Pursuant to due ca 1 I and notice thereof, the City Counc i I for
the City of St. Joseph met on Thursday, August 16, 1990 at
7:30 p.m. in City Ha I I.
MEMBERS PRESENT: Mayor Mike Loso; Members of the Counc i.l
Steve Dehler, Leo Sadlo. Ross Rieke. Clerk/Administrator
Rachel Stapleton. Donald "Bud" Reber absent.
OTHERS PRESENT: Stuart Goldschen, Ed K<3.cures, David Mehr,
Dale Salo, Brenda Piepus, Rose Wiehoff.
AGENDA APPROVAL: Sadlo made a motion to approve the agenda;
seconded by Dehler.
Ayes: Loso, Dehler, Sadlo, Rieke.
Nayes: None. Motion carried.
MINUTES: Dehler made a motion to approve the minutes of the
August 2 meeting; seconded by Sadlo.
Ayes: Loso, De hIe r, Sadlo, Rieke.
Nayes: None. Motion carried.
MAYOR REPORTS: 1) Stearn's County Sheriff's Department is
ordering patrol cars through the State bid. Local
governments may tie in with their bid. Dehler made a motion
to purchase a 1991 Ford LTD Crown Victoria, with state patrol
specifications, at a base price of $12,448; seconded by
Rieke.
Ayes: Loso, Dehler, Sadlo, Rieke.
Nayes: None. Motion carried.
2) Police Chief submitted a schedule for September through
December. Mayor recommended additional coverage on weekends.
Rieke made a motion to allow the Mayor to work with the
Po lice Department to hire extra coverage by Stearns County
Sheriff's Department on weekends; seconded by Dehler.
Ayes: Loso, Dehler, Sadlo, Rieke.
Nayes: None. Motion carried.
3) Po 1 ice Chief Lorentz submitted a request for retirement.
Dehler made a motion to approve Police Chief B i I I Lorentz's
retirement, effective January 31, 1991; seconded by Rieke.
Ayes: Loso, Dehler, Sadlo, Rieke.
Nayes: None. Motion carried.

4) Ci ty wi I I advertise for the Chief of Police position in
the St. Joseph Newsleader, the St. Cloud Times, the
Minneapolis Star, trade magazines. Police interview board is
Loso, Reber, Sadlo.

5) Rod and Gun Club proposed to upgr8.de f'1orni ngs i de P8.rk, by
developing a wildlife pond, at no cost to the City. Rieke
made a motion to accept the Rod and Gun Club's propos8.1 for
Morningside Park, as presented; seconded by Dehler.
Ayes: Loso, Dehler, Sadlo, Rieke.
Nayes: None. Motion carried.
6) t<1i II stream Park dredging is expected to be done at the end
of the summer. Sadlo made a motion to approve the dredging
of the pond and deposit the dredgings along the ditch area,
to provide landscaping of the area, and sod and seed as
needed. The motion was seconded by Rieke.
Ayes: Loso, Deh I er, Sadlo, Rieke.
Nayes: None. Motion carried.
7) Po lice Chief requested capital outlay items of ( 4 ) Smith &
Wesson 9mm semi automatic weapons, for the Department. Rieke
made a motion to approve purchase of the 4, 9mm weapons, with
holsters and extra magazine pouches, plus extra magazines, as
quoted by Streicher's at $1,997, 8.nd training and ammo at
$400, and to advertise the used weapons, for sale. The
motion was seconded by Sadlo.

COUNCIL REPORTS: RIEKE: The Planning Commission wi II hold 8
hearing on a proposed amendment change to define family as
"three unrelated persons" rather than currently is five
unrelated persons; and they will hold a hearing on a proposed
zoning change for the area north of CSAH 75, excluding the
mob i Ie home district. The area is currently industrial.
Both hearings wi I I be held on September 4.
DEHLER: 1) Park Board met and discussed summer and winter
recreation programs, use of the parks, and recommendations
for upgrading parks. 2) Community committee met and proposed
a keg ban ordinance to control for profit parties. Mayor
stated that the proposed ordinance is too vague, and the
proposal needs a lot more study. Rieke felt that the effect
on the total community should be looked at. 3) Dehler made a
motion to purchase a new clock for city hall; seconded by
Sadlo.
Ayes: Loso, Dehler, Sadlo, Rieke.
Nayes: None. Motion carried.
Ed Kacures discussed with the counc i I that he did not agree
with the minutes of the August 6, 1990 city counc i I meeting,
which stated "offensive nature of materials" (which are
stored on his property), and requested that the minutes be
changed. He does not feel that his stored materials are
offensive. f1embers of the Counc i I felt tha.t "offensive" is a

personal viewpoint, and that a majority are of the same
opinion. Sadlo made a motion to deny the request; seconded
by Dehler.

