Mayor Dehler ëI.t this time introduced Cra. i g Bomgaars, who discussed with the Counc i I the microphone system installed in the Council Chambers. Mr. Bomgaars wa.l ked through the operation of the system. Approve AÞ!enda. : Hazen made a motion to approve the agenda. with additions; seconded by Rieke. Motion Carried 4:0 Approve Minutes: Loso made a motion to approve the minutes of August 1, 1991 as presented, August 20, 1991 with the following corrections: Page 1952--tax levy set should be 228,112 not 28,112; and August 28, 1991 with the following corrections: Page 1953: . . . 20% of the project costs must be assessed, not bonded. The motion was seconded by Rieke. Ayes: Dehler, Rieke, Loso, Hazen Nayes: None. Motion Carried 4:0 Mayor Reports: No report. Counc i I Reports: Loso: 1) Discussed with the Counc i I the noise problems with the rental units on Old Highway 52. Residents in those units have been gathering outside of the units creating disturbances. Loso made a motion to instruct the City Attorney to look into the possibility of re-wording the noise ordinance, which would make a provision for citing a large group of people gathered in/near an apartment building crea.ting noise disturbances. The motion was seconded by Hazen. Page i9E.8 Discussion: Tab charging should be included into the possible revision. Ayes: Deh I er, Rieke, Loso, Hazen Nayes: None. t1otion Carried 4:0 2) Residents living in the rentëll units on Old High\·,ra.::i a.re parking their vehicles along the South i~est side of Centennial Park. Loso made a. motion to prohibit parking from 10:00 p.m. unt i I 6:00 a.m. along the Southwest side of Centennial Park. The motion fa i led for lack of a second. After discussing the matter further, the Counc i I \·/ou I d like the Police Chief to present at the next Counc i I meeting, the ramifications from a. safety aspect if no parking would be posted a.long the South West side of Centennial Park. 3) In a.n order to help clarify Counc i I directives, Loso made a. motion instruct the Clerk's Office to put into affect a memo system, informing personnel of Counc i I directives a.nd requests. Rieke: Pub I i c \>Jorks Superintendent, Dick laufen, received three (;3) bids for the removal and replacement of tlve ( 5 ) sidewalk sections, they 8. I' e as follows: 1. Robic Construction - - $4,680.00 2. Giroux Construct.ion - - $6,295.00 3. Klein-Georger Builders - - $5,613.00 Rieke ma.de a. motion to awa.rd the sidewalk remova.l and replacement to the low bidder, Robic Construction, for $4,680.00. The Clerk's Office is to notify Robie Construction, a.nd give them thirty (30) days to complete the job. The motion was seconded by Hazen. Ha.zen ma.de a motion to instruct Ci ty Attorney, John Scherer, to draft a proposed fence ordina.nce. The motion \.¡a.s seconded by Loso. Ayes: Dehler, Rieke, Loso, Hazen Na.yes: None. Due to other commitments, Hazen cannot Page 1957 attend the meeting ëI.nd feels thE!. t it is important for a member of the Counc i I to be present. Therefore, Hazen made a motion to send Loso to the Commission meeting on September 16, 1991. The motion WëI.S seconded by Rieke. Ayes: De hie r, Rieke, Hazen Nayes: None. Abstain: Loso Motion Carried 3:0:1 3) Sidewalk District: Their hël.s been some confusion a.s to what the Counc i I is looking for in a sidewalk district. Mayor Dehler clël.rified that the Counc i I is looking for areas that can be classified pub I i c safety sidewalk. That is, sidewalk that is frequently traveled 4) Commission Members/Terms: Hazen questioned the appropriateness of a member of the Planning Commission not living within the City Limits during his/her term. Loso stël.ted tha.t he felt a I I members of subsidiary boards should be City Residents. Dehler concurred, but felt that since the Commissions established their own bylaws, they should address the issue ëI.nd make ëI. recommendël. t ion to the Counci I. Rieke made a motion to instruct the Planning Commission to discuss membership during tenure and make a recommendation to the Counc i I at their next meeting. The motion was seconded by Loso. Ayes: Dehler, Rieke, Loso, Hazen Nayes: None. Motion Carried 4:0 OLD BUSINESS EëI. s t BëI.Ker Street Post: Loso questioned the need for the posts that are in East Baker Street. The Fire Department along with the Po lice Department have approached Counc i I Members about removing the post to assure accessibility. Hazen made a motion to instruct Dick Taufen to remove the posts on the East Baker Street, the corners of East Baker and Third St SE, East Baker and East Baker and Second Str SE. The motion was seconded by Loso. Discussion: I f any of the posts mentioned a.bove are on private property, and the residents want them to s tël.y they can, but a I I post in the right-of-way must be removed. Metro Bus: Tom Tripp, representative from the Metro Bus would like to come before the Counc i I meeting to discuss alternatives/service avai lable. Loso made a motion to invite Tom Tripp to the October ? 