Pursuant to due ca I I and notice thereof, the City Counc i I for
the City of St. Joseph met on Thursday, September 20, 1990 at I
7:30 p.m. in City Ha I I.
MEMBERS PRESENT: Acting Ma,yor Donald "Bud" Reber; Members of
the Counc i I Steve Dehler, Leo Sadlo, Ross Rieke.
Clerk/Administrator Rachel Stapleton. Mayor Mike Loso
absent due to vacationing in Germany.
OTHERS PRESENT: Richard Rohloff, Tom Ploeger, Robert
Chelberg, Alan Rassier, Jennifer Peterson, Mark Lambert,
Robert Loso, Richard Taufen.
AGENDA APPROVAL: Dehler made a motion to approve the agenda
with the addition of a request of Mark Lambert, to insta.ll
storm sewer; seconded by Sadlo.
Ayes: Reber, Dehler, Sadlo, Rieke.
Nayes: None. Motion carried.
TREASURER'S REPORT: Dehler made a motion to approve the
August treasurer's report; seconded by Rieke.
Ayes: Reber, Dehler, Sadlo, Rieke.
Nayes: None. Motion carried.
MINUTES: Sadlo made a motion to approve the minutes of the
September 6 meeting as corrected; seconded by Dehler.
Ayes: Reber, Dehler, Sadlo, Rieke. I
Nayes: None. Motion carried.
COUNCIL REPORTS: SADLO: 1) Saturday morning, August 18, there
was a water break near the construction of CSAH 75 signal
project. Molitor Excavating was avai lab Ie and repaired it.
2) The repairs to the pump on a fire truck were much greater
than anticipated, total cost $4,488.50. After discussion,
Sadlo made a motion to approve the payment of $4,488.50 to
Emergency Aparatus, Inc. for repair of the pump; seconded by
Rieke.
Ayes: Reber, Dehler, Sadlo, Rieke.
Nayes: None. Motion carried.
RIEKE: Planning Commission held a hearing, on September 4,
to discuss proposed change of the definition of f am i I y from
five unrelated persons to three unrelated persons, and to
change part of the industrial zone to business and/or
business and R-3.
Recommendation expected at their next regular meeting. A
special meeting of the Planning Commission was held on
September 10 to hear a report by Fred Sandal of APO.
DEHLER: Park Boa.rd met and discussed the projects in the
parks; received a report on summer recreation program; the
warming house; initial pla.nning for a winter recreation I
program and advertised for a winter director, and would like

to consider coordination with the Boys and Girls Club and
I District 742 as the summer program operates, in order to
increase participation, and requested that a winter program
operate for one more year. Sadlo made a motion to a I low a
winter program, with attempts to increase participation, as
budgeted; seconded by Rieke.

Na.yes: None. Motion carried.
Rieke made a motion to a I low approximately 12 trees to be
moved in Millstream Park to the picnic area, at $250;
seconded by Sadlo.
Ayes: Reber, Dehler, Sadlo, Rieke.
Nayes: None. Motion carried.
Dehler suggested a window be installed in the Baseba I I Park
rink warming house. After a Counc i I discussion, Dehler agreed
to see what acceptable window materials are available, and
get prices. Dehler also recommended that the East side
warming house be available for skaters to put on skates, but
not heated.
MARK LAMBERT - STORM SEWER: Mark Lambert requested the
Counc i I provide for a I lowance of installation of storm sewer
for his property, with the CSAH 75 project. He also
requested that it be special assessed. He also stated that
I if it can not be special assessed, he s t i I I would have it
installed and pay the cost up front. Rieke made a motion to
a 1 low the storm sewer to be installed and to a I low it to be
special assessed, if this can be accomplished, and in an
equitable manner, upon review of the attorney. The motion
was seconded by Dehler.

