MEMBERS PRESENT: Mayor Mike Loso. Members of the Counc i I Donald "Bud" Reber, Steve Dehler, Leo Sadlo, Ross Rieke. Deputy Clerk Judy Weyrens. Counc i I Member Rieke arrived at 8: 14 p.m. OTHERS PRESENT: City Engineer Joe Bettendorf, Dick Taufen, Stuart Goldschen, John Eich, Bernard Hollerman, Regina Hollerman, Lawrence Rennie, Marie Rennie, Margaret Eisenschenk, Rose Reber, Greg Kacures, Ed Kacures. AGENDA APPROVAL: Reber made a motion to approve the agenda as presented; seconded by Sadlo. Ayes: Loso, Reber, Dehler, Sadlo. Nayes: None. Motion Carried. BILLS PAYABLE: Sadlo made a motion to approve the bills payable with the exception of two bills: 1) The Police car body repair, which wi I I be allowed after review of accuracy in relation to previous quote; 2) and the engineering of CSAH I 75 when County portion, if any, is deducted. The motion was seconded by Reber. Ayes: Loso, Reber, Dehler, Sadlo. Nayes: None. Motion Carried. Treasurer's REPORT: Sadlo made a motion to approve the June Treasurer's report as presented; seconded by Reber. Ayes: Loso, Reber, De hIe r, Sadlo. Nayes: None. Motion Carried. MINUTES: A motion was made by Sadlo to approve the minutes of the July 5, 1990 Counc i I meeting; seconded by Reber. Ayes: Loso, Reber, Deh I er, Sadlo. Nayes: None. Motion Carried. Dehler made a motion to approve the minutes as presented for the July 19, 1990 Counc i I meeting. The motion was seconded by Sadlo. Ayes: Loso, Reber, Dehler, Sadlo. Nayes: None. Motion Carried. MAYOR REPORTS: 1) Summer Maintenance Position - Mayor questioned the Committee of Reber and Dehler on the status of the maintenance position. Dehler felt that after talking to I Dick Taufen, Pub I i c Works, the position would require more than that of part time. With this in mind, Dehler" didn't feel the applications fit with the needs of the City. Page 1809 Reber concurred that the ~.pp 1 i I~~" t ions didn't f i I I the needs of the City, and also questioned whether or not their is a need for an additional maintenance person. 2) The Rod and Gun club is looking into preserving the drainage pond at Morningside park in its natural state. COUNCIL REPORTS: SADLO: The fire board met with representatives of the College and Convent of St. Benedict and discussed St. Benedict's assistance in annual financial needs of the Fire Depar tment. Representatives of St. Benedict stated they would include this need in their next fiscal budget. REBER: As part of the process of repairing the Centennial Park Shelter, Reber presented a estimate from Giroux Construction to replace the windows on the west side of the shelter. Reber made a motion to approve the estimate of Giroux Construction for $185.00 to remove and replace the wi ndo\I1s; seconded by Dehler. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None. Motion Carried. RIEKE: The City Clerk only received one application for the position of planning commission secretary. Reber made a motion to hire Teresa Kruger-Lahr as the planning commission _. secretary, starting at the August 6, 1990 meeting, and to have someone from the Clerk's Office attend the same meeting. Ayes: Loso, Reber, Sadlo, Rieke. Nayes: De hIe r. Motion Carried 4-1. DEHLER: Centennial Park is being painted by the Jaycees. Dehler has received an estimate from Overhead Door to replace two overhead doors. Dehler made a motion to approve the estimate of Overhead Door to i nsta II two coil away doors for $996.00; seconded by Reber. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None. Motion Carried. PUBLIC HEARING - CSAH 75: The Mayor cal led the hearing to order at 8:00 p.m. and turned the hearing over to the City Engineer Joe Bettendorf. The purpose of the hearing was to pass upon the proposed assessment, against abutting property, for the curb and gut tel', and water main improvement on Date Street, between First Avenue NW and First Avenue NE on College Avenue, between Ash Street and Date Street; on Cedar Street between First Avenue NE and a point 200 feet east of First Avenue NE; and on First Avenue NE between Cedar Street and Date Street. After discussing the purpose of the hearing, Joe Bettendorf opened the hearing for questions. Page 1810 1. La.wrence Rennie questioned his driveway approach. Response: Joe Bettendorf wi I I review their driveway and respond back to them. 2. Rose Reber questioned the proposed assessment in relation to assessments in the past. Response: After discussion, Joe Bettendorf stated he would further research the past assessments. 