June 4. 1987 at 7:30 p.m. in City Hall. Members Present: Acting Mayor Donald "Bud" Reber; Councilmen Steve Dehler, Leo Sadlo, Ross Rieke. Clerk/Adm. Rachel Stapleton. Others Present: Fr. Richard Leisen, Harvey Schmitt, Mary Ann Krebsbach, Joyce Belford, Joe Fitzgerald, Mary Ann Fitz.l;erald. Nick Zakowski. Bob Johnson. Ed Kacures. Joe Bettendorf. Agenda Approval: Sadlo made a motion to approve the agenda; seconded by Rieke. Ayes: Reber. Dehler. Sadlo. Rieke. Nayes: None. Motion carried. Minutes Approval: Sadlo made a motion to approve the minutes of the May 14 and May 21 meetings; seconded by Dehler. Ayes: Reber. Dehler, Sadlo. Rieke. Nayes: None. Motion carried. ªil1§ EªYªQl~~ The Council discussed clarification needed for callout and comp time policy; Rieke made a motion to approve the bills payable as presented with the exception of Tree Stump Removal bill; seconded by Sadlo. Rieke: Catholic Charities had a re-zoning hearing, Planning Commission recommended to re-zone from R-l to R-3 the area proposed for the Elderly housin.l; apartments on West Minnesota Street; Planning Commission also recommended a variance to allow 16 units be built rather that the required limit of 12; Resurrection Lutheran Church had a hearing to allow a special use permit for a Church in an agricultural zone area, recommended passage by Planning Commission; Joint Powers Board met and allow re-zonin.l; in the Township of Kevin I Schirmers property from R-l to R-2. Qêhlêr~ Park Board has discussed the need to fix the fence at the Ball Park and could use existing posts; also discussed the need to put impact absorbing material under the playground equipment in Centennial Park. Motion carried. I Acting Mayor Reber: No report. Catholic Charities Elderly Housing: Fr. Liesen and Harvey Schmitt met with the Council to discuss the proposed elderly apartment project and recommendations of the Planning Commission. They discussed upgrading 4th Ave. by the project to City standards and agreed it should be done with the project and assessed to adjoining property owners. Dehler made a motion to allow the property to be re-zoned from R-l to R-3 to allow the apartments in the area because it is a desirable area for elderly apartments: seconded by Sadlo. Ayes: Reber, Dehler, Sadlo, Rieke. Nayes: None. Motion carried. Dehler made a motion to allow a variance as recommended by the Planning Commission which would allow a 16 unit apartment building rather than the 12 unit maximum which the ordinance calls for the following reasons: 1 ) because the majority of the units have one-person occupancy, the living density is very low: 2) surveys indicate a need for a senior citizen's apartment dwelling in St. Joseph; seconded by Rieke. Rieke made a motion to approve pay request #6 of Landwehr Heavy Moving. of $110.423.51: seconded by Sadlo. Ayes: Reber, Dehler, Sadlo, Rieke. Nayes: None. Motion carried. 2nd Avenue Street Improvement Project: Mr. Bettendorf discussed problems with the 2nd Avenue project and how they were handled. He also presented pay request #2 of Hardrives, Inc. Dehler made a motion to approve pay request #2 of Hardrives. Inc. for $55.172.32: seconded by Rieke. Ayes: Reber, Dehler. Sadlo. Rieke. Nayes: None. Motion carried. Park Terrace: Joyce Belford of lot 11, Park Terrace Add'n met with the Council to discuss her concerns relating to a 20 feet strip of property adjacent to Clinton Village which was offered to the property owners adjacent to it in Park Terrace in 1983. Her concerns were that the owner of her property at that time. chose not to purchase this parcel of land, the property owner next door to her. Ed Kacures. did purchase it. I does she have any recourse? Was it a legal sale? Since the City holds a utility easement what land use is allowed? Also discussed were the terms of the easement. Ed Kacures stated he has deed to the property in Question and did not have a building on the property. Joe Fitzgerald discussed numerous cracks he has noticed in Park Terrace in the driveways and l¿J03 _ X'L}o< streets. He will do a survey of them and report back to the Council. Resurrection Lutheran Church: Sadlo made a motion to approve the Special Use Permit as recommended by the Planning Commission to allow a church to be built in agricultural zoned area; seconded by Rieke. Ayes: Reber. Dehler. Sadlo. Rieke. Nayes: None. Motion carried. ð~~ª~21iQ~~ Dehler made a motion to approve Ordinance 1987 to annex a parcel of property as approved by the State Municipal Board which will allow the proposed Lutheran Church to be build within the limits of the City; seconded by Rieke. Ayes: Reber. Dehler. Sadlo. Rieke. Nayes: None. Motion carried. No. 1987 AN ORDINANCE EXTENDING THE CORPORATE LIMITS TO THE CITY OF ST. JOSEPH TO INCLUDE CERTAIN UNINCORPORATED PLATTED LAND (UNPLATTED LAND NOT EXCEEDING 200 ACRES IN AREA) ABUTTING UPON THE CITY LIMITS WHEREAS. a certain Petition for Annexation requesting annexation of the territory hereinafter described was duly presented to the council on the 5th day of March. 