Nayes: None. Motion carried.
CIVIL DEFENSE DIRECTOR ROBERT LOSO REPORTS: The president of
the company owning the mob i Ie home court, requested that the
City assume the responsibility of liability insurance on the
storm shelter at the Cour t, because they are in danger of
losing their insurance coverage, and the City required the
shelter be installed. He felt the City should provide some
other means of access control to the building, if the City
would not take on the liability of it. Reber stated the
shelter was a State requirement, and this is not pub I i c
property, the City would not assume liability for it. A
trailer court resident stated that the residents are directly
working to upgrade the shelter, to have lights provided and
leaky roof fixed. Sadlo stated that the the mob i Ie home
court residents should work directly with the property owners
to resolve the situation. Also, the storm shelter could be
I locked and each mob i Ie home could be given a key.

ELECTION: Rieke made a motion to appoint Leander Kapsner as I
an additional election judge for the general election;
seconded by De hIe r.
Ayes: Rebe r, De hie r, Sad la, Rieke.
Nayes: None. Motion carried.
OUTDOOR LIQUOR PERMIT: Mark Zimmer requested an outdoor
liquor permit for the LaPlayette for homecoming. He would
have no outdoor music, would provide the required security,
and all outdoor operations would meet the requirements of the
ordinance. Rieke made a motion to allow the permit and waive
the 30 days advance notice requirement; seconded by Sadlo.
Ayes: Reber, Dehler, Sadlo, Rieke.
Nayes: None. Motion carried.
Acting Mayor declared a recess at 8:50 p.m.
Acting Mayor reconvened the meeting at 8:58 p.m.
REFUSE SERVICE BIDS FOR 1991: Bids were received by the
Counc i I for refuse service for 1991. Council to review and
consider at the next meeting.
MILLSTREAM PARK REPAIRS: Rieke made a motion to purchase a
basketbal 1 backboard for Millstream Park, at a cost of I
$75.98, to replace the vandalized one; seconded by Sadlo.
Ayes: Reber, Dehler, Sadlo, Rieke.
Nayes: None. Motion carried.
FIREFIGHTER CERTIFICATION: Rieke made a motion to approve
newly required State certification of 30 firefighters, at $10
each, which would allow them certification by grandfather
status; seconded by Sadlo.
Ayes: Reber, Dehler, Sadlo, Rieke.
Nayes: None. Motion carried.
LAKE REGION FIRE SCHOOL: Rieke made a motion to approve the
attendance of five firefighters at Lake Region Fire Schoo I ,
at Benson, at a cost of $100; seconded by Sadlo.
Ayes: Reber, Dehler, Sadlo, Rieke.

CLERK/ADMINISTRATOR REPORTS: 1) The owner of the mob i Ie home
court requested that the penalty on the water b i I I be waived,
because they changed their corporate office address, and he
did not receive the b i I Is in time to make payment before the
penalty was imposed. Counc i I was in general agreement that
penalties are not waived. 2) F i ling for the City election
closed September 11, with two candidates for Mayor and five I
for Counci I. 3) Clerk discussed refuse ordinance #107, and
the need to update it and require that all residences have a

refuse service. Counc i 1 discussed control of outside stora.ge
of junk. Policy to be esti3.bl ishect t hi3. t the Po I i oe Chief is
the enforcing officer, that the offending property owner is
notified to remedy the situation within a specific period of
time, if not done so, the Police Chief wi I I issue a citation.
4) Clerk requested a new calculator for the office. Rieke
made a motion to approve a Canon calculator at $124; seconded
by Sad 10.

5) City ha I 1 needs a new flag. Dehler agreed to ask the
American Legion if they wish to donate a flag.
Dick Taufen presented an existing soil borings report of the
City shop yards, for the Counci I 's review. The Counc i I felt
these reports were adequate for consideration for the
location to place a sand and salt shed. Discussed were to
buildup the floor area with class I I , and then blacktop.
Counc i I Member Sadlo requested that he be excused next
meeting, to attend a Navy reunion in Florida.
The meeting was adjourned at 9:45 p.m. with a motion by
Sadlo; seconded by Rieke.
