Joseph met in regular session on Thursday, May 15, 1986 at 7:30 p.m. . Members Present: Mayor Mike Loso; Councilmen Bud Reber, steve Dehler, Leo Sadlo, Ross Rieke; Clerk/Administrator Rachel Stapleton. Minutes: Minutes of the May 1 City Council meeting were approved as presented with a motion by Sadlo; seconded by Reber. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None Motion carried. Salaries: A motion was made by Dehler to increase the police reserves salary the same percentage as the regular city employees were raised; seconded by Reber. Mayor stated motion was nul and void as per notice City received from Bureau of Bills:Mediation Services. Dehler withdrew motion; and moved to approve the bills as presented; seconded by Rieke. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None Motion carried. EPA Wastewater Project Grant: Mayor was notified that the EPA Wastewater Project grant was approved and the City will proceed witht the project. Retail Beer License: st. Joseph Parish 4th of July application for outdoor beer license approved with a motion by Dehl"er; seconded by Reber to approve the license provided parish provides four security guards and proof of liquor liability insurance if required by state Law and no beer leaves the premises. Ayes: Loso, Reber, Dehler, Sadlo. Nayes: None. Rieke abstained. Motion carried. Summer Aides: City should receive two maintenance aides and two recreation aides, one at 50% city obligation through State programs. Population: Estimate from State Demographer, 3140. Motion to change on st. Joseph signs by Dehler; seconded by Rieke. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None Motion carried. Dehumidifier for City Hall Annex basement. Motion to approve purchase from Sears for $255.38 by Reber. Seconded by Sadlo. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None Motion carried. Bond Issue - Notification of paying agents fees increase - will check into further and see what this entails. Noise Complaint Hearing: Was held at 8:00 p.m. to determine if a violation of the probation from July 18 of 1985 did occur at address 111 College Avenue North, Robert & Mary Gamades, owners, on March 9, 1986. A court reporter recorded this hearing. (1.11": Ms. Kim Pennington, Counsel for Gamades, offered settlement to the City; City Council requested full hearing. Tamera Schirber - Next door neighbor, stated night of March 8-9, 1986 loud party audible in their house and louder when door opened at 111 College Ave. N. She asked them twice to quiet down. Steven Schirber - Next door neighbor, stated noise, fighting, yelling and crudity, 18Qii _L '- U _.!. kept him awake on May 8th, from house in question. Kept children and himself awake. Called the police and gave statement on April 10, 1986. Peter Jansky - Officer ansewered call about 2:30 a.m., music got louder as he got closer to house, could hear it on the sidewalk, 20-30 feet from the house. Asked them to reduce the noi se or he \1Í 11 have to break up the party - had a complaint. Art Reber: Neighbor across street - remembers a party, not sure of the date. Noise problem from this place about the same as last year. Patricia Hynes: Hadn't seen lease form before, nor signed lease. Had gathering on l\Iarch 8, 25-35 people and approximately 15 in basement. She felt it was a neighbor problem. She turned off music when officer came. Mrs. Gamades had told them "no loud parties allowed". Recess at 8:45 p.m. - Reconviene at 8:52 p.m. Mary Gamades - stated these aren't the same tennants as lived there when proba- tion started. stated she told these tennants no noise problems allowed or would be evicted. Didn't have signed lease. She knew of no other noise problem with these tennants. Resolution: Be it resolved, by the City Council of the City of st. Joseph, Minnesota that: there did occur a violation of probation, grounds - failure to provide written lease agreement; motion by Reber; seconded by Dehler. Ayes: Loso, Reber, Sadlo, Dehler, Rieke. N aye s : None Motion carried. Resolution: Be it resolved, by the City Council of the City of st. Joseph, Minnesota that: there did occur a violation of noise ordinance with respect to the land- lord, grounds - neighbors statements, loud music and noise. Motion by Reber; seconded by Sadlo. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Naye s : None Motion carried. Motion by Sadlo that City Council take under advisement and pass judgement at a later date; seconded by Reber. Discussion - nothing would be gained by waiting. Ayes: None Nayes: Loso, Reber, Dehler, Sadlo, Rieke. Motion Failed. Resolution: Rieke moved to accept offer of $150.00 to assist in expenses of hearing and give copy of written lease agreement to the City and on any receipt of all verified noise complaints on this property, the City shall notify both the tennant and landlord within 48 hours, and within 48 hours the tennant must meet with City officials, if not resolved, the city will notify the landlord who must begin eviction prodeedings within 48 hours against the tennants; seconded by Sadlo. Ayes: Reber, Sadlo, Rieke. N aye s : Loso, Dehler. l\lotion carried. stearns County - Board of Health: Agreement to allow city to use certain equipment for emergency serVlces. Motion to approve Dehler, seconded by Sadlo. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None Motion carried. Seal Coat Bid Opening: Changed to May 29. Recess at 9:51 p.m. - Reconviene at 9:55 p.m. lr¡n~ t)Vu Computer: Marlin Boeckman discussed with the Council the proposed computer. Discussed hardware and software. Dehler moved Mr. Boeckmann and City Clerk/Administrator seek out and put computer system on line by approximately July 1, and include maintenance, all by quotes to get the most economical agreement within the - budget guidelines set by the City; seconded by Rieke. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None Motion carried. License Agreement: st. Joseph City and st. Cloud Township. Reber moved to approve the License Agreement for the Wastewater force main project, seconded by Sadlo. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None Motion carried. Clerks Orientation: Motion to allow City Clerk/Administrator to attend Clerk's orientation was made by Dehler, seconded by Reber. , Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None Motion carried. Councilmen Reports: Sadlo: The fire contract with st. Joseph Township will be ready for City Council approval in June. . Reber: The shooting range issue has been settled. Dehler: Parks Commission meeting brought up the following issues: 1) Allow cattle in Morningside Park. 2) Park shelter rents, consider damage deposit. 3) Shooting range information - Mayor requested Park Commission prepare a proposal, for use of the shooting range, for the Council to consider. 4) Water for hill slides in Tot Lots. 5) Quote for building hills. Tot Lots: Reber moved to accept the quote of Felix Excavating, to build two hills for sliding in the Tot Lots, of $1,040.00 apiece or $2,080 for both; seconded by Rieke. Ayes: Loso, Reber, Dehler, Rieke. Nayes: None. Sadlo abstained. Motion carried. Millstream Park: Need about 20 yards - $80.00 worth of washed sand in Millstream Park, moved by Loso to purchase; seconded by Rieke. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None Motion carried. Mayor's Report: The Police Department patrolmen have procurred the services of a federation for collective bargaining.
