HomeMy WebLinkAbout1989 [10] Oct 19 1733 October 19, 1989 Pursuant to due call and notice thereof, the City Council for the City of St. Joseph met on Thursday, October 19, 1989 at 7:30 p.m. in the City Hall. MEMBERS PRESENT: Acting Mayor Donald "Bud" Reber. Councilmen Leo Sadlo, Ross Rieke, Steve Dehler. Deputy Clerk Judy Weyrens. Mayor 1oso absent due to Mayors conference. arHERS PRESENT: Bernard Hollermann, Regina Hollermann, Diane Gohman, Peter Van Heel, Joe Miller, Shirley Miller, John Eich, Lyle Grieger, Stuart Goldschen, Mike Deutz, Greg Kacures, James Kacures, Bob Krebsbach, Jim Krebsbach, Mark Lamber t . AGENDA APPROVAL: Rieke made a motion to approve the agenda as presented; seconded by Sadlo. Ayes: Reber, Rieke, Sadlo. Nayes: None. Motion Carried. TREASURERS REPORT - Sad 10 made a motion to approve the treasurers reports for July, August, and September, as presented; seconded by Rieke. Ayes: Reber, Rieke, Sadlo. Nayes: None. Motion Carried. Councilman Dehler arrived at 7:42, MINUTES - Sadlo made a motion to approve the minutes as presented for the September 28 and October 5 Council meetings; seconded by Dehler. Ayes: Reber, Dehler, Sad 10 , Rieke. Nayes: None. Motion Carried. MAYOR REPORTS: Dick Taufen requested the Council consider changing the name of Callaway Drive to Callaway Street in Cloverdale 3rd Addition. Dehler made a motion to designate the 3rd street to the south of Minnesota Street, east of 7th Street SE as Callaway Street; seconded by Rieke. Ayes: Reber, Dehler, Sadlo, Rieke. Nayes: None. Motion carried. COUNCIL REPORTS: SADW: 1) The bids for the iron removal renovation, chlorine system, and floridation uPJrading have been published, with the bid opening on November 1, 1989 at 11:30 a.m. 2) Discussed the function and use of the meeting room when Official City meetings are scheduled. When a City meeting is scheduled, that will take precedence to all other functions / meetings, and they will not be performed during official City meetings. DEHLER: Requested the City Clerk check with the insurance 1734 company on the liability allowing a group of students to use the warming house without having a supervisor present. Mayor declared a recess at 8:10 p.m. Mayor reconvened the meeting at 8:34 p.m. KREBSBACH - BILLBOARD: Bob Krebsbach requested the Council to clarify the motion of the October 5, 1989 approving the request of Krebsbach Oil to construct a bi lltoard. Counci lmen Dehler stated that the motion approved the construction of a billboard, but the sign could not be placed in such a manner that it would obstruct the westerly traffic view of Little Louie's Pizza. Bob felt that due the curve of CSAH 75, that no matter where the sign was placed the v¡esterly traffic view of Little Louie's Ylould be obstructed at one time or another. Af te r discussion, Dehler made a motion to allow Krebsbach Oil, Co. to construct a billboard on their property. The sign must be a minimum of 10 feet atove ground level, placed at least 20 feet from their property line, and directly east of their existing bulk tanks, allowing the westerly traffic on CSAH 75 to have enough time to see and react to Little Louie's. The mot ion was seconded by Sadlo. Ayes: Reber, Dehler, Sadlo, Rieke. Nayes: None. Motion Carr ied . LAi.\ffiERT - APARI'ìvIENT PROPOSAL: As requested by the Council at the October 5, 1989 City Counci 1 meeting, Mark Lambert presented the following written proposal for a 12 unit apartment complex: l. Lambert's intent is to construct a twelve (12) unit three bedroom apartment building to be rented to students. Their will be no more than 4 students per apartment and one parking stall shall be provided for each student. 2. As a condition of the City issuing a building permit, Lambert \·¡ill purchase an adjacent parcel to provide the above mentioned parking. 3. Lambe r t will demolish the house located at 129 E. Cedar St. to provide an asphalt road of not less than 20 feet in width to the apartments. In addition, a stop sign \.¡ i 11 be placed where the serVlce road intersects with Cedar Street. 4. Lambert will also demolish an old mobile home and attached garage. 5. Lambert will fence the entire east toundary line of the property, as well as the northern edge of both the Gohman and Eisenshank property. Lambert will escrow $1500.00 to cover the cost of the fence. 6. Should the apartments be used as a student rental, Lambert agrees to provide on-site caretakers to oversee the property and to minimi ze any student misbehavior. Lambert \'li 11 incorporate into all 1735 student leases, restrictive provisions prohibiting parties and calling for evictions after a second noise ordinance violation. The St. Joseph Police Department will at all times have the caretaker's current address and phone number.. The Council expressed concern whether or not there was enough access for the fire truck to get to the apartment building should their be a fire, if the increased traffic on Cedar Street would interfere with the CSAH 75 project, and whether the water mains are adequate to service the apartment building. After a lengthy discussion, acting mayor Reber made a motion to table this issue until the next Council meeting, when more information will be available. CLERK/ADM REPORTS: 1) Building inspector, Ron Euteneuer, requested the Council look into an amendment to the Ordinances pertaining to the placement of satellite dishes on private property. The Council will have the planning commission look into such an amendment and make a recommendation to the Council. 2) The winter parking restrictions take effect on November 1 thru April 1, 1990. Cars are not allowed to park on City streets between 2:00 a.m, and 7:00 a.m. 3) The annual Santa's Train will be on December 9, 1989. 4) Dick Taufen would like the Council to check into city responsibility and resident responsibility for mail box placement with regards to snow removal.
