A. My guess is th<3t the I·.rater is running of both sides of

is that when we put in G1~rD .3.nd gutter, .3.nd \I,'e get rid
of those ditches, a.nd blend those yards into the curb
and gutter, now that curb and gutter is going to take
that water somel'.rha.t, now we have crea.ted a problem. Now
loJe hël. v e to ha.ve a. pipe to take it out, a.nd the only \VëI.y
that we can ha.ve some a.ssurances tha.t we ëI.re not. going

storm sewer. He felt that. t.he City was creat.ing a.
problem, so they should pay to fix the problem t ha t. they

A. Curb and gutter is put in to protect + . edges of the

assumed that there loJas a. 66 foot right. of wa.y for

legally plël.tted street. I,.Jhen \'.re put the preliminary
assessment role together for this improvement, we found
that 1':' ne 1 r I...a.s no record of Kennedy School st.l8r
trël.nsferring that right of wa.y over to the City of St.
Joseph. I,../e researched it further a.nd found that the
property did in fB.ct. belong to the school district., B.nd
we had no right t.o be on - .¡. ;:;0 t.he City went ahead and

put. the poles in, in order t.o C1_~ t. the roa.d off, wit.h the
opinion t.hat if I·se I'" i nd up putting t.ra.ffic on some
else's property, we \... i I I have a liabilit.y problem. I f
there is no street there, vIe don't want people on it.
\.Je then went. to t.he school dist.rict and asl-;ed them for
right of way for the street a.nd they said they would
give it t.o us, but they wanted to look at their plans
first ëI.nd make sure that they didn't box themselves in.
Sometime ea.r I y this yea.r, the school district did give
the City of St. .Joseph a.n easement for that street.

and it gives us a prot.ection to the edge of t.hat.

A. I didn't see ëI.ny· trees that were in jeopa.rdy, but I

it off yeël.r a.fter year, it is not going to get any

isn't going to get cheape r.

requests to do something about the dust. Beyond that it

Joe Bettendorf: Ba.ker is ëI. pretty busy st.reet, it does carry
more traffic t.han an unimproved road should. I t is
especially difficult to deal with in the winter time.
Sooner or later something is going to have to be done,

guess is debatable. With school tr.3ffic, there is
definitely o. need.
Bob Lyons discussed the need for the City to move traffic to
CSAH 75 and that East Baker Street should be extended.
Joe Bettendorf discussed with those present, the construction
schedule .3.nd stated that the project might. ha. v €I to wait until
spring because of the tight construction schedule. Sadlo
made a motion to close the hearing at 8:25 p.m. The motion

amendment to Ordinance No. 71 rather than abolishing
it. Dehler discussed that a new amendment. t.o Ordinance
No. 71 had been drafted and required a. number of
changes, tha.t would mël. k e it difficult. for minors t.o
consume alcohol. Each establishment al lowing minors in
t.he bar \oJou I d have hire ëI. po lice officer to be on duty
the nights they allowed minors in the esta.b I ishment.
Additionally, instead of the minors wearing the arm
