September 7, 1989
Pursuant to due call and notice thereof, the City Council for
the City of St. Joseph met on Thursday, September 3, 1989 at
7:30 p.m. in the City Hall.
MEMBERS PRESENT: Mayor Mike Loso. Members of the Council
Donald "Bud" Reber, Steve Dehler, Leo Sadlo, Ross Rieke.
Deputy Clerk Judy Weyrens.
OTHERS PRESENT: Joe Bettendorf, John Scherer, Bill Lorentz,
Mark Zimmer, Brian Murphy, Claude Menzhuber, Dennis Tamm.
APPROVE AGENDA: Reber made a motion to approve the agenda
with additions; seconded by Sadlo.
Ayes: Loso, Reber, Dehler, Sadlo, Rieke.
Nayes: None. Motion Carried.
BILLS PAYABLE: Sadlo made a motion to approve the bills as
presented; seconded by Reber.
Ayes: Loso, Reber, Dehler, Sadlo, Rieke.
Nayes: None. Motion Carried.
MINUTES: Reber made a motion to approve the minutes of the
August 17 City Council meeting as corrected; seconded by
Rieke.
Ayes: Loso, Reber, Dehler, Sadlo, Rieke.
Nayes: None. Motion Carried.
ORDINANCE AMENDMENT - COMPOST: Reber made a motion to amend
Ordinance No. 107: Garbage and Refuse Ordinance by the
enactment of a new section 107.5: Compost Site For Disposal
of Yard Waste; seconded by Rieke.
Ayes: Loso, Reber, Dehler, Sadlo, Rieke.
Nayes: None. Motion Carried.
MAYOR REPORTS: 1 ) Met with County Engineer Doug Weiszhaar
concerning the cost share of CSAH 75 Signal Project. The
request was turned down because the engineer on the project
is the City Engineer, and the project was started earlier and
is now nearing completion. The next step is to see whether
the County will revise the cost split.
2) Met with representatives of the School District
concerning the certificate of occupancy for the newly
remodled Kennedy School. An agreement was signed by the
School District assuring that the watermain improvements will
be completed as scheduled. They will also let the City know
the status on the easement for East Baker Street by October
1, 1989.
COUNCIL REPORTS: SADLO: Concerned whether the refuse hauler
is abiding to the refuse limits set by the Park Refuse and
the City Council. The refuse hauler indicated that they are
sticking to the two can limit.

REBER: 1 ) Parking by Kennedy School is becoming a problem,
as some of the neighbors are having a hard time getting in
and out of their driveways. Reber requested the City Clerk
to send a letter to Mr. Jim Lee of the School District asking
that the employees of Kennedy School use the provided off
street parking to alleviate some of the parking problems near
the school.
2) Questioned whether or not the setback requirements are
being satisfied by builders in the City. The City might want
to check into requiring builders to supply the building
inspector with a certified surveyors report to get accurate
property lines.
RIEKE: The planning commission will be meeting on September
11, 1989 at which time they will be considering a special use
permit for Mark Lambert and Peter Omann will be presenting
building plans. The Council would like to stress the
importance of the planning commission and their role in the
development of St. Joseph, and they should work with future
planning of the City rather than as a recactionary committee.
DEHLER: The park board met and discussed possible
development of mornings ide park. Mayor Loso at this time
would like to respond to the letter he received from the
park board questioning why three projects have not been
completed. 1 ) The fence near the horseshoe pits has not been
approved by the Council. 2) Jogging course was going to be
installed by volunteers and they City would pay for the
cement and equipment rent. 3) Re-doing of the horseshoe pits
has already been completed.
POLICE POLICY PROPOSALS: Police Chief Bill Lorentz presented
a request to change the current police policy regarding high
speed chase. This change is necessary because state has
mandated a change and we must comply. Chief Lorentz would
also like the Council to amend Police Policy No. 36.03
General Rules to allow the officer involved in a high speed
chase to determine when to cease the chase. The decision
would be based on common sense such as weather conditions.

POLICE EQUIPMENT REQUEST: Police Chief Bill Lorentz
requested the City purchase a new radar for the patrol car.
The current radar was purchased in 1980 and needs to be
updated. Reber made a motion to approve the purchase of a
Decatur Hunter Double Barrel radar from Minnesota Traffic
Radar for $1235.00 -- keeping in mind that this is an
important piece of equipment and should not be over used;
seconded by Rieke.

