Pursuant to due ca I I and notice thereof, the City Council for
the City of St. Joseph met in regulël_r session, on Thursday,
Apr i I 18, 1991 at 7:30 p.m. in City Ha I 1 .
MEMBERS PRESENT: Mayor Steven Dehler; Members of the Counc i I
Leo Sadlo, Bob Loso, Stephanie Hazen. Clerk/Administrator
Rachel Stël.pleton. Ross Rieke absent, due to medical reasons.
OTHERS PRESENT: Mike Hazen, Bud Reber, Dave Ho I lander, John
We Ish, Ed Kacl..1res, Sr. , Stuart Goldschen, Erica Erickson, Ron

AGENDA APPROVAL: Hazen made a motion to approve the agenda
with additions; seconded by Loso.
Ayes: Dehler, Sadlo, Loso, Hazen.
Nayes: None. Motion carried.
MINUTES: Loso made a motion to approve the minutes of the
April 4 meeting, was seconded by Hazen.
Ayes: Dehler, Sadlo, Rieke, Loso, Hazen.
Nayes: None. Motion carried.
MAYOR REPORTS: 1) APo's funding through the members, is
being discussed by St. Cloud. APO wishes to establish firm
future funding, which would a I low for a taxing district. 2)
MTC's Dave Tripp reported that MTC wi I I do a study on the
feasibility to provide bus service to St. Joseph and will
report in June.
COUNCIL REPORTS - HAZEN: The information provided at the
loss control workshop, was very good. It was sponsored by
the League of Minnesota Cities Insurance Trus t.
SADLO: 1) Seventh Avenue from Minnesota Street to Baker
Street needs rebuilding. The City Engineer should be
instructed to start looking at improving Baker Street and
Seventh Avenue. Loso stated that there are concerns in the
Seventh Avenue neighborhood, of losing property when the
street is widened. Dehler asked if an annexation study could
be done along with a road study. Attorney Scherer stated
that this could be done although the property owner may not
be receptive to annexation. Only property under City
jurisdiction. which has a .benef i t to the property, may be
assessed. 2) Sewer contract with st. Benedict's still needs
to be revised. 3) The barb wire fence in Morningside Park
should be taken down: City should retain the roadway easement
entrance from Seventh Avenue, but should establish an ac~e5S
entrance from Tenth Avenue SE; also should ins ta I I monument
markers on the corners of Morningside ParK.
LoSO: 1) Park Board discussed dumpsters needed for cleanup

day, and would like to provide food for the workers for the
City wide cleanup on May 11. Sadlo made a motion to allow up
to $75 for soft drinks and sandwiches for the workers;
seconded by Hazen.
Ayes: Dehler, Sadlo, Loso, Hazen.
Nayes: None. Motion carried.
2) Park Board is looking for an individual or organization to
plant trees by the shelter in Centennial Park, and to adopt
Morningside Park for development of it. Also, the Big Toy in
Centennial Park needs repair.
3) Park Board recommended having the bathrooms at Centennial
Park open in the summer and a sign stating "Rest Area. " Loso
made a motion to have the restrooms open from 10:00 a.m. to
10:00 p. m. each day from June 1st to the day after Labor Day.
The Police Department wi I I be responsible for opening and
closing them and checking for vandalism. This service wi I I
be evaluated at the close of the season. The motion was
seconded by Hazen.

4) The Tree Inspector should check the trees in Memorial Park
for a fungus.
5) What is the status of sodding and seeding of the ditch
area of the softball fields.
6) Water tower surveys have not a I I been turned in yet. The
City rea I I y needs to get them all in.
OLD BUSINESS:
PROPERTY PURCHASE: The engineering firm wi I 1 absorb a fee,
which the authorization was questioned, for engineering
plans, on the property which the City approved a resolution
to purchase.
POLICE RADIO - t-1otion by Sadlo to drop the question of
disposal of po lice radio, which evidently was disposed of by
the previous Po lice Chief; seconded by Hazen. Discussion -
Loso stated that a private citizen has concerns in this
ma t tel' .

