MEMBERS PRESENT: Mayor Mike Loso. Members of the Counc i I Donald "Bud" Reber, Steve Dehler, Leo Sadlo, Ross Rieke. Deputy Clerk Judy Weyrens. APPROVE AGENDA: Reber made a motion to approve the agenda; seconded by Sadlo. Ayes: Loso, Reber, Sadlo, Rieke. Nayes: None. Motion Carried. Dehler arrived at 7:37 p.m. BILLS PAYABLE: Sadlo made a motion to approve the bil Is payable as presented; seconded by Reber. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None. Motion Carried. Mayor requested the City Clerk send a memo to the po lice department reminding them of the ho I i day policy. MINUTES: Dehler made a motion to approve the minutes with corrections to pages 1771 and 1772; seconded by Reber. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None. Motion Carried. MAYOR REPORTS: 1) The right-of-way land acquisition for CSAH 75 project has been completed. DDD Partnership - $ 700 Triple K Partnership - 5,400 (Donated 5,400) Joe 8< Shirley Mi ller - 6,500 David Hollander - 7,800 (Donated 5,300) Charles 8< Hope Klocker - 9, 100 2) The compost area wi I I be open effective April 6. The hours wi I I be from 4:00 p.m. - 8:00 p.m. Friday and 8:00 a.m. thru 12:00 noon on Saturdays. This area wi I I be open until further notice. 3) There wi I I be a special closed meeting Tuesday, April 10 at 7:30 p. m. COUNCIL REPORTS: SADLO: 1) The renovation on the iron filtration system is complete and operating again. 2) During January and February of this year, we have lost 3,131,000 ga I Ions of water that was pumped but not b i I led to customers. The cost the city incurred pumping the lost water was approx. $396.71. Water Products Company has a product on the market that locates water leaks, and wi II a I low the city to test the equipment for 30 days. Surety bond and certificate of insurance shou 1 d ,::\be in the City Clerk's Office befof"e ßny ~)(Q~v~t.iç n, REBER. 1) The St. Joseph ball team would 1 i ke to use the snow fence again this year in the ballpark along first base to the outfield and along third base to the outfield. 2) The curbing on 1st Ave SE that was installed in 1987 is beginning to deteriorate in two locations. The City Engineer wi II check into this area when he is in the City. 3) Dick Taufen received a request by St. Benedict to sweep the main entrance into the college/convent. Counc i I genera I I y agreed that the sweeper wi I I be used only for pub I i c use. Ross: Gary Schyma would like to place student rental in the second level of his business located at 11 Minnesota street. The planning commission wi II discuss this at the next planning commission meeting. DEHLER: No report. LIQUOR ORDINANCE - 18 Year Old Arm Band: When the amendment to ordinance #71.11 was approved, it was to be reviewed by the counc i 1 at the end of the six month trial period. This being the end of the trial period, the council requested the Po lice Chief and 1 iquor license holders allowing minors in their establishments by use of arm bands, to appear before them to discuss the workability of the ordinance and if it should be continued. The mayor stated the po lice chief would speak first followed by the establishment owners. Po 1 ice Chief: Stated their has been an increase in the number of altercations in and near I i qual' establishments since the amendment to the ordinance. Also, he felt that because of the volume of minors it the bars, it was difficult for the bouncers to keep track of the minors. La Playette: Mark Zimmer feels allowing minors in 1 iquor establishments by use of arm bands can work with proper supervision. He has hired four bouncers to circulate amongst the patrons, to watch the minors as close as possible. The only night they use the armbands allowing minors in the bar is on Thursday nights. Sa l' s Bar and Gr ill: Dale Schneider stated that since March 16, they have hired more bouncers to monitor the patrons. In addition, they tried stamping all the patrons -- majors with a different color than minors. This would alleviate the problem of minor patrons pushing the arm band up their coat sleeve and the bartenders could easily check a I 1 patrons when purchasing alcohol. After discussion, the Mayor recommended to continue the current po I icy, but encouraged the establishment owners to continue to impf'ove methods of contro 11 i ng the minors and , 1777 WQì~k with the po Ii ce department when problems arise. OUTDOOR LIQUOR PERMIT. Mark Z i mmeì~ r"eques ted an outdoor per"mit far an event to be held at the La Playette on Sunday, May 6, 1990, from 3:00 p.m. to 10:00 p.m. Mark ¡:¡t.at.