Minutes of Special City Council Meeting Held on Thursday, April 22, 1976
The Council of the City of St. Joseph met in special session on Thursday, April 22,
1976 at 7:30 p.m. in City Hall. I
Members present: Herman Schneider, Bud Reber, Hugo Weyrens Jr., Steve Dehler,
Harry Khevel, Bob Johnson.
Also present were: Fire Chief Mike Loso, Asst Fire Chief Bill Wasner, Police Chief
Bill Lorentz.
Mayor Khevel opened meeting at 7:30 p.m.
Fire Chief report: Chief Loso presented the application of Steve Schirb er for
membership in the fire dept.
Motion made by We~ens seconded by Dehler to approve application as presented
Ayes: Schneider, Reber, Weyrens, Dehler, Knevel.
Nayes: None.
Chief Loso presented documents relating to fire radio base station. Motorola
Corp. information presented. Cost factors presented (remotes $290.00 each)
Base station $3200. - 3400.
Communications program to be f~ther explored at a future date. To coor-
dinate city wide communications ~ystem. Special meeting to be scheduled.
Liquor Hearing Hearing opened at 8:05 p.m.
Licensees present:, El Paso, Inc. ; Claude, Marion & Carol Menzhuber; La Playette,
Mark Zimmer; Salls Cafe, Dale Schneider. 16 other persons were in attendance. I
Police Officers Testimony on Complaints
La Playette Bar - Time 02:25 - Date 1/15/76 - Officer Young
Officer Young was checking doors when he noticed the lights were still on
at t~~ La Pla~ette. He looked in the window and saw three males, one behind
the::a.nd two s,tting at the bar. There was at least one beer bottle. on
the bar with contents in it. Officer knocked on door and was let in. There
was no beer present then. Officer Young saw Mark Zimmer stop by the La and
told him of the incident.
Salls Cafe - Time 01:30 - Date 3/20/76 - Officer Ewald/Young
While checking the bars in town, officers found people present in bar area
at Salls Cafe. Officers advised owner, Dale Schneider, that this area had
to be 'tacated. There were no alcoholic beverages present at the bar or
else where. People present in bar area were playing pool and foosball.
El Paso Bar - Time 01:45 - Date 1/31/76 - Officer Young/Ewald
Officers found the El Paso open. They entered and found six beers on a&
table with people sitting around it. The officers took the beers and placed
them on the bar and told the people it was closing time; to which they
replied "who are these Boy Scouts to tell us when to drink or not." The
owner came over to the officers and explained these people were only the
SnoJoes; to which the officers replied, "they should know better." The
owner then complained that police didnlt answer his burglar alarm.
Subject was enformed that next time call the police. I
EI Paso Bar - Time 01:45 - Date 3/20/76 - Officers Young/Ewald
Officers checked the EI Paso Bar, cars were present in the parking lot.
Officers found a number of people inside the bar; one female was drinking
a beer at the bar. Officers advised her that she would have to dispose of
the beer. Female replied that there is nothing wrong with employeels having
a drink after work. Female was advised this is not true. The owner of the
bar got hot tempered about the alarm system and doors in the bar. Officers

Mark Zimmer: 2 employees, 1 patron, reported by Mark. Zimmer reportedly out of
town on night of Jan 15, 1976 - informed help he would return by 2:30 a.m.
Explained clean-up proceedures at night - after 2 a.m. or later owner and
employees have drink after work is completed.
I Chief Lorentz: reported all bars checked on rotating basis
Councilman Weyrens: questioned drinking after work by employees in establishment.
Attorney Knapp ordinance not intended to restrict owner or employees.
Lorentz requested ruling on employee drinking in bars after hours
Knevel requested licensees cooperate with Police Officers.
Mrs. Menzhuber indicated insurance and police requirements are complied with.
Dale Schneider reported no drinking problem after hours.
Mayor Knevel Cooperation and officer good judgement important.
Lorentz reported method and policy of incident report. Did not consider the
present complaints serious. Indicated bars were cooperating.
Weyrens Suggested officers contact owner or employees upon entering bar initially.
Sno Joe member reported on El Paso incident - clean up bottles on table hour or longer
Attorney Knapp explained ordinance time limit set as aid for clean up of bar.
I Dehler Incidents do not indicate a lack of cooperation - met with bar owners
found no complaints. A motion was made by Dehler seconded by Schneider that
complaints do not warrant suspension - owners had not been uncooperative.
, Reber questioned difference relating to Midway Bar suspension.
Vote on motion Ayes: Schneider, Dehler, Knevel.
Nayes: Reber.
Abstaining: Weyrens. Motion carried.
John Schroeder suggested council consult League of Municipalities or Attorney
General office. Questioned lack of cooperation question.
Zimmer inquired of police attitude toward bar owners. Ewald reported attitudes
good of all owners present. Young reported never refused entrance all
cooperative - owners seem interested - often thank you rather than argument.
Proposed Ordinance changes window question - Section 10 reviewed by Attorney Knapp.
Menzhuber cited problem of window - required three at El Paso.
Lorentz suggested use of peeps - wide angle lense more desirable than officer
enter of building. No size specified in ordinance.
Menzhuber suggested officers locate peeps in all places.
I Weyrens requested officers to contact owner rather than approach table or persons
involved in incident first.
Mayor thanked licencees for appearing.
Hearing adjourned at 9:05 p.m. Council recessed for 10 minutes.

St. Pat's Paraße review: questioned council reason for banning St. Pat I
Day Parade. Mayor Knevel presented a report on this years parade. Incidents
license to exhibit conduct a discredit to both schools - an excuse for a
big bash - original intend to reflect with credit to institutions: Important
provisions listed: no breaking of law, security provided by students, parade
route established with police, litter disposal provided. 4th of July parade
incidents reported by Zimmer. St. Johns student, par~ director, presented
his apology for incidents. Parade directors to appear before council next
January to discuss parade plans.
Resolution: Special Liquor Act: A motion was made by Scbre ider seconded by Reber

Nayes: None
A motion was made by Reber seconded by Weyrens to approve 3.2 on-sale license
application of St. Joseph Joes Baseball Club for season.
Ayes: Schneider, Reber, Weyrens, Dehler, Knevel.
Nayes: None
A motion was made by Weyrens seconded by Schneider to approve permit to have
carnival unit in city by Recreation Assn. in conjunction with Spring Fling.
Ayes: Schneider, Reber, Weyrens, Dehler, Knevel
Nayes: None
A motion was made by Reber seconded by Schneider to approve Lions 3.2 on-sale I
license for May 14 - 15 - 16 1976
Ayes: Schneider, Reber, Weyrens, Dehler, Knevel
Nayes: None
Fire District Contract Proposed contract reviewed - changes suggested. Attorney
Knapp to prepare final copy. May 11 - 9 p.m. City - Township meeting on
Fire District concept - check with Thralow to confirm date. Letter to
St. Bens on contribution to purchase equipment.
Police Report Lorentz presented the police report for r&lrch 1976. Report on file.
Council to meet at 8 p.m. Thursday, April 29, 1976
Dick Taufen report signs and signpost needs cited. Costs to be obtained.
A motion was made by Reber seconded by Weyrens to approve attendance at one day
seminar, Wastewater Treatment Plant on Thurday, April 29, 1976. (TI4t1'&.IV ,

Nayes: None.
Motion made by Weyrens.seconded by Schneider to approve Arbor Day planting of
BiCentenial Tree to be registered \vith statewide Heritage Tree Program.
Ayes: Schneider, Reber, Weyrens, Dehler, Knevel.