Nayes: None. Motion carried.
VARIANCE REQUEST: David Mehr discussed with the Counc i I his
request for a one and one half foot variance on the heighth
of a fence in a residential zone. The Planning Commission
held a hearing on the variance and at the hearing Mr. Mehr
stated his request to construct a privacy fence to screen his
view. Mr. Mehr stated that he felt that the owner of the
property who stores the assorted materials, adjacent to his
back yard, should have to bu i I d a privacy fence. The Counc i I
discussed setting precedent, and if more than six feet in
height is necessary in residential neighborhoods. Dehler
made a motion to support the Planning Commission, in denying
the request for a variance; seconded by Rieke.
Ayes: Dehler, Sadlo.
Nayes: Loso, Rieke. Motion failed.
Rieke made a motion to a I low the variance as requested;
seconded by Loso.
Ayes: Loso, Rieke.
Nayes: Dehler, Sadlo. Motion failed.
Robert Johnson, Retired City Clerk, stated that he was
surprised by the action of the Planning Commission and the
City Counci I, and felt that variances are provided for in the
ordinance to a II ow for adverse situations.
ELECTION JUDGES: Dehler made a motion to set election judges
salaries at $5 per hour and to approve the following as
election judges for 1990 primary and general election;
seconded by Rieke.

Ayes: Loso, Dehler, Sadlo, Rieke.
Nayes: None. Motion carried.
HISTORICAL MONUMENT: Dehler made a motion to approve the use
of 50% of the St. Joseph Dedicated Fund, of the Stea.rns
County Historical Society, as requested, to repair and

relocate the historical marker commemo ra. tin g the blockhouse
built to protect the St. Joseph area residents during the
1862 Sioux Uprising. This approval is to dedicate the funds
and does not approve any change, movemen t, or relocation of
the monumen t. The motion was seconded by Sadlo.
Ayes: Loso, Dehler, Sadlo. Rieke.
Nayes: None. Motion carried.
BUDGET: Council wi I I meet at 7:30 p.m. on August 23, to
discuss and consider the proposed budget for 1991.
DEVELOPERS AGREEMENT: Dale Salo requested the Counc i I
consider a developers agreement for cloverdale Estates Fifth
Addition. Rieke made a motion to table it unti I September 6
to allow for legal counsel input; seconded by Sadlo.
Ayes: Loso, Dehler, Sadlo, Rieke.
Nayes: None. Motion carried.
Residents of previous additions discussed the problems which
they encountered in dea ling with Developer Dale Salo.
Concerns were junk pi I ed, oil dumped, open paint cans in junk
pi Ie, construction materials buried on site. Mayor asked
about the State FmHA inspection, how it was handled with the
residents of the homes. Residents stated that they did not
inspect, only asked what the problems were with the houses.
When the report comes from the State, the City can address
problems which relate to the City.
CLERK/ADMINISTRATOR REPORTS: 1) A street light was requested
for West Ash Street between Fourth and Fifth Avenues.
Counc i I requested to see if it is needed in that area. 2)
Rental Housing inspection is almost completed. A few need
required repairs. 3) Clerk presented b i I Is for the
Centennial Celebration of $10,600. Rieke made a motion to
approve the Centennial Celebration bi II s as presented;
seconded by Sadlo.
Ayes: Loso, Dehler, Sadlo, Rieke.

4) Sadlo made a. motion to approve Fire Department b i I Is of 30
covera 11 s - $1,036, a.nd 6 air packs - $1,800; seconded by
Dehler.
Ayes: Loso, Dehler, Sadlo, Rieke.
Nayes: None. Motion carried.
5 ) Park Refuse requested that all recyclables be at the curb
by 7:00 a.m. on Thursdays. 6) Po lice Chief requested the
Council's opinion on purchasing warning ticket books for
department use. Counc i I felt it appropriate to wait for the
new Police Chief to consider this matter.

The meeting adjourned at 10:15 p.m. with a motion by Sadlo;
seconded by Rieke.
