March 19, 1987 I Pursuant to due call and notice thereof, the City Council for the City of St. Joseph, Minnesota met in regular session on Thursday, March 19, 1987 at 7:30 p.m. in City Hall. ~êmQêr§ rrê§ê~~~ Mayor Mike Loso; Councilmen Bud Reber, Steve Dehler, Leo Sadlo, Ross Rieke. Judy Weyrens, Adm. Secretary. º~h§rª rrêê~~~~ Kathy Bruns, Greg Kacures, Bob Lyon, Ann Johnson, Lee Kapsner, Iver Linnemann, Art Reber, Dale Salo, Harvey Schmitt, Louie Walz. ~!~Y~ê§~ Minutes of the March 5th meeting were approved as corrected with a motion by Dehler; seconded by Rieke. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None. Motion carried. ºQª£ê~i~Y ºrQ!~ª~£ê rrQEQ§êQ~ Ann Johnson appeared before the Council to ask that the City to look into the possibility of adopting a resolution to encourage the area businesses to refrain from the promotion, rental, or sale of pornographic material. The mayor discussed that if the City decided to adopt an obscenity ordinance, it should be one that the City I could enforce. Rieke made a motion to have the City Attorney look over the submitted sample and draft an enforceable ordinance; seconded by Reber. Ayes: Loso, Reber, Sadlo, Rieke. Nayes: Dehler. Motion carried. ºªlê §ªlQ~ Mr. Salo presented a petition for annexation for the SE quarter of Sec. 10, Cloverdale Estates, 2nd addition, known as Outlot A. Rieke made a motion to approve the petition, subject to approval of the municipal board and the waiver of any objection by the township; seconded by Reber. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None. Motion carried. Mr. Salo also requested the City to write three separate letters- 1. the city will maintain the streets, 2. the city will maintain the water and sewer lines, and 3. the city will provide adequate trash collection. These letters are needed to comply with the FmHA regulations. Rieke made a motion to have city clerk, write the above mentioned letters along with the advise of the City Engineer; seconded by Sadlo Ayes: Loso, Reber, Dehler, Sadlo, Rieke. I Nayes: None. Motion carried. ~º§ êê!1§~QQrf~ Mr. Bettendorf presented two alternatives to I provided sewer and water services to the proposed elderly housing project. Alternative 1 would extend the sewer and watermain directly south across the school district property. 1 d. r-~ 7 _ l '...-" . Alternative 2 would extend the sanitary sewer and watermain - west along the entrance road to Kennedy school and then êouth along the east side of county road 121. After a lengthy discussion, the Mayor and Council decided that alternative #1 was not feasible as far as the City is concerned, because if there were further development, the extension would not hold the volume, and they would have to re-dig the sewer and watermain. It was recommended by Mr. Bettendorf, and the Council that Catholic Charities go back to the person they purchased the land from and try to renegotiate. Mr. Bettendorf has some cosmetic changes to the developers agreement, but will present them at the March 25 meeting. In addition, the change order was tabled until the March 25 meeting. glêrßL~Qm~ BêEQr~~ Discussion about the length of City Council meetings lead to the following policy change: A motion was made by Sadlo to promptly begin the meetings at 7:30 p.m. with the first items on the agenda being the approval of the agenda, and the Mayor and Council reports, and the meetings will end at 10: 30 p. m. , with an extension, if needed, to finish the item being discussed (extension to be determined by the Chair, and no longer than 30 minutes) ; seconded by Reber. Ayes: Loso, Reber, Sadlo, Dehler, Rieke. Nayes: None. Motion carried. gQ!:!!}£il BêEQr~~ Sadlo presented a request by the Fire Department to approve Neil Loso as a fireman to fill the vacancy. Reber made a motion to approve Neil Loso as a fireman provided he passes the physical and completes the 6 month probation; seconded by Rieke. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None. Motion carried. Reber: Lions questioned whether or not they need to purchase a building permit to remodel the park shelter. Council decided they wouldn't need a permit, but they would have to have a contractors license which requires the contractor to be insured and bonded. Mr. Walz was present and he might be doing some of the work, and would like to know if it is necessary to be bonded and insured. The city will check with the attorney to check on liability if not insured and bonded. Dehler: Park Board is going through the process to hire a Summer Rec. Director and 2 Aides. They will present recommendations to Council for hire hopefully at the March 25 meeting. The summer program will be run through Dist. 742 as previous years, and they will provide 1 aide also. Rieke: Planning Commission heard two hearing on March 17 for Catholic Charities. The first was to re-zone the site from Public to R-3 multi dwelling. The second was for a variance to allow them to construct a 16 unit complex. The council decided to wait to approve the re-zoning and variance until Catholic Charities makes a commitment that they will be building. Doug Inselman is still questioning easement and would like city to determine if the pipe is located inside or out of the easement. ~QjQYr~m~~~~ Sadlo made a motion to adjourn at 10:25; seconded by Reber.
