Ayes: Loso, Reber, Sadlo. Nayes: None. Motion carried. ~ªª!~~ª!~r [ª£!li~Y ErQjê£1~ St. Benedict's were assessed I for six houses, the house in question is the Whitby house (sewer service is to City side and water service is on St. Benedict's side); this may be a negotiable item. Also, Sadlo noted there needs to be a second letter written to those property owners on city sewer and not on city water to clarify the need to put in a meter on their own water system. ºQQ~ Qf ºrQ!~ª~£~ê ~QQE~!Q~~ Sadlo made a motion to approve the Resolution adopting the Code of Ordinances for the City of St. Joseph; seconded by Reber. Theisen Variance: Reber made a motion, as recommended by the ------- --------- Planning Commission, to approve the requested variance of Sy Theisen, to allow up to nine unrelated persons to occupy his home at 119 Third Ave. SE. , for nine months only, from September 1 , 1987 to May 31, 1988 and because the house is large and has enough bedrooms to easily accommodate that number of people, and he will screen the renters closely because all his costly household goods will remain in the house; seconded by Sadlo. Ayes: Loso, Reber, Sadlo. Nayes: None. !1otion carried. Reber requested Maintenance Dept. apply calcium chloride early this year to control dust in alleyways. Rieke arrived at this time and discussed having the attorney advise on having Westel Cable Corp. put the $10,000 into an escrow account for future equipment purchase for the access channel. Council also discussed hazzardous private properties and allowable City proceedures to ensure the safety of them. (Lade & Borrasch properties). ~~£1~£ tl~ªriDg Q~ Street l@ErQY§@~~~ ~rQl~£~ Increase: A I ------ --------- public hearing was held at 8:00 p.m. to discuss the proposed increase in the Second Avenue Street Improvement Project. Joe Bettendorf, City Engineer, discussed increasing the project to include the block on 2nd Ave. between Birch Street and CSAH 75. The proposed assessments would be on curb and gutter and boulvard. The cost is estimated at $6.50 per running foot along the front of the project. The project is expected to be mainly completed by July 4. Questions: Marion & Claude Menzhuber and Carol and Denny Tamm's concerns were that they didn't feel the boulvard was necessary and who would be responsibility it is to maintain it. Answer: It is the property owner's responsibility to maintain the boulvard, and it is necessary to designate the traffic flow line and entrance and exit pattern from the street. Question: Carol Tamm questioned liability from accidents on the boulvard and the City Attorney stated that if it is a vehicle, the car's driver is probably responsible. Q. Who is responsible for maintenance of the boulvard and could a surface other than grass be installed? A. The property owner is responsible for maintenance of the boulvard and crushed rock or black top or concrete could be installed with the property owner bearing the difference of the cost over grass. I Q. Questions on loosing parking space and the width of the boulvard and street were asked and would like the boulvard abolished to use that space for parking. A. Parking will be parallel on the street by the curb. Mayor Loso stated that the street remain 66 feet wide and the J471 ~ boulvard will remain 11 feet wide which is city property. Q. Will the City require bumpers installed on the parking lot to keep the boulvard from being driven over? And will the City pay for them? A. Bumpers would be a good idea but the City cannot bear the cost of them. Q. What is the purpose of the curb and boulvard? A. To define the edge of the street, control where people drive, define property, and exit and entrances of traffic, for safety. Q. How wide will the entrances be, and who will determine were they will be? And how far will the curb go? A. Between 24 and 32 feet wide. The property owner may determine where they want the entrances providing they don't interfere with the hydrant. Also the curb will go around the radius only at the corner. Q. Why will we have to pay for the project when we don't want it? A. The property owners are really getting a deal on this project because you only have to pay the cost of the curb and gutter and not any cost to rebuilding the street. This also adds value to the property.. Q. Dave Hollander asked if the property owner would have to restore the boulvard after the City has torn it up? A. No, the project will restore the property.. Q. What about the pedestrians? A. No, sidewalks are planned, if they were they would be assessed to the property owner. There was much discussion on the 11 foot boulvard. Claude Menzhuber stated that he felt the 11 foot boulvard will be dead space and could be u~ed for parking. Joe Bettendorf stated the City is providing parking space for the park by making a parking lot in the Monument Park part of the project. Councilman Steve Dehler arrived at 8:40 p.m. and asked if angle parking was considered? Mayor Loso stated it was eliminated due to lack of space in the boulvard. Ken Twit asked if this street would continue to be a bus route? Mayor stated that we would like to see the buses use Minnesota Street West but cannot require that they use it, and are trying to look after everyone's best interests. Sadlo made a motion the hearing cease; seconded by Reber. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None. Motion carried. Motion carried. 1472 ~ ºb-ª!2~~ ºIº~I 111 Reber made a motion to approve change order #1, for the Second Avenue Street Improvement Project to increase it to include the block on Second Avenue between Birch Street NW and CSAH 75 at a cost of $27,206.10; seconded by Sadlo. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None. Motion carried. Reber made a motion to keep the curb as proposed by the El Paso and allow the property owners the option of gravel or black top in lieu of grass on the boulvard; Seconded by Sadlo. Discussion by Dehler on parking availability for Centennial Park which is City obligation. Ayes: Loso, Reber, Sadlo, Riek. Nayes: Dehler. Motion carried. Second Avenue NSP Pole: The Council discussed the light pole ------ ------ --- ----- on Second Ave. and Minnesota Street and the need to have the pole moved out of the HalkHay area. ºêY~12E~r~ª ðgr~êm~~~~ Joe Bettendorf also discussed the developers agreement with the Council. Dehler moved to adopt the developers agreement (format) ; seconded by Rieke. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None. Motion carried. Rieke made a motion to allow the City Engineer and Dick Taufen to work out minimum standards which will provide the City with standards for the delopers agreement; seconded by Reber. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None. Motion carried. Recreation: Dehler made a motion to approve Lori Linn as ---------- Summer Recreation Director as recommended by the Park Commission; seconded by Rieke. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None. Motion carried. Rieke made a motion to allow the JayCees to install the slides in the Parks for a $50 donation; seconded by Sadlo. Ayes: Loso, Reber, Dehler, Sadlo, Rieke.
