enforcement of the suspension. If another violation occurs within the 10 months period, another public hearing before the City Council will be scheduled. Ayes: Loso, Dehler, Sadlo, Rieke. Nayes: None Motion carried. Landlord was advised to review ordinances and policies with renters. Hearing closed at 8:40 p.m. (tape recorded). Council recessed at 8:40 p.m. - reconvened at 8:55 p.m. Housing Inspector: Roman Reber, Building Inspector, appeared before Council and indicated the fee schedule adopted back in 1972 - that granted building inspector 50% of permit fees with a limit of $50.00 on anyone permit - was inadequate compensation for the job. The Council had previously approved appointment of Mayor Loso, Councilman Bud Reber and City Clerk Bob Johnson to serve on a com- mittee to review permit fees and compensation schedules. City Clerk to examine and review statements presented by the building inspector. Final reports ívere not complete at this time. The Building Inspector was instructed by Mayor to submit a request for compensation and other equipment that he considered necessary. st. Benedict students: Ka ty otting, President of student Government; Angie Andrist, Kathy Steffl, st. Ben's, appeared before Council. The girls indicated they thought the rental housing and noise ordinances ívere good. They wanted Council to know that not all of st. Benedicts was in opposition. They also stated they considered one violation enough for suspension and that allowing three violations was very generous. The girls also indicated they wanted to improve communications between city and student body. Students have a need for more information. Nayes: None Motion carried. Garbage Pickup 1986: A discussion of garbage pickup service for 1986 was held. Copy of the 1986 Park Refuse proposal of a 50¢ per account per month increase was received and reviewed. Motion to Bid: A motion was made by Rieke seconded by Sadlo to call for bids on 1986 garbage pickup. Ayes: Loso, Dehler, Sadlo, Rieke. Nayes: None Motion carried. Dale Schneider Outside Permit: Copies of a letter from Atty. Scherer regards Dale Schneider outside beer garden operation were presented to Council. State Revenue Report: Council received copies from League of Cities, dated Sept. 27, 1985, indicating a possible State Revenue shortfall may occur and affect the budget of cities in 1986. Council Reports: (Sadlo) - Roof repair question - pumphouse #2 - work to be completed before winter - maintenance getting quotes. (Rieke) - Reported landlord meetings are taking place - may be invited - also he had visit from renters of 314 Old Hwy. 52 - students - regards possible violation. (Dehler) - Questioned certifications. certifications were for levy, specials and delinquencies only. Mayor Report: Mayor Loso presented a request for fire chief attendance at convention in Duluth - Oct. 23-24-25. Motion to approve by Dehler seconded by Sadlo. Ayes: Loso, Dehler, Sadlo, Rieke.