MARK ZIMMER - LA PLAYETTE - 1) Requested the Council to grant
the La Playette a one day outdoor liquor permit on September
30, 1989, (Homecoming SJU/CSB), beginning at 2:00 p.m. They
would fence in an area outside with the only access being
from inside the building. Their would be bar no set up
outside, just patio furniture for people to sit and their
would be no live music. Rieke made a motion to approve the
outdoor liquor permit for September 30, 1989 provided Mr.
Zimmer fills out the appropriate application and pays the
required fee; seconded by Sadlo.
Ayes: Loso, Reber, Dehler, Sadlo, Rieke.
Nayes: None. Motion Carried.
2) Presented the Council with an identification procedure to
control minors in a bar. Dehler made a motion to instruct
the City Attorney to prepare a proposed amendment to
Ordinance No 71.11 to be reviewed and discussed by the
Council at a later time; seconded by Reber.
Ayes: Loso, Reber, Dehler, Sadlo, Rieke.
Nayes: None. Motion Carried.
SUNDAY LIQUOR CLOSING: Brian Murphy and Mark Zimmer
requested the Council to consider changing Ordinance No 71
to allow liquor establishments to allow the sale of liquor
between the hours of 12:00 a.m. and 1:00 a.m. on Mondays
unless otherwise prohibited. Reber made a motion to amend
Ordinance 71 to allow the sale of liquor between the hours of
12:00 a.m. and 1:00 a.m. on Mondays; seconded by Sadlo.
Ayes: Loso, Reber, Sadlo, Rieke.
Nayes: Dehler. Motion Carried 4-1.
Mayor declared a recess at 9:00 p.m.
Mayor recovened at 9:10 p.m.
JOE BETTENDORF - CITY ENGINEER: 1) The iron filtration tank
needs to be repaired. Joe presented a plan to renew the
interior of the tank and replace the existing media and
clean, repair or replace other apertences. The improvement
will include installation of chlorination equipment. Rieke
made a motion for the City Engineer to draw specs and plans
in preparation for advertising for bids on the project;
seconded by Reber.
Ayes: Loso, Reber, Sadlo, Rieke.
Nayes: Dehler. Motion Carried 4-1.
2) Updated the Council on the drainage issue by the
Cloverdale Estates Addition. Sadlo made a motion for the
City Engineer to obtain the necessary easements for the
construction of a culvert and pond; seconded by Rieke.
Ayes: Loso, Reber, Dehler, Sadlo, Rieke.
Nayes: None. Motion Carried.
Mayor extended the meeting 30 minutes.

CLERK/ADM REPORTS: 1 ) Property owners in Cloverdale Estates
are requesting additional street lighting. Rieke made a
motion to have Stearns Cooperative Electric Association
proceed with placing two street lights in Cloverdale Estates
with one on 9th Ave SE and Dale Street, and the other on 10th
Ave SE and Dale Street; seconded by Dehler.
Ayes: Loso, Reber, Dehler, Sadlo, Rieke.
Nayes: None. Motion Carried.
2) We now have all the necessary information to advertise for
the purchase of a street sweeper. Rieke made a motion to
advertise for the purchase of a street sweeper; seconded by
Dehler.
Ayes: Loso, Reber, Dehler, Sadlo, Rieke.
Nayes: None. Motion Carried.
3) Insurance on wastewater plant - Rieke made a motion to
approve the additional insurance coverage for the wastewater
plant; seconded by Reber.
Ayes: Loso, Reber, Dehler, Sadlo, Rieke.
Nayes: None. Motion Carried.
4) The boulevard beautification committee would like to place
a water fountain on Minnesota Street near the Lab School
entrance.
5) Computer project: We are still having some problems with
getting the computers on line. Councilman Reber suggested
bringing in a computer specialist to get the computer
on line.
6) The volleyball net at Millstream Park was stolen on the
weekend of September 2, 1989. Reber made a motion to approve
the purchase of a new volleyball net; seconded by Dehler.

Nayes: None. Motion Carried.
7) Time line for the 1990 budget. Rieke made a motion to
hold a Special Council Meeting on September 28, 1989 at 7:30
p.m. to work on the 1990 budget; seconded by Sadlo.
Ayes: Loso, Reber, Sadlo, Rieke.
Nayes: Dehler. Motion Carried 4-1.
ADJOURN: Dehler made a motion to adjourn at 10:55 p.m.;
seconded by Sadlo.
