Minutes of Regular City Council Meeting Held on Thursday, April 8, 1976
The City Council met in regular session on Thursday, April 8, 1976 at 7:30 p.m.
in Ci ty Hall. ,
Members Present: Herman Schneider, Bud Reber, Hugo Weyrens Jr., steve Dehler,
Harry J. Knevel, Bob Johnson.
Also present: Attorney John Knapp, Engineer Joe Bettendorf.
The meeting was opened by Mayor Harry J. Knevel at 7:30 p.m.
Approval of Minutes
Minutes dated 3/4 - 3/15 - 3/25/76 were submitted to council . Meetings
minutes deferred until next meeting.
Treasurer Report Presented
Motion was made by Herman Schneider seconded by Weyrens to direct clerk
to clarify Water Fund and Plant Operation and Maint. Fund with Treasurer.
Ayes: Schneider, Weyrens, Dehler, Knevel
Nayes: None
Forester: Reported ill and unable to attend meeting.
Refuse Pickup May I
A special refuse pickup has been scheduled for May 1, 8 a.m. Notice
to be published April 19, 1976.
Recreation Grant Status
·Letters to State Rep. and Senator report by Mayor Knevel. Return I
communication from Rep. Bernie Brinkman acknowledged and filed.
R.R. Crossing Relocation Public Hearing
Public Hearing opened at 8 p.m. by Mayor Harry Knevel. Reason for
continuance of hearing to allow Burlington Northern an opportunity to
be heard. No representative of the railroad was present.
Stake placement question
Stakes were placed on east side of College Ave. N. in project area
to allow property owners an opportunity to see street placement.
Kay's Cafe Curb Question
Engineer indicated meeting with Kay but not having dicusssed matter
with O.C. Dierkhising. Better traffic control at this point with curb
and gutter indicated by engineer. Plans now in St. Paul with no curb -
change in plans would be council option.
Motion on Kays Cafe Curb and Gutter
A motion was made by Weyrens seconded by Dehler to change specs on
project relating to Kay's Cafe - curb cafe frontage on College Ave.
Safety factor cited as primary reason for curb and gutter installation
with water flow control also listed as important. No parking area
will be sacrificed by curb and gutter installation.
Ayes: Schneider, Reber, Weyrens, Dehler, Knevel.

Keith Anderson: Questitned method of determining assessment totals.

Attorne~ Knapp - Assessment Review Knapp indicated
A torney John Knapp presented an assessment review.
the added Railroad assessment will result in some reduction in other
I assessments. Final assessment totals cannot be determined until after
project bid has been accepted. 40% of Project cost charged to City to
be assessed to area property owners. 60% of City cost to be placed on
ad valorem taxes. Cost of new street to be assumed by County~- Area
assessments based on 90% area 10% frontage assessment policy.
Keith Anderson: Questioned responsibility of repairs for abondoned CSAH #2.
Engineer Bettendorf: Engineer stated present County #2 would be patched
under normal county maintenance. The county policy is to repair only
in projects of street re-Iocation.
Mrs. Emma Danzl: Questioned amount of street re-placement relating to present
property lines.
Engineer: Reported West side of street curb line to remain in place. Street
to be Widened approximately 30 inches on east side.
Council reported safety factor as primary reason for Rail Crossing and street
re-location. City has responsibility as crossing is located within city limits.
Hearing Adjournment
A motion was made by Schneider seconded by Reber to close hearing at 8:30 p.m.
Ayes: Schneider, Reber, WeYrens, Dehler, Khevel.
Nayes: None.
Motion to proceed on Project
A motion was made by Dehler seconded by Weyrens to proceed with project,
direct engineer to prepare final plans and specs.
Ayes: Schneider, Reber, Weyrens, Dehler, Knevel.
Nayes: None. Motion carried.
Time Schedule
To coincide with County, NSP, Bell Telephone schedules, R.R. installation
of signals also scheduled for Sept. Aug 1 - 7, 1976 estimated as tentative
construction start schedule. Spring bid advantage to re-advertise on
h~gh bids if necessary. Bid opening possible at end of May. Project
review at next regular meeting.
PCA Communications
Report presented by Engineer Bettendorf. Feb 18, 1976 letter: engineer-
ing firm responding - red tape - paper wo~k cited by engineer - continued
monitoring to be made. Matter to Mini Convention in Duluth.
June Meeting Change
Motion was made by Schneider seconded by Dehler to change June meeting
on lOth to June 3, 1976 to allow members to attend Mini Convention of
League of Municipalities in Duluth, Mn.
Ayes: Schneider, Reber, Weyrens, Dehler
Nayes: None. Motion carried.
City Clerk instructed to contact Rep. Brinkman, Sen Schrom '(by Letter of
phone call to meet in PCA office with Engineer Bettendorf and City Clerk
approved on motion by Weyrens seconded by Schneider