ß.¡: U1ß. music would end at 8: 30 p. m. , he would contact Jim Kostreba for additional security, and he would contact the nearby residential neighbors prior to the event. Sadlo made a motion to allow the outdoor permit as requested; seconded by Reber. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None. Motion Carried. VARIANCE REQUEST - DAVID HOLLANDER: David Hollander appeared before the counc i I to request a twenty-two (22) foot variance on the size of his existing business sign. The property is legally described as follows: The East 100 feet of the West 400 feet (as measured along the Northerly right of way line of Trunk Highway #52) of the following described tract: A I I that part of the SE 1/4 NW 1/4 of Section 10, Township 124, Range 29, Stearns County, Minnesota, described as follows, to witt: Commencing at the Southeast corner of the NW 1/4 of Section 10; thence on an assumed bearing of North along the East line of said NW 1/4 a distance of 559.31 feet to a point on the Northerly right of way line of Trunk Highway #52; thence North 88 18' West along said right of way line 831.57 feet; thence North 01 35 East 290.22 feet to its intersection with the Southwesterly right of way line of the Burlington Northern Railroad; thence Southeasterly along said right of way line to its intersection with said East line of the NW 1/4 of Section 10; thence South along said East line 87.91 feet to the point of beginning. Reber made a motion to approve the twenty-two foot variance on the size of the existing sign on the above mentioned property; seconded by Sadlo. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None. Motion Carried. PUBLIC HEARING - CLINTON VILLAGE RE-ASSESSMENT: At 9:00 p.m. the mayor called a public hearing for the re-assessment of the vacant Clinton Village lots. Being that their was no written or oral testimony, Sadlo made a motion to approve the resolution authorizing the re-assessment of the balance of special assessment #17, which was disregarded by the State who acquired the lots due to tax debt. The re-assessment included the balance previously assessed from 1989 thru 1997. The motion was seconded by Reber. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None. Motion Carried. MILLSTREAM PARK REQUEST: Paul Meyer representing the st. Claud Dry Riders appeared requesting approval for their 1778 or"gani;;::ation to host the Dr"y Rider"s Mid-State Rally at Mi J J str"eam Par"k, J abor" day weekend, September 1-3 1990. As a part of the rally, the Dry Riders would like to provide ~ h~nç) in the par"k on Saturday afternoon and evening. After discussion, the Mayor requested Paul Meyer to provide the City with a written request including an itinerary for the three days they would be using the park, and they would act on this matter at the next counc i I meeting. PETITION FOR ANNEXATION: The counc i I received the petition of Bernie & Nancy Evans for annexation. The property is legally described as: That part of the Northeast Quarter of the Southwest Quarter of Section 10, Township 124, Range 29, lying and being within the following metes and boundary lines: Beginning at a point on the North line of Minnesota Street extended East in the Village of St. Joseph, distant 50 feet easterly of the Southeast corner of Block 1 of Loso's Fourth Addition to said Village; thence East along the North 1 i ne of Minnesota Street extended, 70 feet; thence parallel to Woodrow Wilson Avenue 198 feet North; thence West parallel to Minnesota Street 70 feet to the easterly line of Woodrow Wilson Avenue; thence southerly along the easterly 1 i ne of Woodrow Wilson Avenue 198 feet to the place of beginning; and that portion of the Northerly thirty three (33) feet of Minnesota Street, adjacent to said tract. CLERK/ADMINISTRATOR REPORTS: Summer Recreation: The summer recreation program wi II be sponsored jointly by the City, St. Cloud Boys and Girls Club, and District 742. The program wi I I run from June 11 thru August 2. Loss Control Workshop: Reber made a motion to approve Rachel Stapleton and Dick Taufen's attendance at the Loss Control Workshop on May 11, 1990 at the Sunwood Inn; seconded by Sadlo.