1987; and WHEREAS, the petition was signed by all owners; and WHEREAS. the Town Board of St. Joseph Township has waived any objection and no other municipality has boundaries which abut upon the boundaries of the land to be annexed; and WHEREAS, a hearing was duly held by the governing body of the City of St. Joseph. Minnesota. on the proposed annexation and the Township has waived the 90-day notice period; and WHEREAS, the land described in the Petition abuts upon the city limits at the south boundary thereof; The council of the City of st. Joseph, Minnesota, ordains: Section 1. The city Council hereby determines: (1) that the territory described herein abuts upon the city limits and is (is about to become) urban or suburban in character; and (2 ) that none of the territory is now included within the limits of any city. Section 2. Territory Annexed. The corporate limits of the city are hereby extended to include the unplatted land which is less that 200 acres described as follows and the same is hereby annexed to and included within the city as effectually as if it had originally been a part thereof: Part of Section 3, Township 124N, Range 29W, Stearns County. Minnesota. being at the place where State Aid lA :1 I ~. Road #2, meets Old state Aid Road #2, such point being the North Boundary line of the herein described tract, with the East boundary line going South along the boundary line of Old State Aid Road #2. a distance of 595 feet, thence at right angles to the West a distance of 360 feet to the East boundary line of State Aid Road Number 2, thence Northeasterly along said boundary of state Aid #2 to the place where State Aid Road #2 meets Old State Aid Road #2, the north boundary line being a distance of 80 feet, 3.00 acres, plus or minus, all in Stearns County, Minnesota. Section 3. Filing. The city Clerk is hereby directed to file certified copies of this ordinance with the Minnesota Municipal Board, the Secretary of State, the Town Clerk, and the County Auditor. Section 4. Effective Date. This ordinance takes effect upon its passage and publication and the filing of the certified copies as directed in Section 3, and approval of the ordinance by the Minnesota Municipal Board. Rieke made a motion to approve Ordinance 1987-A to annex a parcel of property as approved by the State Municipal Board which will allow the proposed Development of Outlot "A" to be known as Cloverdale Estates Third Addition, to be developed within the limits of the City; seconded by Rieke. A petition was presented as a request by Irma Hoffman, to annex her property to the City at Minnesota and Third Streets Northeast. The Council considered it and felt the other I propertv owners in the area outside the Citv limits should be asked if they also would like to come into the City at this time. Dehler made a motion to inform those residents on Third Avenue of the request to annex in their area and ask them if they wish to annex at this time; seconded by Sadlo. Ayes: Reber, Dehler, Sadlo, Rieke. Naves: None. Motion carried. Summer Employees: Rieke made a motion to hire Patrick J. Bozzo and Marcus J. Kuebelbeck. throu~h the Minnesota Youth Employment Program, for the summer as maintenance aides; seconded bv Dehler. Ayes: Reber, Dehler, Sadlo, Rieke. Naves: None. Motion carried. City Hall and City Hall Annex: Clerk discussed with the Council the need to improve the lighting in City Hall Annex, Council a~reed this was needed and should proceed with it; also discussed the need to check the condition of the windows in both buildin~s. Dehler made a motion that the Police Department would be required to put UP and take down the fla~ each dav which there is a police officer on duty, if flag etiquette does not allow it to be flown 24 hours per dav; seconded bv Rieke.
