MEMBERS PRESENT: Mayor Steven Dehler; Members of the Council Leo Sadlo, Bob Loso, Stephanie Hazen. Clerk/Administrator Rachel Stapleton. OTHERS PRESENT: Stuart Goldschen, Judy Weyrens, Dan Nierengarten, Bud Reber, Art Rebe r, Bradley Lindgren. APPROVE AGENDA: Hazen made a. motion to ëI.pprove the a.genda; seconded by Loso. Ayes: Dehler, Sadlo, Hazen, Loso. Nayes: None. Motion carried. MINUTES: Hazen made a motion to approve the June 20 and July 3 minutes as presented; seconded by Loso. Ayes: Dehler, Sadlo, Hazen, Loso. MAYOR REPORTS: 1) Mayor requested that a.ll corrections are put in the motion to approve the minutes of past meetings, so the Counc i I can see them. 2) The Mayor and Clerk/Administrator attended a legislative update meeting in A I exandr ia., sponsored by the League of Minnesota Cities. COUNCIL REPORTS - SADLO: No report. LOSO: No report. HAZEN: Planning Commission has viewed sketches of two proposed plats, ëI.nd may be considering preliminary plats soon. OFF SALE LIQUOR ORDINANCE AMENDMENT: Rieke arrived during the discussion on the amendment. Sadlo felt that the a I lowance for a second exclusive off sale license should be a I lowed when the population reaches 4,500. Loso felt 3,200 population should a I low a second license. Dehler wa.s adverse t.o t.he requirement. of a.dvert.ising for off sale applicat.ions, Sadlo a.pproved the a.dvertising requirement.. Rieke stated that he believes in the free enterprise system. Loso made a motion to approve an a.mendment to Ord i na.nce 71 which would establish a limit to the a.mount of exclusive off sale liquor licenses, by popula.tion. Reber also discussed that previously building permits were issued for fences, but have not been issued since he was building inspector. Counc i 1 suggested that Bud, as a member of the Planning Commission, bring the matter before the Planning Commission, for a recommendation to the Counci I. The City Counc i 1 closed the meeting to discuss ma.tter pursuant to Minnesota Statutes 471.705 subd. 1d (b) (2) and to evoke attorney/client privilege for the purpose of advising the City Counc i I \1/ it h regard to legal stra.tegy matters relating to potential litigation. This portion of the meeting was tape recorded. The Mayor re-opened the meeting at 9:41 p.m. Hazen made ëI. motion to approve the following resolution accepting the Young settlement proposE!. 1 ; seconded by Rieke. Be it resolved that the City Counc i I for the City of st. Joseph accepts the proposa.l presented by Officer Young for the purpose of resolving a 1 I existing disputes arising out of Officer Young's employment with the City, pursuant to the following terms: 1. Officer Young wi I I immediël.tely tender his resignation, which resignation is to be effective July 11, 1992, or earlier upon finding comparable employment elsewhere. 2. Officer Young wi I I immediately be reinsta.ted as a. patrol officer with the St. Joseph Po lice Depël.r tment. 3. Officer Young wi I I withdraw and dismiss a pending Veteran's Preference comp I ëI.i nt relël.ting to the hiring of the St. Joseph Chief of Police. 4. The City wi 1 I withdraw ëI. two day suspension of Officer Young for insubordination and Officer Young wi I I dismiss a grievance filed with respect to that suspension. 5.
