Pursuant to due call and notice thereof. the City Council for
the City of St. Joseph. Minnesota met in regular session on
Thursday. Julv 16. 1987 at 7:30 p.m. in City Hall.
Members Present: Mayor Mike Loso; Councilmen Donald "Bud"
Reber, Leo Sadlo, Ross Rieke. Clerk/Adm. Rachel Stapleton.
Councilman Steve Dehler was absent due to being out of the
City.
Others Present: Ken Twit, Tom Klein, Mike Phillipp. Gary
Roquette, Dan Schroeder, Bob Fulton, Jackie Fulton, Darwin
Ericksen. Maurice Palmersheim. Walt Bruns. Mike Scherer, Anna
M. Scherer, Louie Walz, Larry Johanns. Dale Salo. Aloys G.
pfannenstein.
Agenda Approval: The agenda was approved as presented with
the addition of item lOb - Al Pfannenstein. St. Joe Meat
Market and four additions to the Clerk's report. with a
motion by Rieke; seconded by Sadlo.
Ayes: Loso. Reber. Sadlo, Rieke.
Nayes: None. Motion carried.
~i~Y~êª~ Minutes of the July 2 meeting were approved as I
presented with a motion by Sadlo; seconded by Reber.
Ayes: Loso. Reber. Sadlo. Rieke.
Nayes: None. Motion carried.
~ig~Q~ º~dinance: Amendment to the liquor ordinance which
clarified the time of opening allowed on Sundays to by 12:00
noon. was approved with a motion by Reber: seconded by Sadlo.
Ayes: Loso. Reber. Sadlo. Rieke.
Nayes: None. Motion carried.
Official Depository: Rieke made a motion to approve a
resolution allowing Piper. Jaffery. & Hopwood Incorporated to
be an official depository for deposits and investments as
allowed by State law; seconded by Reber.
Ayes: Loso. Reber. Sadlo. Rieke.
Nayes: None. Motion carried.
ºQY~£!l BêEQ~!ê~ (Sadlo) Recommend putting in valves on the
water main on 1st Avenue Northwest in conjunction with the
excavation for the utilities for the new Meat Market. Sadlo
made a motion to install valves on the water main; seconded
by Rieke.
Ayes: Loso, Reber, Sadlo, Rieke.
Nayes, None. Motion carried. II
(Reber) 1) Needed shelving in the City Hall storage room
could be installed for about $100. Will have Pete Giroux do
it.
2) Need to enforce no parking on sidewalk area by

Martini Mobil; Mayor will alert the Police Chief.
I 3) The new autobodv repair shop is filtering his paint
booth. This will control the emissions from his building as
he must meet state specifications and we can exceed them.
(Rieke) - Planning Commission met and recommended approval of
the preliminary plat and to object to the vacation of Dale
and Calloway Street; also the Planning Commission recommended
approval of the St. Joe Meat Market plans.
Mayor Reports: The newly revised police policy has been
worked over many times and is ready for approval. At the
Mayors Conference it was recommended to approve a formal
police policy for liability protection. Mayor Loso also
stated many other thinJ:(s were discussed at the Mayors
Conference which he will distribute copies of his report to
the Councilmen.
Police Policy Acceptance: Sadlo made a motion to accept the
new police policy; seconded by Reber.
Ayes: Loso. Reber. Sadlo. Rieke.
Nayes: None. Motion carried.
ºlêrß B~E2r1~~ 1) The mechanics of collectinJ:( delinquent
assessments on the property in Clinton Village is in motion
by the County Auditor. He can do no further action until the
I property would be forfeited and placed for sale in December
of 1989.
2) The County has requested the City appoint an assessor
for the coming year. Sadlo made a motion to appoint Ollie
Lesnick as City Assessor for the year; seconded by Reber.

