Hembers Pr-esent: Mayor Steve Dehler. Members of the Counc i I Ross RieKe, Bob Loso. Deputy Clerk Judy Weyrens. Others Present: Terry Schmid, Po lice Chief Brad Lindgren. The purpose of the special meeting was to continue the reviewal and balancing of the 1992 budget. North lël.nd Addition: Terry Schmid presented the Counc i I with a drël.f t of the protective land covenants for Northland Addition. The revision of the covenants was needed to define the minimum floor requirement for split level homes. After discussion, Rieke made a motion to approve the minimum floor requirement as outlined in the protective land covenants. The covenants wi I I be included in the developers agreement. The motion was seconded by Loso. Ayes: Dehler, Rieke, Loso. Nayes: None. Motion Cëlrried 3:0 East Able Street Improvement: Residents along Able Street East petitioned to have curb and gutter placed on their property. The project has been completed and the assessment hearing needs to be I scheduled. Motion Carried 3:0 RESOLUTION DECLARING COST TO BE ASSESSED AND ORDERING PREPARATION OF PROPOSED PLANS WHEREAS. the City Engineer has been directed to proceed with the improvement of Curb and Gutter on ëI. I I real property ab~tting on the North Side of East Able Street, between Second Street Southeast, and Third Street Southea.st, and the cost thereof has been determined to be $3,918.85 of which the property owners wi I 1 pay 100% of the costs~ NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ST. JOSEPH, MINNESOTA 1. The portion of the cost of such improvement to be paid by the city is hereby dec I a.red to be $0.00 and the portion of the cost to be assessed against benefited property O\I/ne r s is declared to be $3,918.85. RESOLUTION FOR HEARING ON PROPOSED ASSESSMENT WHEREAS, by a resolution pël.S sed by the counc i 1 on r 19 -' the City Clerk was directed to prepare a proposed ëI.ssessment of the cost of improving the North side of East Able Street, between Second Street Southeast, and Third Street Southea.st, by adding Curb and Gutter, AND WHEREAS, the Clerk has notified the Counc i I that such proposed assessment has been completed ëI.nd filed in his office for pub I i c I inspection, NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ST. JOSEPH 1. A hearing sha II be held on the 17th day of October, in the City Hall at 8:00 p.m. to pass upon such proposed ëI.ssessment and ëI.t such time and place a I 1 persons owning property affected by such improvements wi I I be given a.n opportunity to be heard with reference to such assessment. 2. The City Clerk is hereby directed to cause a notice of the hearing on the proposed ëI.ssessment to be published once in the official newspaper at least two weeks prior to the hearing, and he/she shall stël.te in the notice the total cost of the improvement. The owner of any property so assessed may, at any time prior to certification of the assessment to the county auditor, pay the whole of the ëI.ssessment on such property, with interest accrued to the date of pa.yment, to the City Clerk, except that no interest s ha 1 I be charged if the entire assessment is paid within 30 days from the a.dopt i on of the ëI.ssessment.
