MEMBERS PRESENT: Mayor Mike Loso; Councilmen Donald "Bud" Reber, Steve Dehler, Leo Sadlo, Ross Rieke. Clerk/Adm. Rachel Stapleton. OTHERS PRESENT: Duane Sorenson, Mike Deutz, Dick Clement, Alan Rassier, Denise Fuller, Mark Zimmer, Ray Brandenberger, Curt Cotton, Denny Tamm, Carole Tamm, George Molus, Sr. Brian, William Lorentz, Richard Taufen, Joe Bettendorf. AGENDA APPROVAL: Dehler made a motion to approve the agenda with deletion and additions; seconded by Reber. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None. Motion carried. MINUTES: Minutes of the March 2 meeting were approved with a motion by Reber; seconded by Sadlo. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None. Motion carried. BILLS PAYABLE: Sadlo made a motion to approve the bills payable as presented; seconded by Reber. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None. l'1otion carried. MAYOR REPORTS: 1) Met with the task force on student problems and reviewed the proposed keg ordinance with them. They were receptive to it and preferred the simple, direct approach of the proposed ordinance and are supportive of it. 2) Commend Jim Marthaler on his informative school reports to the Council. 3) Need to review, by the next meeting, the feasibility of establishing a City compost for grass clippings and weeds. If feasible, would need to hire caretaker during the hours it will be open. COUNCIL REPORTS: SADLO: Presented water report for 1988 and stated that acid treatment and televising of well #2 is scheduled for April 10. REBER: 1 ) Received a request to fill holes in alley with Class 2, in Block 6, Original Townsite of St. Joseph. Refer this duty to the maintenance department, to do when time permits. 2) Received complaints of wood piles at 1012 Minnesota Street East. Clerk to refer this to City Attorney for recommendation of appropriate action. RIEKE: Plqnning Commission requested that Council delay action on Scherer Trucking Special Use permit request until 1 e fí 0 -L ;LJ ~ () further action of the Planning Commission. DEHLER: Needed repairs to Centennial Park shelter will cost I approximately $6,000, not including electrical and plumbing repairs. Options include tempered glass windows, roll type doors, or glass blocks (most costly). Reber made a motion to allow Giroux Construction proceed with repairs to the shelter and omit the window portion of the project until a decision on the windows is made at a future date; seconded by Sadlo. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None. Motion carried. ORDINANCE #74 LIQUOR (KEG ORDINANCE): Council discussed the values of controlling the number of kegs allowed on property units for control of the size of parties. Reber made a motion to approve Ordinance #74, an ordinance limiting possession of certain containers of non-intoxicating or intoxicating malt liquor ( kegs) ; limiting the number of kegs on a property unit to one. The motion was seconded by Sadlo. Discussion - of penalties and other appropriate control measures. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes; None, Motion carried, PLANNING COMMISSION ORDINANCE AMENDMENT: Dehler made a motion to approve an amendment to ordinance #25 which will allow the number of appointed members to be five to seven members; seconded by Reber. Ayes; Loso, Reber, Dehler, Sadlo, Rieke. Nayes; None. t-Jotion carried. NOISE COMPLAINT: Presented a police report of a noise complaint at 127 E, Cedar Street. (Second complaint) On reviewal Council felt that this minor incident did not call for a hearing. Dehler made a motion to notify the owner that we received the complaint and appropriate action would be taken if further violations occur at this residence. Sadlo seconded the motion. Ayes: Loso, Reber, Dehler, Sadlo, Rieke, Nayes: None. Motion carried. GAMBLING LICENSE APPLICATION: St. Joseph Parish - Dehler made a motion to waive the 60 day waiting requirement and allow the State Gambling Control Board to consider the application on receipt; seconded by Reber. Ayes: Loso, Reber, Dehler, Sadlo. Nayes: None. Rieke abstained. i'10tion carried, HOOK UP CHARGES: Joe Bettendorf, City Engineer, reported on his findings of expansion of existing businesses and construction of additional facilities on an existing lot as they relate to the water and sewer hook up charges. CSAH 75 SIGNAL PROJECT: Joe Bettendorf, City Engineer, 1 (à 17 0 -..;¡ 'i _-'-- U (j .....1 discussed with the Council that he has met with the affected I property owners, whose property is adjacent to the project. He presented written comments from Michael J. Deutz, Harold Rothfork, Mark Lambert, and Charles and Hope Klocker and presented the responses to each, from the County Engineers office. Joe then discussed a preliminary cost break down of alternate 2, $763,940; 3, $763,940; and 4, $782,150; proposals. The cost breakdown also included FAU, County, and City amounts. Mayor Loso questioned the amount of County participation in engineering costs and because of prior discussions and the fact that this is an intersection of two County roads, the County should have greater participation in the engineering of the project. Expect to have more negotiation of this cost. Dehler asked on traffic control and mobilization. Joe stated that these are costs to start the project construction and allow traffic flow during construction. Sadlo proposed that a water main be installed under the highway in conjunction with this project. Dehler discussed adaptions of alternate #4 to include right on, right off at First Avenue NE. Joe stated that this would create, basically, a safety situation as we currently have. Dehler felt the advantage of access to First Avenue NE would be important to the community. Councilman Reber left at 9:30 p.m. Dehler made a motion to approve and