Nayes: None. Motion carried.
3) The new emergency alarm system for the wastewater
plant and lift station requires touch tone type phones to
adequately make the system work. This is also making the
Fire Hall in need of a new phone line that can be accessed at
any time during fire emergencies from the fire hall. Sadlo
made a motion to install a separate telephone line for the
fire hall and to purchase touch tone phones to replace all
those that are on the emergency alarm system for the
wastewater system; seconded by Rieke.
Ayes: Loso, Reber, Sadlo, Rieke.
Nayes: None. Motion carried.
4) The State has notified the City that the new laws on
levy limits now onlY allow a 3% increase over last year's
levy. The City has only a short time to object to this and
show need if a greater levy is required. Mayor and Council
I were in agreement to stay within the limit.
5) Sadlo made a motion to allow the request from the
Wastewater System operator of the purchase of materials for
shelving for the pump station of $97.50.

Cloverdale Estates 3rd Addition: Dale Salo presented his
preliminary plat for Cloverdale Estates 3rd Addition.
Discussed were the fact that he intends to do this in a I
piecemeal fashion of 4 separate parts; that he would have to
bond at 125% of the estimated cost of each portion as the
final plat is approved; the sewer line would serve the lower
elevations without a lift station or grinder pump by running
it down each side of the storm sewer; he would have to use
the type of curb approved by the City engineer; that each
portion would have to stand in it's own right. Reber made a
motion to approve the preliminary plat as recommended by the
Planning Commission, with the following stipulations:
1 ) Approval is contingent upon the status of the stub
streets of Dale and Calloway currently located in the
township. If these streets are vacated approval would
be withdrawn.
2) Further drainage studies, as requested by the city
engineer. will be submitted at the time the final plat
is presented to the Planning Commission which will take
into consideration the impact of the run-off to the
areas immediately south of the property as well as any
drainage impact to properties adjacent to the
development in the other directions and that the contour
lines present on the map of the proposed development be
extended to show drainage impact on those properties
adjacent to the development. I
3) Approval is contingent upon the developer and the city
engineer reaching a solution to the satisfaction of the
city engineer with respect to the sanitary sewer for the
five lots at the southeast portion of the development
which cannot be served by conventional sewer as
currently designed.
4) Approval is contingent upon the City Engineer's reviewal
of the street and utility plans for the first phase of
the development and it would be capable of standing on
its own feet if the rest of the development is not
completed in the foreseeable future.
5) The traffic on the access streets to the development
would be monitored and controlled as necessary by the
City,
The motion was seconded by Rieke.

~uilding Permit: Mike Scherer discussed with the Council his
need to rebuild a non-conforming structure on his R-l zoned I
property. He has obtained a building permit to rebuild only

~ 800 sq. feet as allowed by ordinance in his zone. The
Council informed him that the proper procedure is to get
approval from the Planning Commission to rebuild the
structure within means available through the zoning
ordinance, probably through re-zoning.
~ª~~r~Q~~r ªêEªir~ Larry Johanns of Watertower Paint & Repair
Company discussed with the Council optional contracts for
yearly maintenance of the watertower. He proposed a five
year contract to drain, clean, and inspect the tower each
year for $575 yearly or. to drain. clean. inspect the tower
yearly and paint the tower once in the five year period, the
cost would be $1878 per year. Sadlo made a motion to approve
a five year contract with Watertower Paint and Repair Company
to drain. inspect and clean the tower yearly and paint it
once in the five years for $1878 per year; seconded by Reber.
Ayes: Loso. Reber. Sadlo. Rieke.
Nayes: None. Motion carried.
Aloys Pfannenstein. Jr. of the St. Joe Meat Market requested
approval of the building plans for the new St. Joe Meat
Market at 26 1st Avenue Northwest. Rieke made a motion to
approve the plans as recommended by the Planning Commission;
seconded by Sadlo.
Ayes: Loso, Reber, Sadlo, Rieke.
Nayes: None. Motion carried.
The Council discussed the status of taxable property
purchased. by an entity which is property tax exempt by law.
City Attorney John Scherer stated that if the property is
being used for educational or religious purposes it is
exempt; any property which is not being used for educational,
charitable or religious purposes may be taxable.
Adjourn: Reber made a motion to adjourn at 9:55 p.m. ;
seconded by Sadlo.
