Joseph met in special session on Thursday, April 5, 1979 at 7:30 p.m. in City Hall. Members Present: Acting Mayor Herman Schneider; Councilmen Bud Reber, steve I Dehler, Mike Husen; Clerk Bob Johnson; Treasurer Leo Sadlo. Absent: Mayor Hugo Weyrens (out of state). Also present Tom Jovanovich, City Attorney. Treasurer Report: Treasurer Leo Sadlo presented the monthly fund report. A motion was made by Dehler seconded by Husen to approve the treasurer's report as presented. Ayes: Schneider, Reber, Dehler, Husen. Nayes: None Motion carried. Donabauer - Hanson: Al Donabauer, Donabauer Well Drilling, and Dave Hanson, representative of Johnson's Screens, were present to discuss feasi- bility and methods of upgrading Well No. 1. The purpose and advan- tages of drilling a test well were also reviewed. The City Council will study the matter further. Mark zimmer, La Playette: The letter written to Mark Zimmer, La Playette manager, written by City Attorney Jovanovich was presented and related to the purchase of intoxicating liquor by a minor. The question of all liquor violations being reported in the monthly police report was raised. The violation was omitted in error, reportedly. Roport by the licensee indicated an adult purchased the liquor for the minor. Roman Reber: Roman Reber was present regards Amendment to Ordinance No. 58 - 1 Parking prohibitions during snow season November 1 to April 1 - problem of towing vehicles out of City cited. Reber indicated he had called and received assurance vehicles would not be towed due to the near- spring like weather conditions several days prior to the actual towing of two vehicles from in front of his residence. Parking;ticket collec- tion policy by towing firm was also challenged. Mr. Reber requested Council consider providing a parking area within the City for towed vehicles. Further, he requested Council impose a moratorium on all towing of vehicles to become effective immediately. Reber requested reimbursement for towing charges. A motion was made by Husen seconded by Reber to approve payment of towing charges by the City. and refer parking tickets back to City orney. Ayes: Schneider, Reber, Dehler, Hus~n. Engineer Bettendorf: Engineer Bettendorf presented data on Wastewater plant Industrial Cost Recovery and User Charge system now required by the EPA prior to receiving the grant award for Step 3 of the plant Up- grading project. Motion to Amend Grant Amount: A motion was made by Reber seconded by Husen to authorize Clerk to request Minnesota pollution Control Agency amend I grant amount by $774.41 to defray engineering fees for preparation of a required Industrial Cost Recovery and User Charge system. Ayes: Schneider, Reber, Dehler, Husen. Nayes: None Motion carried. 881 city south Boundary: Information presented relating to south boundary line running through College of st. Benedict Campus. Copy of letter sent to Finance Director Mike Fritz by City Clerk was presented to Council members. Legal description indicates boundary running south of Regina, ~ Aurora and Corona Halls with only one apartment being in the Township. City has suggested st. Benedicts search their records to determine the ~- accuracy of City findings and consider a boundary change to include a~l structures of residence on campus with City limits prior to the 1980 Census enumeration. Copy of letter in CSB file. plant Operation Agreement: plant operation agreement examined. Engineer to obtain information and cost data on sewerage measuring devices. Millstream Addition Feasibility: Engineer reported request to do feasibility study on Millstream Addition for Landmark Realty. Conflict of Interest Question: City Attorney Tom Jovanovich requested City Council delay action on Engineer work on Millstream Addition on con- tractural basis for Landmark Realty until further study can be made of conflict of interest possibility. Engineer to further study options for sanitary sewer service to Millstream Addition. Patrolman Schwegel Resignation: Chief Bill Lorentz presented the resignation of Police Patrolman Robert Schwegel effective April 16, 1979. A motion was made by Dehler seconded by Reber to accept patrolman Schwegel's resignation~ Ayes: Schneider, Reber, Dehler, Husen. Nayes: None Motion carried. Police Officer Ad: A motion was made by Dehler seconded by Husen to approve advertising for a Police officer. - Ayes: Schneider, Reber, Dehler, Husen. Nayes: None Motion carried. Police Reserve Policy: A motion was made by Husen seconded by Dehler to suspend Police Reserve policy to permit police reserves to work alone for a period of six months. Voting for the motion: Reber, Husen, Dehler. Abstaining: Schneider. Motion carried. Conflict of Interest Question: Attorney Jovanovich indicated a City Official having an interest conflicting with the public interest must not participate in voting. Rugby Club Party: A request by the st. John's Rugby Cluh to use City Park facilities for a May 5th party was denied on motion by Reber seconded by Dehler due to liability question. Ayes: Schneider, Reber, Dehler, Husen. Nayes: None Motion carried. Bills Approved: A motion was made by Dehler seconded by Reber to approve bills for payment as presented. Ayes: Schneider, Reber, Dehler, Husen. Nayes: None Motion carried. Park Board Toilet Facility: A motion was made by Husen seconded by Dehler to - approve expenditure of $500.00 from Millstream Park fund for an addi- tlonal toilet facility in Millstream Park located near Lions Shelter. The estimate of $500.00 was presented by Bud Reber. Ayes: Schneid8r, Hc~ber, :Qehler, Hu~en. Ayes: Schneider, Reber, Dehler, Husen. Nayes: None Motion carried. - Memorial Park Fence: Total cost for Memorial Park baseball field fencing (outfield section) was estimated at $2700.00. Request for $1500.00, the balance of funding need was taken under consideration by City Council. Minutes Approved: Minutes of the March 8, 1979 Council meeting were approved on motion by Husen seconded by Dehler. Ayes: Schneider, Reber, Dehler, Husen. Nayes: None Motion carried. Ordinance #52 Amendment: A motion was made by Husen seconded by Reber to amend Ordinance No. 52, a building Ordinance, to allow Clerk to co-sign building permits. Ayes: Schneider, Reber, Dehler, Husen. Nayes: None Motion carried. Adjournment: A motion was made by Reber seconded by Dehler to adjourn at 12:30 a.m. Ayes: Schneider, Reber, Dehler, Husen.
