PurBuant to due call and notice thereof, the City Council of I
the City of St. Joseph met on Thursday, May 5, 1988 at 7:30
p.m. in City Hall.

bills as presented; seconded by Sadlo.

ºQ!:!~£il B~EQr!~~ SADLO: Due to the increase in water volume,
councilman Sadlo suggested the City consider imposing a water
ban. After discussion, Sadlo made a motion to allow the
public works director, Dick Taufen, to impose a Hatering ban
when he feels it is necessary; seconded by Reber.
Ayes: Loso, Reber, Dehler, Sadlo.
Nayes: None. Motion Carried.
DEHLER: The park board re-designed the sand box for the tot
lot, making it 24' x 24'. Dehler made a motion to have Dick
Taufen secure the equipment and install the sandbox; seconded
by Reber.
Ayes: Loso, Reber, Dehler, Sadlo.
Nayes: None. Motion Carried.
REBER: 1 ) The ball park needs repair done to the eaBt and
west dugouts, and both bathroom doors need to be replaced.
Sadlo made a motion to replace each door at the cost of $265
(each) , and repair the west roof dugout at $395, for a total
of $925; seconded by Reber.
Ayes: Loso, Reber, Dehler, Sadlo.
Nayes: None. Motion Carried.
2) The Recreation Association purchased $600 of lime for the I
ball park, and would like to know if the City would help pay

for the lime. Reber made a motion to pay $400 towards the
lime, with the remaining $200 to be paid by the Recreation
Association; seconded by Sadlo.
Ayes: Loso, Reber, Dehler, Sadlo.
Nayes: None. Motion Carried.

3) Jack Warnes has agreed to do the building inspection for
the st. Ben's remodeling project, but requested that the City
defer his payment until 1989. Dehler made a motion to approve
Jack Warens as the building inspector for the st. Ben's
project and defer his payment until 1989; seconded by Rieke.
Ayes: Loso, Reber, Dehler, Sadlo, Rieke.
Nayes: None. Motion Carried.
4) Councilman Reber also discussed the street patching policy
and what form of material the City should allow contractors to
use. Reber made a motion to change the wording of #9 of the
City Standards, Ordinance #57.5, subd. 6 from concrete to
ready mix/batch mixed concrete; seconded by Sadlo.
Ayes: Loso, Reber, Dehler, Sadlo, Rieke.
Nayes: None. Motion Carried.
5) Received a request for the City Assessor to require a fee
for any remodeling done in the City.
6) Requested the City Establish an application form to be
filled out before a building permit is issued. The form
should include such items as legal description, plot plan, and
a listing of any eaBements on the property. Rieke made a
motion to have Councilman Reber talk with the City Engineer
and draft a form; seconded by Sadlo.
Ayes: Loso, Reber, Dehler, Sadlo, Rieke.
Nayes: None. Motion Carried.
RIEKE: The planning commission met and discussed:
1) The variance for Mike Duetz. The reason for recommending
approval were: a) the building is already in place and their
is a justifiable need for expansion. b) the setback from the
front footage (property line south), is far enough to the
building so that conBtruction to the lot line of the side yard
would not interfere with the intersection. After discuBsion,
Dehler made a motion to approve the variance for Mike Duetz
allowing him to build up to the lot line in an industrial
area; seconded by Rieke.
Ayes: Loso, Dehler, Sadlo, Rieke.
Nayes: Reber. Motion Carried 4-1.
2) Diane Schneider is extending the Sal's cooler addition by 2
feet, on the south side.
3) Preferred Property Services sent the planning commission a
letter concerning parking at the 8 plex apartments.
Hendrickson Easement: Corman and Marilyn Hendrickson appeared
before-the-CouncfI-to request partial vacation of a utility
easement on the southerly side of their property, located at
Lot 7, Block 2 Cloverdale Estates, 2nd Addition. After
discusBing the alternativeB with the City Engineer, Joe
Bettendorf, Councilman Rieke made a motion to vacate the
westerly 5.0 feet of the existing 10 foot utility easement on

the southerly 105 feet of the lot and retain a 5 foot utility
easement on the southerly 105 feet of the lot; Beconded by
Reber.

hearing was held as advertised and notices mailed to the
affected property OHners. Joe Bettendorf, City Engineer,
discussed the project, Hhich Has included in the comprehensive
plan from 1980. He Btated the improvement Hould be a
bituminouB overlay Hith concrete curb and gutter, Hhere none
currently exiBts. The improvement is along FirBt Avenue South
East between Minnesota Street and Baker Street East.
QueBtion - Bud Reber: THO of the properties along the
improvement area already have curb and gutter, will they be
asses Bed for new curb?
AnSHer: Yes, the type of curb and gutter in place is the older
Btyle and it has Berved itB useful life.
Question - Steve Dehler: Since an adjustment is made for
replacement of curb that Btill has useful life, iB their any
adjustment made for replacement of old curb?
AnsHer: No, once the curb has Berved its useful life, the
property OHner Hill have to pay for neH curb.
QueBtion - Merl Gretsch: What iB curbing good for?
AnSHer: Curbing defines the street and protectB the edge of
the pavement from breaking away, and generally keeps parked
cars in line. Also, it helps the snOH plowB and improveB
drainage.
Question -Dan Nierengarten: Is any of the blacktop coming off?
AnSHer: Yes, Hhere the blacktop is bad they Hill cut if out
and patch. This iB a maintenance project so they Hon't be
removing all the blacktop.
Question - Pat Zahler: ~.Jill the street be higher than it is
nOH, and if it is, will their be a drop from behind the curb
to the laHn?
AnsHer: The curb Hill be 6" and if their is a drop, He Hill
put in back fill.
A number of the residents expressed concern about Hhether
their Hill be a drainage problem after the improvement, since
they feel that they already have a problem at the corner of
First Street and Minnesota Street. After discuBsion, it Has
determined that the drainage problem occurred Hhen there HaB a
heavy rain, and the proposed improvement shouldn't cause any
problems.
Question - Merl Gretsch: I Hould like to put in a double
garage, how Hill that Hork Hith the improvement?
AnsHer: All the driveways Hill be the same width they are nOH
unleBB you would like to change it. If you do, stake the
middle of the driveHay and tell UB hOH Hide you Hould like it.
Question - Leo Sadlo; Mr. Sinclair and Mr. Ehlert currently
have a ramp coming from the curb to the driveway, what iB

