I October 5, 1989
Pursuant to due call and notice thereof, the City Council for
the City of St. Joseph met on Thursday, October 5, 1989 at
7:30 p.m. in the City Hall.
MEMBERS PRESENT: Mayor Mike Loso. Councilmen Steve Dehler,
Leo Sadlo. Deputy Clerk Judy Weyrens. Councilmen absent:
Donald "Bud" Reber, Ross Rieke.
OTHERS PRESENT: Stuart Goldschen, Mark Lambert, Ken Twit,
Dick Taufen.
AGENDA APPROVAL: Sadlo made a motion to approve the agenda
with additions; seconded by Dehler.
Ayes: Loso, Sadlo, Dehler.
Nayes: None. Motion Carried.
BILIS PAYABLE: Sad 10 made a motion to approve the bills
payable as presented; seconded by Dehler.
Ayes: Loso, Sadlo, Dehler.
Nayes: None. Motion Carried.
TREASURER'S REPORT: Dehler moved to table the approval of
the July and August treasurer's report until the next
I meeting; seconded by Sadlo.
Ayes: Loso, Sadlo, Dehler.
Nayes: None. Motion Carried.
MINUTES: Dehler made a motion to approve the minutes of the
September 21 Council meeting with corrections; seconded by
Sad 10.
Ayes: Loso, Sadlo, Dehler.
Nayes: None. Motion Carried.
MAYOR REPORTS: 1) During the installation of the bathroom
facilities at Millstream Park, it was discovered that their
was not adequate electrical power to service all the
facilities at Millstream. Dehler made a motion to improve
the electrical power at Millstream park by placing
underground wiring in the Park, at a cost of $3400; seconded
by Sadlo.
Ayes: Loso, Sad 10, Dehler.
Nayes: None. Motion Carried.
2) Dick Taufen, Civil Defense Director, has handed in his
resignation. Due to his numerous commitments and lack of
time needed for the job, he felt that it \\Duld be best to
step down. Loso made a motion to advertise in the local
I paper for a Civil Defense Director, with compensation being
$25 per month; seconded by Sadlo.

COUNCIL REPORTS: SADID: No report. I

Dehler made a motion to certify
DELINQUENT UTILITY HEARING:
to the County Auditor, the delinquent utility bills which
have not been paid or secured; seconded by Sadlo.
Ayes: Loso, Sadlo, Dehler.

STREET SWEEPER - CONSIDER BIDS: Only one bid was received
for the purchase of a street sweeper ---
Mac Queen Equipment Inc. $15,500
Dehler made a ITOtion to approve the purchase of a street
sweeper from Mac Queen Equipment, Inc. for $15,500; seconded
by Sadlo.
Ayes: Loso, Sad 10 , Dehler.
Nayes: None. Motion Carried.
Mayor declared a recess at 8:25 p.m.
Mayor reconvened the meeting at 8:35 p.m.
SPECIAL USE & VARIAI\~E - KREBSBACH: Krebsbach Oil, Inc. is
requesting a special use permit to allow construction of a
v-shaped, double faced billboard, and a one hundred eighty
(180) foot variance on the size of each face of the I
billboard. The property is legally described as follows:
That part of lot 9, Aud. Subd. 4, which lies east of the west
186.5 feet thereof, northerly of the northerly right of way
line of CSAH 75 and \.¡est of a line d r a \VI1 due south from a
point which is 800 feet due west of a point on the west line
of Schneider's Addn., distant 800 ft. northerly of the
intersection of said west line and the northerly right of way
line of CSAH 75.
Dehler made a motion to approve the special use permi t to
allow construction of a billboard on the above mentioned
property; seconded by Sadlo.
Ayes: Loso, Sadlo, Dehler.
Nayes: None. Motion Carried.
Dehler made a ITOtion to allow a 180 foot variance on the size
of each face of the billboard provided that the positioning
of the sign does not obstruct· the wester ly traffic view of
Little Louie's Pizza; seconded by Sadlo.
Discussion: Before construction, a building permit will
have to be issued, and the sign must be placed
at least 20' beyond the property line.