submit to Stearns County and the State of Minnesota for approval, Alternate #4 with the addition of a right on, right off access at First Avenue Northeast on the north side of the highway; seconded by Rieke. Ayes: Loso, Dehler, Sadlo, Rieke. Nayes: None. Motion carried. Dehler made a motion to request Stearns County guarantee future access on the south side of CSAH 75 at a location where Fourth Avenue would cross in the future; seconded by Sadlo. Ayes: Loso, Dehler, Sadlo, Rieke. Nayes: None. Motion carried. GAMBLING LICENSE APPLICATIONS: 1) CENTRAL MINNESOTA SEXUAL ASSAULT CENTER: Denise Fuller presented an application for gambling license for the Central Minnesota Sexual Assault Center, to be held in the LaPlayette. After discussion Dehler made a motion to allow the application, without objection, with the assurance that this group' will designate 75% of the balance of the gross profits (10%) to be used for the St. Joseph area and after three months, report to the Council on the results of this requirement. Sadlo seconded the motion. Ayes: Loso, Dehler, Sadlo. Nayes: None. Rieke abstained. Motion carried. Reber returned at 10:25 p.m. 2) SARTELL LIONS CLUB: Dick Clement of the Sartell Lions Club presented a gambling license application, to be held at the Midway Bar. He stated that when the St. Joseph Lions or Lioness get their license reinstated, the Sartell Lions would be willing to give up their license in st. Joseph. The Sartell Lions were requested to return 75% of the 10% gross profits, for charitable purposes in the St. Joseph community, Sadlo made a motion to allow the application with out objection; seconded by Reber. Ayes: Loso, Reber, Dehler, Sadlo, Nayes: None. Rieke abstained. tvJotion carried. Dehler made a motion to waive the 60 day waiting requirement for the Sartell Lions Club gambling license application; seconded by Reber. Ayes: Loso, Reber, Dehler, Sadlo. Nayes: None. JOSEPH JAYCEE'S: Dehler made a motion to allow the gambling license application with out objection, of the St, Joseph JayCee's; seconded by Sadlo. Ayes: Loso, Reber, Dehler, Sadlo. Nayes: None. Motion carried. 4) AVON LIONS CLUB: Dehler made a motion to allow the one day gambling license application with out objection, of the Avon Lions Club, for the St, Joseph Lions Club, for an event to be held at the El Paso, and to waive the 60 day waiting period; seconded by Reber. Ayes: Loso, Reber, Dehler, Sadlo. Nayes: None. Rieke abstained. Motion carried, OUTDOOR LIQUOR PERMIT: t-1ark Zimmer requested an outdoor liquor permit for an event to be held at the LaPlayette on Sunday, Hay 7, from 3:00 p.m, to 10:00 p.m. Mark stated the music would end at 9:00 p.m. and he would contact St. Benedict's Convent and the nearby residential neighbors, prior to the event. He would have an under 21 years old allowed area, closed off with snow fencing and an entrance only through an outside gate. There will be no outside lnOA O(~JJ entrance where alcohol and beer is dispensed and served. I Dehler made a motion to allow the outdoor liquor permit as requested; seconded by Sadlo. Ayes: Loso, Reber, Dehler, Sadlo. Nayes: None. Rieke abstained. Motion carried. BOULEVARD TRAILBLAZING SIGN REQUEST: Mike Deutz requested the Council allow a trail blazing sign as requested at a prior meeting. The State will not post the hours of operation and the City may make stipulations on maximum dimensions of the sign. Dehler made a motion to allow a trailblazing directional sign, for St. Joseph Gas and Bait to be placed on the boulevard as requested; seconded by Sadlo. Ayes: Loso, Dehler, Sadlo, Rieke. Nayes: Reber. Motion carried. GASOLINE REQUEST: Mike Deutz requested the City consider his company as a gasoline supplier for a portion of this year. Council agreed to put his company in the rotation for the year. Also, Clerk to notify the suppliers that in case of an emergency, the supplier will furnish fuel immediately, without question. ST. JOSEPH RECREATIONAL ASSOCIATION: Jim Brummer, St. Joseph Recreational Association, requested that an amount of rent be established for the Real Estate Park Land license which they currently hold. Reber made a motion to approve an amendment to the Real Estate Park Land license, which establishes the monthly rent for use of the premises to be zero dollars ($0.00) per month; seconded by Sadlo. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None. Motion carried. PROPOSED RECREATIONAL BUILDING: Jim Brummer discussed with the Council a proposal for a recreational building for St. Joseph. Requested the Mayor appoint interested individuals to do a feasibility study. Reber made a motion to approve in concept, a Recreational Center Feasibility Study Group to be formed, as a volunteer, non-compensated committee, to study the proposed project; seconded by Rieke. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None. Motion carried. STREET SWEEPER: Dick Taufen, Street Superintendent, presented information on a used street sweeper which he felt would meet the needs of the City_ Reber made a motion to proceed with the appropriate measures to obtain an adequate street sweeper, for immediate use, to provide for the needs of the City; seconded by Dehler. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. . Nayes: None. Motion carried. HOOK UP CHARGES: Council discussed hook up charges for new and expanded commercial buildings. Agreed that hook up 1 --. (, r, C _.J b " _LU()¿~ should be paid when actually hooking building up to city water, and encourage water line to be stubbed in during excavation for other services. LOSS CONTROL WORKSHOP: Sadlo made a motion to approve the attendance of the Clerk, Police Chief, and Superintendent of Public Works to attend a loss control workshop in St, Cloud on April 25; seconded by Reber.