City Attorney was asked for recommendation in this matter.
He stated that the City could take the matter to
conciliation court or pursue criminal charges. Council
discussed options and generally agreed to have the Po lice
Department perform an internal investigation and report
findings to the Counci I.
ORDINANCE BOOKS: Draft copy of the updated Code of
Ordinances has been given to the Clerk/Administrator for
review, prior to copying.
RESOLUTION ESTABLISHING MEETING ADJOURNMENT REQUIREMENTS:
Loso made a motion to approve a resolution establishing that
Counc i I meetings wi I I end by 10:00 p. m. , but may be extended

up to one half hour by order of the Mayor; the motion was
seconded by Hazen.
Ayes: Dehler, Sadlo, Loso, Hazen.
Nayes: None. Motion carried.
STREET LIGHT: The proposed street light at First Avenue NW
and CSAH 75 was approyed.
SPECIAL USE FINDINGS RESOLUTION: Loso made a motion to
approve a resolution stating the findings regarding the
denial of a special use permit to Mark Mimbach, to a.llow the
operation of a repairable used car and yehicle lot. The
motion was seconded by Hazen.
Ayes: Dehler, Sadlo, Loso, Hazen.
Nàyes: None. Motion carried.
MILLSTREAM PARK SOFTBALL FIELDS: The St. Joseph Recreational
Association recommended posting a plaque designating a I 1 the
people a.nd organizations who have contributed to the project.
They also reaffirmed their request to name the fields
"Brummer Fields. " After a discussion of the community
support of the recreation a.rea, and that many organizations
and hundreds of individuals have contributed to it, and that
this requested to honor to Mr. Brummer may cause others
efforts to be forgotten, Dehler made a motion to retain the
name Millstream Park ëI.nd Millstream Park Ba I I fie Ids; seconded
by Sadlo.
Ayes: Dehler, Sadlo, Hazen.
Nayes: None. Abstain: Loso. Motion carried.
OFF SALE LIQUOR: Motion by Loso to hold a pub I i c hearing, on
Tuesday, May 7, at 7:00 p.m. in the City Ha I I , to get public
input on the moratorium regël.rd i ng the number of off sale
liquor licenses in the City; seconded Hazen.
Ayes: Dehler, Sadlo, Loso, Hazen.
.Nayes: None. Motion carried.
OPEN TO THE PUBLIC: 1) Dave Ho II ander requested that the
City lift the requirement of a bond for liquor licenses,
because the State has dropped this requirement already.
Hazen made a motion to a I low the liquor license applioations
to be accepted without a bond, for Counc i I consideration.
The motion was seconded by Sadlo.

Nayes: None. Motion carried.
2) Bud Reber requested that the results of the wa.ter tower
survey be published in the paper when it is completed.
3) Mark Loso requested that a monetary fine be imposed for
liquor violations, rather than a suspension. Suspensions are
a hardship on employees as we I I as the license holder.
4) Ed Kacures requested a change in the minutes of those not
in favor of "Brl.Ammer Field." Mark Loso and Bud Reber were
also not in favor of it.
Sadlo made a motion to recess at 8:20 p.m. for 10 minute$;
seconded by Hazen.

Mayor reconvened the meeting at 8:30 p.m.
BAR VIOLATION: Brad Meyer, the Officer on duty when the
violation occurred discussed that there were s t i I I patrons in
the bar at 1:45 p.m. and that there was a beer on the table.
Mark Loso, owner of Loso's Midway on Main Pub, discussed that
one of the employees was cleaning up and was having a beer.
The patrons present were in need of a ride home. An employee
was going to give them a ride home, after he was finished
cleaning and closing. Mr. Loso expressed concern that they
should not drive. He said the violation was not intentional
and that it was only a 15 minute violation. Loso made a
motion to accept the violation as the bar owner says there
was a violation; seconded by Hazen.

Nayes: None. Motion carried.
Mark Loso then stated that in 12 years of operating a bar he
has only had three violations for after hours.
Loso made a motion to impose a one da.y suspension and a $200
fine; to stay $100 of the fine and the suspension. Any
violation within six months would lift the stay. The motion
was seconded by Hazen.

Nayes: None. Motion carried.
The hearing ended at 8:45 p.m.
EASEMENTS AND NUISANCE COMPLAINTS: Clerk/Admini$trator
presented inspection reports on pre-existing matter on
easements, and complaints of debris and a large hole on
property owned by Dale SëI.l o. The hole is on a vacant lot in
the Cloverdale Estates development. Counc i I stated that if
this is in an area of construction, the Bui Iding Official
may investigate it. If there is no construction there and it
is on private property, it is a neighbor comp I a i n t.
DELINQUENT WATER BILLS: Hazen made a motion to send proper
notice on delinquent water bi II s and then turn off the water
on those unpaid bills, and to establish a po I icy that water
bills are sent on the 15th of the month, bi-monthly; any b i I I
four months in arrears of the billing be turned off on the
First of the following month, when the meters are read, and
after proper notice is served; seconded by Sadlo.

