SPECIAL MEETING
The Council of the City of St. Joseph met in special session on Thursday,
March 18, 1976 at 7:30 p.m. in City Hall

The meeting was opened by Mayor Harry J. Knevel.
Members present: Herman Schneider, Hugo Weyrens Jr., Steve Dehler,
Harry J. Knevel; Bob Johnson.
Also present: Attorney John Knapp, Engineer Joe Bettendorf.
Absent: Bud Reber.
Fire Dept. Equipment
A motion was made by Weyrens seconded by Dehler to approve purchase of
protective fire equipment. Six sets: helmet, coat, boots - estimated
cost $150.00 per set.
Ayes: Schneider, Weyrens, Dehler, Knevel
Nayes: None.
R.R. Crossing Signals
Engineer Bettendorf reported R.R. Crossing signals installation has been
scheduled for September 1976.
Public Hearing
R.R. Crossing Relocation Project
The Public Hearing was opened at 8 p.m. by Mayor Harry J. Knevel.
Members Present: Herman Schneider, Bud Reber, Hugo Weyrens,Jr.,
Steve Dehler, Harry Knevel.
, Also present: Attorney John Knapp, Engineer Joe Bettendorf.
R.R. Crossing Relocation Project
Engineer Bettendorf presented a project construction report.
Roman Reber: questioned street width, and reason for moving street approx.
3 ft east. Street move primarily to save trees on west side
of street.
Mrs. Keith Anderson: o bj ected. Requested placement of signals at old crossing.
Keith Anderson: objected. Questioned Who desired relocation - city or
county. Believed entire population should share cost due
to safety factor.
Mrs. John Kierzek: objected. Qùestioned curb, gutter, sidewalk change,
Storm sewer enlaregment. Informed by engineer - county
paying 71% of storm sewer costs.
Mrs. Rose Reber: objected. Questioned and cited obstacle of utility cable
presently located in walkway abutting her property - object-
ed to moving street approx 3 ft east as proposed.
Mrs. Hugo Gillitzer: objected. Questioned interference of power line poles.
Mrs. Emma Danzl: objected. To second assessment for storm sewer. Previous
assessment dated 1951 (city wide assessment), cited Date Str.
. drainage problem. (Not in project)
Bill Jones: objected. Questioned control of water on College Ave.

Mrs. John Kierzek: questioned reason County did not pay all costs.
Assessment Costs: Attorney John Knapp presented a review of assessment
costs. 40% area. Present assessment total on information
sheets presented does not contain driveway assessment.
Herman Schneider: questioned amount of boulevard remaining - 7 ft east side
of street - no change west side reported by Engineer
Bettendorf.
Mrs. Kierzek: objected. Questioned benefit to abutting properties and
traffic hazards.
Mrs. Barron: objected. Cited speed control problem on relocated
CSAH #2.
Steve Dehler: Reported occurrence of fatalities at old rail crossing.
Mrs. Rennie: Questioned installation of curb and gutter at Kay's Cafe.
Parking problem cited.
Bill Jones: objected. Presented question of benefit to property ovmers
in area. Policy of deferred assessments questioned. Pro-
perties outside city to be assessed when annexed.
Art Hiemenz: objected. Questioned lack of curb at Kay's Cafe. Citing
the danger of pedestrians forced to walk in street to
avoid parked cars at Cafe. Curb installation at Kay's
to be examined.
Engineer Bettendorf: Reported storm sewer size change from 12" to 15" neces-
sary to comply with State specs and standards.
Keith Anderson: objected. Questioned curb and gutter costs. Estimated at
4.85 per ft installed. Also questioned cost of storm
sewer on per foot basis. 40% of sewer cost to area -
60% advalorem taxes - 29% of total sewer cost charged to
city. City formula of 90% area, 10% frontage to apply.
Mrs. Rennie: Question of assessment pre-payment. Property owner will
have 30 days after final assessment role established to
pay assessment without interest.
Jerry Baggenstoss: objected. Questioned 150 ft frontage assessment. Indi-
cated his frontage was 123 ft. - correction to be made.
Roman Reber: Question of R.R. crossing assessment for portion of
right of way.
Don Reber: Presented question of drainage north of railroad. Question
answer located in county specs for project portion outside
city.
Steve Dehler: Indicated city desire for safety reasons. Assessments
based on normal city policy.
Rich Winter: objected. Questioned reasons for not up-grading present
crossing. County - State requirement.

Bill Jones: objected. Requested council action be deferred to permit
people in area to take action in opposition to project.
I A ttorney Knapp: Advised action by people should follow council action on
project.
Motion to Adjourn Hearing
A motion was made by Reber seconded by Schneider to adjourn hearing at
10:45 p.m.
Ayes: Schneider, Reber, Weyrens, Dehler, Knevel.
N ayes: None.
Weyrens departure
Councilman Hugo Weyrens Jr. departed from City Hall at 10:30 p.m.
Council reconvened at 11 p.m.
Question of staking east side of College Ave N. (relocation Street) to show
property owner location. B.N. Railroad to receive notice of hearing to be
placed on assessment role.
Engineer indicated later in summer start more desirable - surfacing, sodding,
signals in September.
Restoration Question
To original state with approval by city and reduce cost by removing
restoration - curb and gutter at Kay's Cafe to be considered. Question
of council action prior to B.N. notice of hearing.
New Public Hearing
Date set for April 8, 1976 at 8 p.m. on motion by Schneider seconded
by Dehler.
Ayes: Knevel, Schneider, Reber, Dehler.
Nayes: None
Res tora tion·
Question remove from contract.
Art Hiemenz: Question of east side restoration - some sodding. Majority
favored restoration. Watering preferred by property owners.
Swim Program
$2500. cost submitted by St. Bens for summer swim program. Motion
made by Reber seconded by Steve Dehler to approve city participation
in summer swim program at St. Bens.
Ayes: Knevel, Schneider, Reber, Dehler.
Nayes: None.
Motion to adjourn made at ll: 45 p.. m.
