Pursuant to due ca I 1 and notice thereof, the City Counc i I for
the City of St. Joseph met on Thursday, October 4, 1990 at
7:30 p.m. in City Ha I I.
MEMBERS PRESENT: Mayor Mike Loso; Members of the Counc i I
Donald "Bud" Reber. Steve Deh I er. Ross Rieke.
Clerk/Administrator Rachel Stapleton. Leo Sadlo was absent
due to attending a reunion in Florida.
OTHERS PRESENT: Alan Rassier, Dennis Stueve, S. Brian Spain,
S. Judith Schaffer, Linda Sakrey, Margaret Eisenchenck, Mark
Lambert, Gregg Kacures, Stephanie Hazen. Bob Loso, John

payable; seconded by Reber.

TREASURER'S REPORT: Dehler ma,de a motion to approve the
September treasurer's report; seconded by Rieke.
Ayes: Loso, Reber, Dehler. Rieke.
Nayes: None. Motion carried.
MINUTES: Reber made a motion to approve the minutes of the
September 20 meeting as corrected; seconded by Rieke.
Ayes: Loso. Reber. Dehler, Rieke.
Nayes: None. Motion carried.
MAYOR REPORTS: 1) Hugo Weyrens has submitted a letter of
resignation as Housing Inspector, effective November 15.
Reber made a motion to accept the resignation. and requested
a letter of thanks for the fine service Mr. Weyrens has
performed for the City. The motion was seconded by Dehler.

September.
COUNCIL REPORTS: REBER: The American Legion has ordered a new
flag for City Ha I I.
RIEKE: Planning Commission met October 1st and their
recommendations are later on the agenda.
DEHLER: CORE report wi I I be handled later on agenda.
REFUSE BIDS: Dehler made a motion to approve the bid for
refuse service for 1991, of Park Refuse/BFI of $11.40, per
month, per residential unit, for once a week pickup, with
recycling. The motion was seconded by Reber.
Ayes: Loso, Reber, Dehler, Rieke.
Nayes: None. Motion carried.
The Counc i I discussed rates the City wi I I charge customers,
for the contract period. After discussion of the costs of
composting, billing, and various other charges, the Counc i I
requested exact counts and proposed spread at various rates.
Council also discussed refuse ordinance #107, and changes and
I additions needed, to a I low for recycl ing, and improper
disposal of refuse.
ANNEXATION: A motion was made by Dehler an seconded by
Rieke, to approve an amendment to the joint resolution for
Orderly Annexation Between the Township of St. Joseph, and
the City of St. Joseph, which wi I I a I low the annexation of
the following property:
A I I that part of the Northwest Quarter of the Southeast
Quarter (NW 1/4 SE 1/4) of Section Ten (10), Township
One Hundred Twenty-Four (124) North, Range Twenty-Nine
(29) West, Stearns County, Minnesota, described as
follows, to wit:
The North 200 feet of the following described tract:
Beginning at a point on the Northerly line of the Old
Minnesota State Highway #52 distant 305 feet West of the
Easterly line of the Northwest Quarter of Southeast
Quarter of said Section 10; thence running Northerly a
distance of 305 feet, more or less, to a point on the
Northerly line of said NW 1/4 SE 1/4, which point is 316
feet West of the Easterly line of said NW 1/4 SE 1/4;
I thence running Westerly along said Northerly line of
said NW 1/4 SE 1/4 a distance of 173 feet to a point;
thence South a distance of 316 1/2 feet, mor-e or less,

LOT SPLIT: A motion was made by Rieke and seconded by Reber.
to approve a resolution allowing a lot sp lit as indicated in
a survey prepared by registered surveyor David P Regan on
September 6, 1990 as split into the following lega.lly
described properties:

The south 200.00 feet of that part of Lot Four ( 4 ) of
Auditor's Subdivision No. 9 in St. Joseph, Minnesota.
according to the plat and survey thereof on f i Ie and of
record in the Office of the County Recorder, in and for
Stearns County, Minnesota, described as follows. to-wit: I
Beginning at a point 132 feet West of the Southeast
corner of said Lot 16, being on the North line of Pine
Street: thence North parallel to the East line of said

ORDINANCE AMENDMENT - ZONING: Dehler made a motion to
approve an amendment to Zoning Ordinance #52, as recommended
by the Planning Commission, to rezone certain properties in
an area North of CSAH 75 and South of the Rai I road Right-of-
Way, which was zoned Industrial. The properties are rezoned
as follows:
A I 1 of Block 25, Loso's Third Addition to Publ ic;
A I I of Block 1, Loso's Third Addition and Lots One ( 1) and
Two (2) , Block 24, Peter Loso's Addition; and Lot Three ( 3) ,
Block 22, Peter Loso's Addition; Lot Four ( 4) , Auditor's
Subdivision No. 9, .26 A, West 66 feet of East 132 feet of
Lot Four (4) , Less South 150 feet, a I I rezoned to R-3,
I Multiple Family;
A I I of Block 23, Loso's Third Addition; A I I of Lots 1, 2, 3,

ORDINANCE Al'1ENDt1ENT - ZONING: Counc i I discussed a proposCl.1 I
to the Zoning ordinance to redefine "family" from five
unrelated persons, to three unrelated persons. CORE
recommendation report stated that this committee had
recommended the change. Dehler stated that they recommended
studying the matter CI.nd implications of the change. Reber
stated that the proposal would assist in contro II i ng the
location of rentals and preserving the traditional family
neighborhoods. Loso state that the proposal would not deter
rentals, but allow for districts for rentals. Dehler made a
motion to leave the definition of "fami ly" as it stands, and
allow the CORE committee to progress with their goal. Motion
failed for lack of a second.
Reber made a motion to amend Ordinance #54.4 to define
"family" as any number of related persons living together, --
and any group of unrelated persons living together, for
purposes of this ord i nCl.nce, be considered to constitute one
f am i I y for each three persons. The amendment a I lowed those
rental units which currently hold a rental license, to retain
the "five" unrelated persons constitute a family, status,
unless there is a revocation or lapse of a license due to
acts or omissions of the property owne r. Rieke seconded the I
motion.

Nayes: Dehler. Motion carried.
CORE COMMITTEE: Mayor discussed the CORE Committee report
and recommendations, and stated that many of them are being
worked on, and it is encouraging to get r ecommendCl. t ions and
find new ways to handle situations. Rieke made a motion to
a I low the establishment of a permanent Citizen Relation
Committee, CORE, to continue to develop recommendations to
the various factions of the community, and establish
continuing methods of providing better relations for all
members of the community. A member of the counc i I would be
appointed, and act as liaison; the Clerk would act as
secretary; a member of the Po lice Department would be a
member of the committee; the City would provide a meeting
room, the services of the Clerk's office for notices and
agendas. The motion was seconded by Reber.

Rieke made a motion to appoint Dehler as liCl.ison to the CORE
Committee; seconded by Reber.

EDUCATION: Rieke made a motion to approve the attendance of
the Clerk/Adm. at Property Valuation short course, for Board
of Review, in St. Cloud; seconded by Reber.

Nayes: None. Motion carried.
Rieke made a motion to approve the attendance of the Water
Superintendent at Central District Water Operators School at
St. Johns; seconded by Reber.
Ayes: Loso, Reber, Dehler, Rieke.
