Pursuant to due call and notice thereof the City Council of the City of st.
Joseph met in special session on Thursday, September 21, 1978 at 7:30 p.m.
in City Hall.
Members Present: Mayor Hugo B. Weyrens; Councilmen Herman Schneider, Steve
Dehler, Mike Husen; Clerk Bob Johnson; Police Chief Bill Lorentz.
(Bud Reber arrived at 8:45 p.m.)
Police Report: Chief Bill Lorentz presented the July and August police reports.
Two minor liquor violations were reported and examined.
Additional training requirements cited by Lorentz. 2-Day driving
school @ $110.00.
A motion was made by Husen seconded by Schneider to approve patrolman
Robert Schwegel's attendance at emergency driving school.
Ayes: Weyrens, Schneider, Dehler, Husen.
Naye s : None Motion carried.
Attorney Tom Jovanovich: Reported on East Side Project.
1) no more time extensions
2) declare breach of contract
3) notify surety
4) proceed with law suit
5) complete job
Requested approval to hire consultant.
Resolution #1:
In event construction is not completed by September 30, 1978,
or if it appears that contract will not be completed by September 30,
1978, the City Engineer shall declare Kenko, Inc. in breach of contract.
If this is the case City Attorney is instructed to bring an action
against Kenko, Inc. for breach of contract and bring an action against
the Bond surety.
Resolution #2:
city Attorney is authorized to retain Richard Schieffer as
consultant in action against Kenko, Inc. and Kenko's bond surety.
A motion was made by Dehler seconded by Husen to approve Resolution #1.
Ayes: Weyrens, Schneider, Dehler, Husen.
Nayes: None Motion carried.
A motion was made by Husen seconded by Schneider to approve Resolution #2.
Ayes: Weyrens, Schneider, Dehler, Husen.
Nayes: None Motion carried.
Contractor Bonding: Attorney presented information relating to contractor
bonding. Electrical proof of licensing - Fidelity bonding requirements
listed - $2,000 - $5,000 - Liability insurance - electrical (50,000 -
100,000 - 10,000) certificate of W. C. lnsurance.
Election Canvas: Primary election canvas was approved on a motion by Husen
seconded by Dehler.
Ayes: Weyrens, Schneider, Dehler, Husen.
Nayes: None Motion carried.
Budget Summary: A motion was made by Schneider seconded by Reber to approve
publication of summary proposed budget statement.
Ayes: Weyrens, Schneider, Dehler, Husen, Reber.
Nayes: None Motion carried.

Certification of Special Assessments: A motion was made by Husen seconded by
Dehler to approve and certify to County Auditor the following special
assessment rolls: Special Assessment No. 14 - 1978 East Side Imp.
Project No. 77-2311 and Special assessment No. 15 - 1978-RStreet Imp.
Project No. 78-6012.
Ayes: Weyrens, Schneider, Dehler, Husen, Reber.
Nayes: None Motion carried.
Assessor Salary Adjustment: A motion was made by Dehler seconded by Husen to
approve an increase of $50.00 per month for the City Assessor,
effective March 1, 1979.
Ayes: Weyrens, Schneider, Dehler, Husen, Reber.
Nayes: None Motion carried.
Maintenance Report: Used truck market - plow equipment report presented.
Several units to be examined by maintenance department.
Bocce Ball Set: Clerk reported arrival of the govenors bocce ball set.
Fire Department Membership: A motion was made by Reber seconded by Husen to
approve Duane pfannenstein's membership in the st. Joseph Fire Dept.
Ayes: Weyrens, Schneider, Dehler, Husen, Reber.
Nayes: None ~Iotion carried.
Planning Report: Minutes of Planning Commission meeting of September 11, 1978
were distributed.
Attorney to rewrite B-1 and B-2 for council consideration.
City planning survey results were presented for council consideration.
A motion was made by Reber seconded by Schneider to approve payment
of the APO assessment for 1978 in the amount of $410.78.
Ayes: Weyrens, Schneider, Dehler, Husen, Reber.
Nayes: None ;-Iotion carried.
Park Board: Storm damage reported in ~Iillstream Park and other areas of City
property. Improvement items in park project reviewed prior to Park
Board consideration.
stearns County League meeting report presented by Steve Dehler.
Senior citizen program - voluntary work program examined.
APO Meeting: 26 members present. Mayor presented report.
Five years use for present st. Cloud landfill. Committe report
relating to APO personnel salary and benefits also presented by
Mayor \\'eyrens.
A motion was made by Schneider seconded by Dehler to adjourn at 12:15 a.m.