1991 City Counc i I Meeting to ~, present a formal presentation on pub I i c transportation. The motion was seconded by Dehler. Reber s t.a. ted the house wa.s beyond repair and it would be his recommendðtion to discontinue renting' the house. Fence on 5th Ave NW: The Building Inspector a,nd Pub I i c Works Superintendent inspected the fence and sent a. letter to the Ci ty Attorney with their findings. The Attorney wi I I send the property owner a letter stating that he is in violation of City Ordinance. Precinct #? The Clerk's Office is sti II in the process of seeking an a. Open to the Pub 1 i c Brian Schiel, 114 2nd Ave SE discussed with the Counc i I the proposed fence ordinance, and w ha t the purpose of such an or d i na.nce would be. t'1ayo r· Dehler clð.rified. that the purpose of a. fence ordin.3.nce is to try to prevent obstructions on ea.sements, and prevent fences from being built over property lines. Both neighbors, Bud Reber - - 115 Second Ave SE and Bri.3n Schei I -- 114 Second Ave SE, h a. v e agreed to the shift which wi I I straighten both property lines. ['10 t ion CaT r i ed 4:0 Baseb.3.1 I Park: Pat Schnieder, representative of the St. Joseph Basebd.1 I Team, appeared before the Counc i I to discuss the projects at the pa.r k. The Ba.seba 1 I Team is in the process of applying for a grant to help fund the sprinkler system in the basebal I pa.rk. The Baseba I I Team \-/OU I d like to sta.rt/comp I ete the project this fa II, but the gra.nt \'lÍ 1 I not be awarded until October 1991. t1r. Schneider is requesting the City consider covering the expenditures until the gr.3.nt is received. Ayes: Rieke, Loso, Hazen Nayes: Dehler Motion Carried 3: 1 The Mayor reconvened the meeting at 8:50 p.m. City Engineer Reports: Joe Bettendorf, City Engineer, presented the new City Maps. The maps included Lot/Block, Subdivision, and Zoning. 2) The report on We II #1 came back from the Hea.l th Depar tment. At this time their is no need to abandon the we I I , the filtration system is removing the benzine. The well wi I I continue to be monitored quarterly. 3) Nor th I ëI.nd Addn: Terry Schmid, developer -- Northland Addn, has been meeting with Ray Brandenburger and Harold Rothfork in an effort to secure easements for future roadway. Mr. Brandenburger has verbally agreed to grël.nt the City a perpetual roadway and utility easement across his property for a future roadway, with provisions. At the time of final plat approvël.l, Mr. Bettendorf wi I I have additional information on the provisions. Pond View Ridge: RicK Heid, developer -- Pond View Ridge, appeared before the Counc i I to discuss the proposed roads in his development. The planning commission met with the St. Cloud Area Pla.nning Organiza.tion to discuss the plat. The future transportation plan provides for a major artery adjacent to the SE Corporate Limits, and is located in Mr. Heid's Addition, drafted as 12th Ave SEt B i I I Hanson of the APO recommended to the planning commission, that all the driveways backing onto 12th Ave SE in the proposed development be eliminated. Before Mr. Heid re-drafts the deve lopment, he asked the Counc i I how they envisioned 12th Ave SE, and if they had any ideas as to how they would like to see the plat. After a lengthy discussion, MëI.yo I' Dehler informed Mr. Heid that the planning commission has not made a recommendation on the plat. Upon the recommendation of the City Attorney, Loso made a. motion to direct the P la.nning Commission at their next scheduled meeting, September 16, 1991, to make a recommendation to the City Counc i I either approving or denying the pre I imi nary plat for Pond View Ridge Addition. He feels th3.t they provide a quality service at a. reasona.b I e fee, 3.nd d.r e working at ways to improve the service a.nd qua.l i ty. ì1a.y 0 r Dehler stated that he felt the City \13.5 sold a product in 1984 and never received that product. (1'1ayo r Dehler e:<tended the meeting 20 minutes) City Attorney, John Scherer, suggested that Mr. Langley provide a pub I i c hearing and invite all cable subscribers to a. t tend and disc'-~ss ëI.ny problems. ì'1 r . Clerk/Adm Reports: 1) Budget: The Counc i I wi II meet on September 9, 1991 at 7:00 p.m. to continue reviewing, revIsIng d.nd ba.18.nc i ng the budget. 2) Wa.ter Storage Facility Grant: The grant appl ication for the i>,fa. te r Storage Facility was ma i led on August 30, 1991. 3) Noise Violations: Brad Lindgren, Po lice Chief, turned in three (3 ) noise viola.tions, they are as follows: ** 215 t'1innesota Street \.Jest ** 34 First Ave SE ** 606 East t1innesota Street d) Off SëI.I e Liquor - The ad is ready to be placed in the St. Cloud Times for the availability of an Off Sale Liquor license, but the bacKground fee must be esta.bl ished.
