Pursuant to due call and notice thereof the City Council of the City of st.
Joseph met in session on Thursday, March 20, 1986 at 7:00 p.m. in City Hall.
Members Present: Mayor Mike Loso; Councilmen: Bud Reber, steve Dehler, Leo Sadlo,
Ross Rieke; City Clerk, Bob Johnson.
Others Present: Marlin Boeckmann, consultant; Kathy Bruns, editor-reporter, st.
Joseph Courier; Bill Lowell Sr.; Marl Gretch; Greg Kacures; Iver Linnemann;
Renee Tobin, C/ A applicant.
Clerk/Administrator Resume-Applications: The consultant and Council reviewed Clerk/
Administrator position resume/applications received from 51 applicants.
Council-Consultant committee selected the following applicants for interview:
#26 - Rachel stapleton, Sisseton, S.D.
#34 - Anthony F. Hallman, Three Lakes, WI
#47 - Shirley Dove, Morton, MN
#49 - Larry Bethel, Sauk Centre, MN
Council also to consider reducing the number to 2 after the first interview
and scheduling a second interview for the two applicants selected. Interviews
to be scheduled for evenings of March 24 and 25th if possible.
Consultant Boeckmann suggested committee consider questions for interview in
the following areas: a) public relations capabilities
b) character
c) interest in community
d) strength (fair & firm)
e) accounting background
City Clerk instructed to arrange interviews and scheduling.
Minutes Approved: The Council meeting minutes of March 6, 1986 were approved on
motion by sadlo seconded by Dehler.
Ayes: Loso, Reber, Dehler, Sadlo, Rieke.
Nayes: None Motion carried.
License Agreement with st. Cloud Township: with regard the license agreement with
st. Cloud Township for the right to enter upon Township land during construction
of force main to waite Park lift station, Acting City Attorney John Scherer
recommends placing a limit on legal expenditures the Township could charge the
City of st. Joseph for review of the license agreement. Mayor Loso to discuss
matter with Township Board Chairman, Marlyn Libbesmeier.
8:00 p.m. Liquor Hearing: The hearing on possible liquor ordinance violation by the
EI Paso Club, Inc. was opened at 8:00 p.m. by Attorney Scherer.
possible violation: the presence of five persons in the bar after hours.
Carole and Denny Tamm and Tim Borresch, bartender, were present and represented
the EI Paso Club & Lanes, Inc. Question of alcohol being displayed by patrons
after hours was disputed by Denny and Carole Tamm (also Borresch). Tamm displayed
indentical bottles of beer and mineral water.
Officer Young testified, in his opinion, it smelled like beer. No evidence was
taken by Officer Young.

Due to the fact that no evidence was secured by the officer, Mayor Loso moved
that the charges against the EI Paso, Inc. be dismissed, the motion was seconded
by Sadlo.
Ayes: Loso, Reber, Dehler, Sadlo, Rieke.
Nayes: None Motion carried.
Hearing adjourned at 8:30 p.m. (Hearing was taped - #348 side "A").
La Playette, Inc. Liquor Hearing - 8:30 p.m.: The liquor hearing on possible violation
at the La Playette, Inc. was opened at 8:30 p.m. with Attorney Harry Burns, Jr.
representing the La Playette, Inc. Attorney Burns had requested an evidentiary
hearing.
City Attorney John Scherer submitted exhibits A-B-C, statements of persons involved
in possible violations of sale to minors.
Donald Macadanz, 18 years of age, testified that he didn't remember being checked
for an ID at the La Playette entrance. Attorney Burns stated that information
from state indicated illegal consumption must be observed on premises. This did
not happen in this case.
Problems of carding (checking IDs, etc.) when crowds of up to 600 students are
constantly leaving and entering were reviewed. Police Chief Lorentz indicated
minors had been charged for violations.
Motion: A motion was made by Reber seconded by Sadlo to consider three possible viola-
tions as one.
Voting for motion: Dehler, Loso, Reber, Sadlo.
voting against motion: Rieke. Motion carried: 4-1.
Motion: A motion was made by Dehler seconded by Rieke to establish that a violation
did occur.
Ayes: Loso, Reber, Dehler, Sadlo, Rieke.
Nay e s : None Motion carried.
The question of a monetary penalty (such as a $300.00 fine) in place of possible
suspension received some consideration.
Motion: A motion was made by Loso seconded by Sadlo to suspend the La Playette, Inc.
liquor license for one day and stay execution of suspension for six months, if
no violations occur during the period of suspension. Possible violations pending
do not apply.
Voting for motion: Sadlo, Reber, Loso.
Voting aginst motion: Dehler.
Abstaining: Rieke. Motion carried 3-1.
Chief Lorentz recommended voiding liquor ordinance and allowing Police Department
to operate under State Statute and letting court make decision rather than City
Council. Mayor Loso instructed Chief Lorentz to submit recommendation in writing.
Council meeting adjourned for 5 minutes at 10:00 p.m. (tape s top at #350).
Council reconvened at 10:15 p.m.
Rental Housing possible Violation: A motion was made by Dehler seconded by Rieke to
schedule possible rental housing violation for April 7, 1986 at 8:00 p.m.
(Gamades property - 111 College Avenue North.)
Ayes: Loso, Reber, Dehler, Sadlo, Rieke.
Nayes: None Motion carried.