POLICE CHIEF REPORTS: 1) Chief Lindgren gave the monthly
po lice activity report. He requested to hire part time
emp I oyees. Loso made a motion to have the Po lice Interview
Board hire two part time employees, subject to approval of

the Counci I, at $7.00 per hour, for 160 hours for the month
of May, and to reapproach the Council for further part time
he I p. The motion was seconded by Hazen.
Ayes: Dehler, Sadlo, Loso, Hazen.
Nayes: None. Motion carried.
2) Motion by Loso to authorize a standardized 100 point test
for hiring which would provided for Veterans preference and
a II requirements for local government hiring. The motion was
seconded by Sadlo.
Ayes: Deh I er, Sadlo, Loso, Hazen.

3) Hazen questioned when Chief claimed overtime, for
interviewing Jeff Young and arranging office. Chief wi I I
check if it is during the time when he was on part time
administrative duty due to an injury.
4) The radio and tower from B ill Lorentz's house has been
removed and Po lice Department has this equipment.
PETITION ASKING FOR AN ELECTION: Bud Reber presented a
petition asking for an election on a resolution approved by
the City, which authorizes the City to purchase a 10 acre
parcel of land for $150,000, for future City buildings. The
Counc i I accepted the petition and submitted it to the
Clerk/Administrator for verification and filing.
ANNEXATION PETITION: James and Mary Ann Graeve presented a
petition for annexation of their parcel of property at 619
Minnesota Street Eas t, to obtain City water service. Sadlo
made a motion to approve a resolution to amend the Joint
Resolution for Orderly Annexation between the City and
Township of St. Joseph to annex the following parcel of
property; seconded by Loso. Discussion - Graeve's need for
water is immediate, Counc i I a I lowed them to connect to City
water prior to final approval of State Municipal Board,
because the State a I lows a.nnexation for this purpose.

ST WENDEL TOWNSHIP BOARD: Carl Stich, Linus Yurczyk and
Al Siefert asked if there was a possibility of areas of St.
Wendel Township receiving water from the City of St. Joseph,
and if this is a possibility, to plan the water tower with
that in mind. Annexation and the costs of transporting water
were discussed. Joe Bettendorf, City Engineer stated St.
Wendel Township would find it less costly to construct their
own system if it would be possible for them. Carl Stich
stated that they just wished to get the City's feelings on
this matter. The City wi I I take the matter under advisement
and send St. Wendel Board a letter on the City's position.
Sadlo made a motion to adjourn at 10:00 p.m. if the Chair
does not recognize the clock. The Chair recognized the cloak
and extended the meeting 30 minutes.
JOE BETTENDORF, CITY ENGINEER REPORTS: 1) Loso asked if an
upgrading of Old Highway 52 is in street improvement plans.
Joe Bettendorf stated that it is not.
2) Joe stated he would prepare a feasibility report for
Seventh Avenue SE.
3) The signal project on CSAH 75 wi I I wrap up about the
second week of May, with final cleanup items into June.
Kay's Kitchen is concerned about the winter damaged sod, and
curb and gutter questions. Joe wi II discuss it with Hope
KlockeI'.
CAPITAL OUTLAY: Hazen approved the capital outlay requests of
Administration for an Okidata printer for $425 with a $100
trade in, net $325; and a fixed asset software program for
$495, both from Sunset Supply, and to look further for quotes
for a fax machine; seconded by Sadlo.
Ayes: Dehler, Sadlo, Loso, Hazen.
Nayes: None. Motion carried.
Loso made a motion to approve baseballs, catchers mask,
catchers mitts, and a bat for summer recreation to get the
equipment where it is most economical for the quality;
seconded by Hazen.
Ayes: Dehler, Sadlo, Loso, Hazen.
Nayes: None. Motion carried.
Sadlo made a motion to keep the wages of the compost

open unt il midnight, with the stipulation that there is no
liquor served in the outdoor area and that there are no noise
complaints; seconded by Hazen.

Loso made a motion to table the loader contract untiJ next
meeting; seconded by Hazen.

CITY ATTORNEY REPORTS; John Scherer, City Attorney, reported
that representël.t i ves of the Susan Roske Estate indicated that
they expect to have the Administrator of the Estate sign the
contract and return it soon.