3. Ben Ho II erman questioned the process of notifica.tion the contractor wi I I use when they have to close their driveways for construction. Response: The only time their driveways wi I I be unaccesssible will be when the machine is in front of a driveway. 4. John Eich questioned how many days they have to pay the assessment without interest. Response: 30 days from the date of the hearing. There being no further questions, Sa.d I 0 made a motion to adjourn the hearing at 8:32 p. m. . The motion was seconded by Reber. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None. Motion Carried. ED KACURES - FEE WAIVER: Ed Kacures appeared before the Counc i I to request the waiver of the $100 variance fee for .- his proposed fence. The variance would a II ow him to construct a 7 1/2 foot high fence. The Counc i I informed Mr. Kacures that he must make his request before the planning commission before the counc i I wi I I act on the matter. The mayor declared a recess at 9:00 p.m. The mayor reconvened the meeting at 9: 13 p.m. CLERK/ADMINISTRATOR REPORTS: 1) City Attorney John Scherer has prepared a proposed amendment change to ordinance 52.4 as requested by the planning commission. The amendment re-defines a f am i I y as 3 unrelated persons. Dehler made a motion to leave the definition of a f am i I y as it is currently unless a pub I i c hearing is held. Discussion: Sadlo stated the purpose of the proposed change is to preserve the traditional f am i I y residence neighborhoods and place rental properties in the proper perspective. Dehler would like to see other remedies discussed before changing the f am i I y size. The motion died for a lack of a second. Dehler made a motion to have the planning commission set a hearing date to hold a pub I i c hearing for the proposed amendment to cha.nge the definition of the fami lYe The motion was seconded by Rebe r. Page 1811 2) Public Easement - Proposed Ordinance #32: City Attorney prepared a proposed ordinance limiting the use on pub I i c easements. After a lengthy discussion, Dehler made a motion to approve Ordinance No. 32 -- Limiting Activities in Public Easements, with the addition of the word "fences" to Section 32.4 b. i. The motion was seconded by Rieke. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None. Motion Carried. 3) Re-zonin¡:!: Reber made a motion to approve the following resolution directing the Planning Commission to make recommendations regarding re-zoning. Dehler seconded the motion. RESOLUTION The City Counc i I for the City of St. Joseph hereby resolves that the Planning Commission for the City of st. Joseph is directed to immediately undertake a study with respect to re-zoning certain property located that within the City of St. Joseph, lying and being north of the northerly right of way line of County Road 75, south of the southerly right of way line of the Burlington Northern Railroad tracks and east of First Avenue Northwest, except for that property currently zoned RM (mobile home use) . It is further resolved that the Planning Commission is to make specific recommendations regarding re-zoning of the properties within the above-described area, and set forth the recommendations in a proposed ordinance in a form similar to that attached hereto. It is further resolved that the Planning Commission s ha I I proceed immediately with pub I i c hearings in accordance with the provision of the St. Joseph Ordinance, Ordinance No. 52, and present its report to the City Council no later than 60 days from the date of this resolution. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None. Motion Carried 4) Sidewalk Repair: Rieke made a motion to repair the sidewalk in front of the fire ha I I to the corner on Ash street. The motion was seconded by Sa,d I o. Ayes: Loso, Reber, Dehler, Sadlo, Rieke. Nayes: None. Motion Carried. 5) Supplemental Wastewater Grant: The City received notice that the we qualify for a supplemental Notch community adjustment authorized by the State Legislature. This adjustment is to a.id the City of St. Joseph in the City of St. Cloud interceptor project. Page 1812 6) Water Tower Grant: The Mayor, City Clerk, and City Engineer wi I I attend a meeting with representatives of the community development division of Minnesota Department of Trades and Economic Development concerning assistance in funding a proposed water tower. 7) Refuse Contract - 1991: The current refuse contract with Park Refuse/BFI ends December 31, 1990. The counc i I decided to advertise for bids for the refuse removal for 1991. The Mayor with the Clerk wi II write the specs and advertise the bids to be opened at the September 6, 1990 Counc i I meeting.