Nayes: None. Motion carried.

Central Minnesota Regional Development Commission Resolution
Action deferred until a C?~ staff member can appear before council
(call CMRDC). Motion made by Weyrens seconded by Dehler to have clerk
contact to determine urgency. I

Nayes: None. Motion carried.
(Resolution requesting 208 Planning Agency designation by Governor)
Agenda: Charley Burg
Also present Pat Schneider - Burg reported on coming season of Joes
Baseball Team - 33 members (applicants) all local - expressed apprecia-
tion for cooperationthe past year.
Needs cited:
load of lime - split cost of lime with ball club - (21 ton), (approx
$125.00 city cost share). Motion was made by Reber seconded by Weyrens
to approve purchase of lime for infield.
Ayes: Schneider, Reber, Weyrens, Dehler, Knevel.
Nayes: None. Motion carried.
Batting cage fencing needed, dugouts - bleachers need paint,
concession stand - in planning stage.
Handbook
A motion was made by Reber seconded by Dehler to approve purchase of
Handbook for City.
Ayes: Schneider, Reber, Weyrens, Dehler, Knevel.
Nayes: None. Motion carried.
Excavation Ordinance
Proposal examined - several minor changes were recommended. Engineer
-
to prepare corrected cop,ts - copy to clerk and Attorney Knapp.
Hollow Park Drainage Plan
Engineer to upgrade plan submitted by Merickel Construction for lot
drainage in Hollow Park.
Merickel - ChristIe Question
Engineer reported on Merickel-Christle case. City to retain indemnity
bond until matter has been settled.
Plant Operation Agreement
Method examination. Data flow available to be provided by engineering
firm.
Land Ti tIe
Abstract search to be made on north side - property abutting plant area.
Mini Convention
June lOth Mini Convention day attendance approved for members attending
Ayes: Schneider, Reber, WeYrens, Dehler, Knevel.
Nayes: None.
Resignation of Al Maleska
Resignation presented. A motion was made by Weyrens seconded by Reber
to accept resignation of Maleska from City Planning Commission. Resig-
nation placed on file.

Planning Commission AäpOintment
A motion was ma e by Weyrens seconded by Schneider to approve appoint-
ment of Mrs. Dick (Marlene) Schroeder to the City Planning Commission
filling the vacancy.
Ayes: Schneider, Reber, Weyrens, Dehler, Khevel.
Nayes: None. Motion carried.
Posting Meeting Notice
A motion was made by Dehler seconded by Schneider to direct clerk to
post all council meeting notices on City Hall entrance.
Ayes: Schneider, Reber, Weyrens, Dehler, Knevel.
Nayes: None. Motion carried.
Bills presented
A motion was made by Reber seconded by Weyrens to approve bills as
presented. Fire equipment statement to receive further examination
and determination.
Ayes: Schneider, Reber, Weyrens, Dehler, Khevel.
Nayes: None. Motion carried.
Parking ticket question
Parking ticket disputed for lack of sign posting on particular street
refused council rebate.