Rental Housing Policy Change: A motion was made by Dehler seconded by Rieke _cUu
to make the following rental housing violation policy change effective
September 1, 1986: a) 1st recorded violation - owner to receive a letter of
warning from Police Department.
h) 2nd recorded violation - Police Department shall notify
City Clerk's office / City Clerk will schedule hearing.
The violation policy period shall extend from September 1 to September 1 the
following year.
Ayes: Loso, Reber, Dehler, Sadlo, Rieke.
Nayes: None Motion carried.
Tri-County Food Shelf: Notice has been received that Kennedy Elementary PTA will
attempt to form a human chain on April 5, 1986 at 8:00 a.m. on Minnesota Street
from the Tom Thumb store to 1-94 over-pass in support of the Tri-County Food
Shelf program. The chain will be formed on the south side of Minnesota Street.
A motion was made by Dehler seconded by Reber to support program. City Clerk
to advise Police Department.
Ayes: Loso, Reber, Dehler, Sadlo, Rieke.
Nayes: None Motion carried.
Request for Police Vehicle Repair: A motion was made by Rieke seconded by Dehler to
approve repair of police vehicle transmission. Chief to obtain 2 quotes or
estimates.
Ayes: Loso, Reber, Dehler, Sadlo, Rieke.
Nayes: None Motion carried.
Gambling License Application: On motion by Reber seconded by Dehler the Council approved
review of the Lions Club gambling license application to be submitted to State.
There were no objections presented.
Ayes: Loso, Reber, Dehler, Sadlo, Rieke.
Nayes: None Motion carried.
Council Reports: (Sadlo) Engineer proceeding with contract preparation relating to
Well #2 treatment project. Sadlo, Taufen and Engineer surveyed City for new
well location.
(Reber) Indicated need for filing cabinet for building department. will
appropriate one from City Hall meeting room (not in use).
(Rieke) Cable Board meeting next Thursday. Commission to revi~w access channel
use, policies and proceedures.
Mayor: Presented hall project committee report. A motion was made by Rieke seconded
by Sadlo to approve payment of hall project to Backes Construction as determined
by Committee in the amount of $5,702.40 after deducts.
Ayes: Loso, Reber, Dehler, Sadlo, Rieke.
Nayes: None Motion carried.
winter Parking Ban Lift: A motion was made by Rieke seconded by Reber to lift winter
parking regulations effective immediately. (Notice to Police.)
Ayes: Loso, Reber, Dehler, Sadlo, Rieke.
Nayes: None Motion carried.
Police Officer Reprimand: The Council directed the City Clerk to send notice to
Police Chief that Police Officer Jeff Young be issued a 'reprimand of record'
for his insubordinate conduct (snickering and laughing) at the close of the liquor
hearing held on March 20, 1986 at 8:30 p.m.

Adjournment: On motion by Sadlo seconded by Reber the Council adjourned the meeting
at 11:10 p.m.
Ayes: Loso, Reber, Dehler, Sadlo, Rieke.
Nayes: None Motion carried.