FIRE DEP~ffiNT & RELIEF ASSOCIATION - Ken ~.¡it, Treasurer of
the Relief Association and Dick Taufen, Fire Chief, appeared

I before the Council to present a proposed update and change of
their current accounting system, as required by Minnesota
Statutes. In addition, they are requesting permission to
transfer all funds from both checking and savings accounts of
the St. Joseph Fire Department General Fund to a newly
established account called the Firefighters Relief
Association General Fund. In updating the accounting
procedures, the Fire Department Treasurer will be increasing
the amount of time need to perform the job satisfactorily.
Therefore, the Fire Department would like the City Council to
review the current salary of $100 per year, and adjust it
accordingly. Sadlo made a motion to allow the transfer of
all funds from both checking and savings accounts of the St.
Joseph Fire Department General Fund to a newly established
account called the Firefighters Relief Association General
Fund, and to increase the salary of the Fire Department
Treasurer to $40 per month; seconded by Dehler.
Ayes: Loso, Sadlo, Dehler.

Fire Chief, Dick Taufen, also discussed concerns with the
removal of underground storage tanks in the City. The
Counci 1 was in general agreement that all City decisions
would be in conjunction with the State Fire Marshalls office.
I CAPITAL OUTLAY REQUESTS - Dehler made a motion to approve the
following capital outlay requests of the Maintenance
department:
Contractor's Stainless Steel 10 gal. Wet/Dry Shop Vac at $250
Industrial 3000 PSI Pressure Washer at $2,000
Rent storage space for the street sweeper Nov-Apr. at $120;
seconded by Sadlo.
Ayes: Loso, Sadlo, Dehler.
Nayes : None. Motion Carried.
SPECIAL USE & VARIANCE - LAMBERT: Mark Lambert appeared
before the Council requesting a special use permit to allow
construction of a twelve unit apartment building ln an
Industrial District, and to consider a variance request of
fifteen feet on the rear yard setback, to construct garages
in the rear yard, in conjunction with the proposed
apartments. The property is located at 129 1/2 Cedar Street
East and is described as the combined following parcels:

The Westerly Sixty-six (Wly 66') Feet of the Easterly One
Hundred Thirty-two (Ely 132') Feet of Lot Four ( 4) of
" Auditors's Subdivision No. Nine (9) , in the Village of St.
I Joseph, less and except the South Two Hundred (So. 200') Feet
thereof, all according in the Off ice of the Stearns County
Recorder, Minn.

The Easterly Sixty-six (Ely 66' ) Feet of IDt Four (4) of
Auditor's Subdivision, less the Southerly Two Hundred (Sly
200') Feet of the Easterly Sixty-six (Ely 66') Feet of IDt
Four (4) of Auditor's Subdivision No. Nine (9) of IDts 14,
15, 16 and 17 of Auditor's Subdivision No. Four (4) of the
Southwest Quarter of Northwest Quarter (SW 1/4 of NW 1/4) and
of the Southeast Quarter of the Northwest Quarter (SW 1/4 of
NW 1/4) of Section Ten (10), Township One Hundred ~venty Four
(124) North, Range Twenty-Nine (29) West. According to the
plat and surveys thereof on file and of record in the office

The Easterly 66 feet of the Southerly 200 feet of Lot 4 of
Auditor's Subdivision No. 9 of Lots 14, 15, 16 and 17 of
Auditor's Subdivision No. 4 of the SW 1/4 of the NW 1/4 and
SE 1/4 of NW 1/4 of Section 10, all in Township 124, Range
29, Stearns County, Minnesota.
~rr. Lambert discussed with the Council his proposed plan to
construct a 12 unit apartment complex. The property I
currently has three buildings on it, a house, a small house,
and a rrobi Ie home. If allowed the 12 unit apartment
construction, he \Vüuld remove the existing buildings, \·¡iden
the access into the property, have on on-site manager, fence
in the property, and vDuld do everything possible to control
the noise level. After a lengthy discussion, the Council
requested Mr. Lambert to submit his intentions, in writing,
to the City Clerk for review with the Mayor and Council. The
Council will then consider the special use permit and
variance request at the next City Council meeting.
WATER SÅ’OOL: Sad 10 made a rrotion to allow Dick Taufen to
attend the annual water operators school on October 25, 1989
at St. John's University; seconded by Dehler.

Nayes: None. Motion Carried.
ADJOURN: Sadlo made a rrotion to adjourn at 10:03 p.m. ;