going to happen to after the improvement?
Answer: We Hill match into the drivewaYB, and for some of them
I we may have to cut back into the driveways to do this, but we
will only go back as far as we need to match.
Question - Al Schirml: How do you measure the footage?
Answer: The footage is based on the platted property, that is
the legal dimensions.
Question - Dan Nierengarten: When will the City be advertising
for bids, and actually starting the project?
Answer: The bidding should take place in May, with the project
beginning in June.
Question - Pat Zahler: How much overlay will they be putting
down?
Answer: 1 1/2 inches.
Question - Dan Nierengarten: Has the grade been checked yet?
Answer: No, not yet. When surveying we will cross section and
check the grade.
Councilman Dehler brought up the iSBue of sidewalks and asked
the people along First Avenue how they felt about running a
Bidewalk down from Minnesota street to Kennedy School. The
group expressed concern about the cost of a sidewalk and if it
would be more economical to put it in now rather than later.
They also expressed concern about the parking along First Ave.
and the problems associated with all the buses loading and
unloading in front of Kennedy School.
I Sadlo made a motion to cease the hearing at 9:00 p.m.;
seconded by Rieke.
Ayes: Loso, Reber, Dehler, Sadlo, Rieke.
Nayes: None. Motion Carried.
Question - Ed Sinclair: Does the assessment have to be paid
right away?
Answer: No, it could be certified to your taxes over a number
of years.
Reber made a motion to approve a resolution ordering for the
improvement and preparation of plans for the First Street
improvement; seconded by Sadlo.
Ayes: Loso, Reber, Dehler, Sadlo, Rieke.
Nayes: None. Motion Carried.

Automatic SystemB Co. for the Control/Modification for the new
Well No. 3. Rieke made a motion to approve the quote of
Automatic System for $7,300 for the Control Addition /
Modification for Well No. 3· seconded by Sadlo.

Mr. Bettendorf alBo presented the 1988 Budget for the Well and
I Watermain Improvements.

discuBs the City's policy for running water to prevent
freezing. Mr. Meinz feels that the City caused the problem by
his house when they improved 3rd street and raised the depth I
of the watermain to 6 feet. Since then he has been having
problems Hith hiB Hater freezing, and he feels that it is only
appropriate that the City credit his April utility bill for
the additional water he had to run. Mr. Menzhuber claims the
City should credit his Hater because the City called him and
advised him to run his water. After a lengthy discuBsion, the
Council Has in agreement that if they Here to credit Mr. Meinz
and Mr. Menzhuber, they would alBo have to credit the other 25
property owners the City called and notified of the
possibility of freeze up of their service line. Councilman
Rieke made a motion to credit the Hater of the 27 people the
City notified and bill them for the same amount of water they
uBed in the previouB quarter; seconded by Sadlo.
AyeB: Loso, Reber, Dehler, Sadlo, Rieke.
NayeB: None. Motion Carried.
Mayor Loso made it clear that this credit is only for the
current Hater bill and the City will be working on a policy
for future years.
The mayor declared a recess at 10:12 p.m.
The mayor declared the meeting back in session at 10:20 p.m.
~21!£~ Çh!~f B~E2r!~~ Police Chief Bill Lorentz appeared
before the Council to discuss: I
1 ) Gambling - informed the Council that the department has
shut down 3 Bocial functions in local establishments in which
the organizations Here operating illegal gambling, and he
would like to know Hhat the City's policies and procedures are
on gambling. Mayor Loso reminded Chief Lorentz that the
City's philosophy iB if it iB againBt the law it is City
policy to enforce the law and it iB then up to the enforcement
agency, not the City, to Bee to it that there is a procedure,
and that it is adhered to.
The mayor extended the meeting 30 minutes at 10:35 p.m.
City Attorney, John Scherer, recommended that the police
department notify all the bars ~-Jhat is legal and illegal,
that He are going to enforce the laH and if an organization
planB on uBing their establishment, they Bhould make sure they
are licensed.
2) Patrolman Steve Erickson - Chief Lorentz asked the Council
to reconsider their decision of January 21, 1988 at Hhich they
decided that Steve could Hork up to 39 hours a Heek, excluding
the months of June, July, August. According to that deciBion,
Steve Hould be done Horking May 31, 1988. Chief Lorentz feels
that Hith the vacation and military leave of the other
patrolmen, the department Hill be Horking under a skeleton I
staff and feelB that the City could benefit from keeping Steve
on aB a patrolman during the summer months.

3) Dog Policy - Asked the Council what the City policy is
~ regarding picking up of dogs and putting them in the kennel.
Mayor Loso read the policy from the August 6, 1988 minutes of
the City Council: "Maintenance department would handle dogs
running loose, when they are on duty during regular
maintenance hours and the police department would handle dogs,
when they are on duty. When no one is on duty police would
normally handle them in emergency situations. When no
emergency exists the next scheduled person on duty would
handle the call." Chief Lorentz expressed concern about
handling dogs becauBe they are not equipped to do so. The
Council discussed alternativeB ways of tranBporting the dogs,
and decided the policy would remain the Bame.

the American Legion.
